<persName ref="prs:newcastle">Newcastle</persName> informs <persName ref="prs:douglas_j">Douglas</persName> that his proclamation <q>prescribing the conditions on which unsurveyed
Agricultural lands may be occupied in <placeName ref="plc:british_columbia">British Columbia</placeName></q> cannot be approved until <persName ref="prs:newcastle">Newcastle</persName>
receives <persName ref="prs:douglas_j">Douglas</persName>'s feedback on <persName ref="prs:clarke">Clarke</persName>'s proposal, and <persName ref="prs:douglas_j">Douglas</persName> makes the changes
to the proclamation which are outlined in the attached report from <q>the Emigration Commissioners.</q>

I have to acknowledge the receipt of your despatch N<hi style="vertical-align: super; font-size: 80%;">o</hi> 5 of the
<date when="1860-01-12">12<hi style="vertical-align: super; font-size: 80%;">th</hi> of January</date> enclosing a Proclamation issued by you prescribing
the conditions on which unsurveyed Agricultural lands may be occupied in
<placeName ref="plc:british_columbia">British Columbia</placeName>.
</p>
<p>
The difficulties you experienced in providing surveyed <pb facs="rg7_g8c_09/rg7_g8c_09_00113v.jpg"/>country
lands for agricultural Settlers were explained in your despatches of the
<date when="1859-07-04">4<hi style="vertical-align: super; font-size: 80%;">th</hi> July</date> and <date when="1859-10-18">18<hi style="vertical-align: super; font-size: 80%;">th</hi> of October last</date> and the present Proclamation
carries into effect the measures to which you had found yourself compelled to
resort of granting occupation of unsurveyed land with a future right of
preemption.
</p>
<p>
The Proclamation has been laid before Parliament in compliance with
the provisions of the Act 21-22 Vic: Cap. 99, but I shall delay to
convey to you any final decision <fw type="catchword" style="text-align: right;">upon</fw><pb facs="rg7_g8c_09/rg7_g8c_09_00114r.jpg"/>upon it until I shall have received
your report upon the scheme of <persName ref="prs:clarke">Captain Clarke</persName> R.E. for the disposal of
the Crown Lands of <placeName ref="plc:british_columbia">British Columbia</placeName> which I forwarded to you with my
despatch N<hi style="vertical-align: super; font-size: 80%;">o</hi> 3 of the <date when="1860-01-07">7<hi style="vertical-align: super; font-size: 80%;">th</hi> of January</date> which has crossed your
despatch now under acknowledgement.
</p>
<p>
In the meantime it may be useful to communicate to you the enclosed
observations of the Emigration Commissioners in which
some necessary
amendments of the Proclamation issued by you are pointed <fw type="catchword" style="text-align: right;">out</fw><pb facs="rg7_g8c_09/rg7_g8c_09_00114v.jpg"/>out.
