<p><persName ref="prs:carnarvon">Carnarvon</persName> forwards <persName ref="prs:barnston_g">George Barnston</persName>’s letter containing an extract of a letter from <persName ref="prs:barnston_g">Barnston</persName>’s son, <persName ref="prs:barnston">John Barnston</persName>, complaining about his exclusion from practicing as a colonial lawyer in <q>the superior courts of <placeName ref="plc:vancouver_island">Vancouvers Island</placeName> and <placeName ref="plc:british_columbia">British Columbia</placeName>.</q> <persName ref="prs:carnarvon">Carnarvon</persName> points out that if <persName ref="prs:douglas_j">Douglas</persName> decides to remove the disqualification, the local legislature has the power to effect this in <placeName ref="plc:vancouver_island">Vancouver Island</placeName>, and in <placeName ref="plc:british_columbia">BC</placeName>. This would require an amendment of <q>the Judges order in the court</q> which allows non-English lawyers <q>temporary admission only.</q></p>
<p>Contained within the despatch is <persName ref="prs:barnston_g">Barnston</persName>’s letter to <persName ref="prs:lytton_egeb">Lytton</persName>, <date when="1859-04-04">4 April 1859</date>, <q>respectfully</q> begging that action be taken by Her Majesty’s government.</p>

I transmit to you herewith the copy of a letter which I have
received from <persName ref="prs:barnston">M<hi style="vertical-align: super; font-size: 80%;">r</hi> John Barnston</persName> of Montreal, <!--<pb facs="co_410_01/co_410_01_00102v.jpg"/>-->containing an extract from
one [letter] from his son, a Canadian Barrister, residing in <placeName ref="plc:vancouver_island">Vancouvers
Island</placeName>, complaining of his exclusion, as a Colonial Lawyer, from
practising in the<pb facs="rg7_g8c_07/rg7_g8c_07_00186v.jpg"/> superior courts of <placeName ref="plc:vancouver_island">Vancouvers Island</placeName>, and <placeName ref="plc:british_columbia">British
Columbia</placeName>.

<persName ref="prs:barnston">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Barnston</persName>'s application that this disqualification may be
removed appears to me in itself to be a reasonable one, but it is a
matter in which I am unwilling to interfere with your discretion, and I
must leave it to you to decide whether his request can properly be
complied with. Should you see no objection to the admission of Lawyers
educated either in Canada or in the British Colonies generally the local
legislature has the power in<pb facs="rg7_g8c_07/rg7_g8c_07_00187r.jpg"/> <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> to effect this, <!--<pb facs="co_410_01/co_410_01_00103r.jpg"/>-->as I
have pointed out in my recent despatch No. 45 of the <date when="1859-04-09">9<hi style="vertical-align: super; font-size: 80%;">th</hi> April</date> on a
similar application from the Scottish Solicitors, and you will be at
liberty to introduce the necessary measure for the purpose. In <placeName ref="plc:british_columbia">British
Columbia</placeName> all that would be necessary would be the requisite amendment of
the Judges order in Court transmitted with your despatch No. 65 of the
<date when="1859-01-06">6<hi style="vertical-align: super; font-size: 80%;">th</hi> January</date> which provides for their temporary admission only.
