Sir,
As the period has nearly arrived when it will be necessary to
consider and frame the Estimates of Receipt and Expenditure of this
Colony for 1867, it would be a great convenience for me to know your
decision upon the claims advanced for re-imbursement of outlay onaccount
account of maintenance of Lighthouses and Conveyance of Mails as laid
before you in my Despatches No 71 dated 23rd August 1865, and No
72 of the same date.

Ansr that the two subjects to which Govr Kennedy calls attention were referred to Mr Seymour for his report on the 31 Oct and 12 Decr 1865: that no report was submitted by him to the S. State, and that as the Union of V.C.I. with B.C. necessarily entails measures for the adjustment for their respective liabilities, which will now be undertaken by Governor Seymour, that Officer will, in the opinion of Lord Carnarvon, have soon if not already considered the arrangements which it will be best to make for the settlement of these claims on the part of V.C.I.

Writing away from the papers I may not be strictly accurate in my remembrance as to the circes; but my impression is that reference of the question was made to Mr Seymour whilst he was in England. If so he must have been precluded, in consequence of his absence from the spot & without documents, from answering the enquiry of the S.S. satisfactorily. He, therefore, probably reserved the subject for his return. This, however, is conjecture on my part. But the further and more substantial explanation of the delay in settling these claims is that they were disputed by B.C.—that there was reason to conclude that they wd be adjusted in the financial arrangements which wd take place on the union of the Colonies, & that Mr Seymour not being in the administration of the Govt Mr Birch cd not have ventured
upon any definitive proceeding. These are generally the
reasons why it has not been possible to press for a settlement of
this question.
