<p><persName ref="prs:hawes_b">Hawes</persName> reports that the <orgName ref="org:war_office">War Office</orgName> is not prepared to pay for the replacement of stores lost on the <name ref="vsl:briseis" type="vessel">Briseis</name>. He asks that the <orgName ref="org:colonial_office">Colonial Office</orgName> take up the question of insurance and liability with <orgName ref="org:treasury">the Treasury</orgName>.</p>

<p>The minutes observe <q>no alternative</q> and appeal to <orgName ref="org:treasury">the Treasury</orgName> for arbitration.</p>

<p>Enclosed is a draft from <persName ref="prs:elliot_tf">Elliot</persName> to <persName ref="prs:hamilton_ga">G. A. Hamilton</persName>, Treasury, <date when="1859-04-25">25 April 1859</date>, enclosing correspondence with the War Department respecting the loss of the <name ref="vsl:briseis" type="vessel">Briseis</name> and asking which department should properly defray the cost of replacement.</p>

In reply to your Letter of the <date when="1859-03-23">23<hi style="vertical-align: super; font-size: 80%;">rd</hi> of March</date>, on the
subject of the supply of Stores for <placeName ref="plc:british_columbia">British Columbia</placeName>, to replace
those lost in the "<name ref="vsl:briseis" type="vessel">Briseis</name>";
</p>
<p>
I am directed by <persName ref="prs:peel_j">Secretary Major General Peel</persName> to acquaint
you, for the information of <persName ref="prs:lytton_egeb">Sir E. Bulwer Lytton</persName>, that the
stores in question will be provided as requested, (with the
exception, in conformity with your Letter, of the "Iron Houses"
and the "Hay &amp; Oats") as speedily as possible.
</p>
<p>
With reference however to the question raised as to the
cost of the new supply being <fw type="catchword" style="text-align: right;">defrayed</fw><pb facs="co_60_06/co_60_06_00270v.jpg"/>defrayed out of Military funds,
"in conformity with the general practice of the Department,
which acts as its own Insurer," I am to observe that although
it is the practice of the War Department not to insure the
Stores sent by Sea—of which, as it appears by <persName ref="prs:merivale_h">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Merivale</persName>'s
Letter, the <orgName ref="org:colonial_office">Colonial Office</orgName> was fully aware, there is no reason
for charging the loss of these Stores upon this Department.

<p>
An application however must necessarily be made to the
<orgName ref="org:treasury">Lords of the Treasury</orgName>, if the value of the Stores in question
is to be charged to Imperial Funds, and therefore <persName ref="prs:peel_j">Major
General Peel</persName> is of opinion that such application should be
made by the Colonial rather than by the War Department.
</p>
<p>
In the case of any future supplies of Stores for the
Colonies which may be required to be furnished by this
Department, <persName ref="prs:peel_j">Major General Peel</persName> requests that you <fw type="catchword" style="text-align: right;">will</fw><pb facs="co_60_06/co_60_06_00271r.jpg"/>will move
<persName ref="prs:lytton_egeb">Sir E. Bulwer Lytton</persName> to consider whether the Insurance for such
supplies should not in all similar cases be effected by the
<orgName ref="org:colonial_office">Colonial Office</orgName>, and the priced Bills of Lading transmitted
to the Colonial Agent who may be appointed for the purpose.
</p>
<p>
In the present case, the priced Bills of Lading were sent
to <persName ref="prs:moody_rc">Col. Moody</persName> before he left England, who could have insured the
Stores had he thought fit to do so.

sum in our Colonial Estimate for <placeName ref="plc:british_columbia">B. Columbia</placeName> to
cover the expense of the loss sustained in the Briseis—which
this Country must pay for.

I am afraid that there is no alternative. <persName ref="prs:lytton_egeb">Sir E. Lytton</persName>
in the letter to the <orgName ref="org:war_office">W.O.</orgName> of the <date when="1859-03-23">23 March</date> says that the
lot of the articles consumed in the <name ref="vsl:briseis" type="vessel">Briseis</name> must be
replaced—the only question being under what head Military
or Colonial the expense is to be placed.
</ab>
<p>
Perhaps however under the circumstances it will be
best to send corresp. to Treasury &amp; drawing their L<hi style="vertical-align: super; font-size: 80%;">dships</hi>
attention to the necessity, <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> is admitted on all hands,
of replacing the missing stores request to know their
opinion as to the proper head under <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> the sum s<hi style="vertical-align: super; font-size: 80%;">d</hi> be placed.
