<seg type="snippet" xml:id="B606M01_snippet_1">On the <date when="1858-12-24">24<hi style="vertical-align: super; font-size: 80%;">th</hi> December 1858</date> <persName ref="prs:rice">Bernard Rice</persName> (a Native of
Carrickcloughan in the Parish of Killeavy in the County of Armagh)
was Shot to death by one <persName ref="prs:foster_w">William Foster</persName> at <placeName ref="plc:yale">Fort Yale</placeName>, <placeName ref="plc:british_columbia">British
Columbia</placeName>.</seg> An Inquest was held before <persName ref="prs:whannell">P.B. Whannell</persName> Justice of the
Peace and Coroner, and a Verdict of Wilful Murder by <persName ref="prs:foster_w">William Foster</persName>
was found.
</p>
<p>
<persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Elizabeth Rice</persName> the Mother and next of kin of <persName ref="prs:rice">Bernard Rice</persName>
lives in Castle Street in the Town of Newry.
</p>
<p>
On the <date when="1859-01-14">14<hi style="vertical-align: super; font-size: 80%;">th</hi> of January 1859</date>, <persName ref="prs:whannell">Captain Whannell</persName> wrote to
<persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName> informing her of the Murder of her Son, and subsequently
a Second letter, enclosing a Copy of the Verdict, and further Stating
<milestone unit="section" rend=".ind on"/>
</p>
<p>
That among <persName ref="prs:rice">Bernard Rice</persName>'s Papers, a Bill for £20, drawn at 7 days
Sight by the Provincial Bank at Newry on Spooner Atwood &amp; Co <placeName ref="plc:london">London</placeName>,
was found, which Bill, <persName ref="prs:whannell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Whannell</persName> retained until he should hear
from <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName>.
</p>
<p>
That, on the person of <persName ref="prs:rice">Bernard Rice</persName> he had found, and had taken
Charge of a Bag Containing Gold Dust value 69 Dollars and 50
Cents—In Silver Coin One Dollar &amp; 85 Cents and a "Colt Revolver."
</p>
<p>
That the Deceased's friend had Sold his Effects and placed same
in his <persName ref="prs:whannell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Whannell</persName>s hands amounting to 91 Dollars and requesting
Instruction for the disposal of the Effects.

On the <date when="1858-12-29">29<hi style="vertical-align: super; font-size: 80%;">th</hi> Dec<hi style="vertical-align: super; font-size: 80%;">r</hi> 1858</date> Two men, named <persName ref="prs:musgrave">Simpson Musgrove</persName> and
<persName ref="prs:williams_tho">Thomas Williams</persName>, wrote to <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName> from <placeName ref="plc:yale">Fort Yale</placeName>, stating the
death of her Son and stating, "400 Dollars were on his person. That
they had Sold his Claim &amp; Effects for 91 Dollars and handed Same to the
Authorities." See Copy N<hi style="vertical-align: super; font-size: 80%;">o</hi> 2.
</p>
<p>
In <date when="1859-03">March 1859</date> <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName> received these letters and answered
both directly.
</p>
<p>
On the <date when="1859-06-10">10<hi style="vertical-align: super; font-size: 80%;">th</hi> of June</date> <persName ref="prs:williams_tho">Williams</persName> &amp; <persName ref="prs:musgrave">Musgrove</persName> wrote from <placeName ref="plc:yale">Fort Yale</placeName>
acknowledging receipt of <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName>s letter (on <date when="1859-06-08">8<hi style="vertical-align: super; font-size: 80%;">th</hi> June</date>) wherein
one States, "I have just been at the Magistrate of this place to see if
he had sent the Money to you and that the Magistrate said he had written
to <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName> on the <date when="1859-01-27">27<hi style="vertical-align: super; font-size: 80%;">th</hi> of January</date>." See Copy N<hi style="vertical-align: super; font-size: 80%;">o</hi> 3.

<p>
Not having received a reply from <persName ref="prs:whannell">Capt<hi style="vertical-align: super; font-size: 80%;">n</hi> Whannell</persName>, <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName>
instructed me to write to him and on the <date when="1859-08-03">3<hi style="vertical-align: super; font-size: 80%;">d</hi> of Aug<hi style="vertical-align: super; font-size: 80%;">t</hi> 1859</date> I
addressed to <persName ref="prs:whannell">Capt<hi style="vertical-align: super; font-size: 80%;">n</hi> Whannell</persName> a letter explaining that <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName>
was Entitled to the property of her Son, and requesting same would
be remitted to her.
</p>
<p>
But up to the present, no reply has been made to this letter.
Nor has she heard from <persName ref="prs:whannell">Capt<hi style="vertical-align: super; font-size: 80%;">n</hi> Whannell</persName>. See Copy N<hi style="vertical-align: super; font-size: 80%;">o</hi> 4.
</p>
<p>
The Bill for £20 was sent by <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName> to her Son to sustain
him while in bad health in the Colony. The Second Bill she now
holds, It having been returned to her through the Post Office at
Puget Sound after her Sons death.

I enclose a Copy of <persName ref="prs:rice">Bernard Rice</persName>s letter to his Mother
acknowledging receipt of the £20 Bill, and explaining that, it having
been the Second Bill of Exchange, it was not Negotiable. See Copy
N<hi style="vertical-align: super; font-size: 80%;">o</hi> 5.

I beg on the part of <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName> Your Lordship will be pleased
to cause inquiry to be made into the facts, and direct <persName ref="prs:whannell">Capt<hi style="vertical-align: super; font-size: 80%;">n</hi>
Whannell</persName> to remit to <persName ref="prs:rice_e">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Rice</persName> the Effects of her Son <persName ref="prs:rice">Bernard Rice</persName>,
which came to the hands of <persName ref="prs:whannell">Capt<hi style="vertical-align: super; font-size: 80%;">n</hi> Whannell</persName>, and if possible, to
bring <persName ref="prs:foster_w">William Foster</persName> to Justice.

We do not possess the information requisite for us to act upon

Governor, directing him to institute the necessary enquiries, &amp;

present a Justice of the Peace. Inform the applicant of the course
taken.
