<persName ref="prs:berens_hh">Berens</persName> informs <persName ref="prs:newcastle">Newcastle</persName> that the <orgName ref="org:hbc">HBC</orgName>
has accepted <q>a Memorandum of Agreement, dated <date when="1861-10-11">October 11th 1861</date>,</q> settling the
<orgName ref="org:hbc">company</orgName>'s land claims in <placeName ref="plc:british_columbia">British Columbia</placeName>.
The minutes recommend against appointing <persName ref="prs:moody_rc">Moody</persName> as arbitrator and suggest that <persName ref="prs:gosset_wd">Gosset</persName>
fill the position instead.

I have the honour to acknowledge the receipt of a letter
addressed to me by <persName ref="prs:elliot_tf">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Elliot</persName>, under date the <date when="1861-11-02">2<hi style="vertical-align: super; font-size: 80%;">nd</hi> instant</date>,
on the subject of a Memorandum of Agreement, dated <date when="1861-10-11">October 11<hi style="vertical-align: super; font-size: 80%;">th</hi>
1861</date>, transmitted for Your Grace's consideration by the Emigration
Board, which had been settled between <persName ref="prs:walcott_s">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Walcott</persName> on the part
of the Colonial Land and Emigration Commissioners, and <persName ref="prs:dallas">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Dallas</persName>, accompanied by <persName ref="prs:maynard">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Maynard</persName>, on the part of the
<orgName ref="org:hbc">Hudson's Bay Company</orgName><fw type="catchword" style="text-align: right;">in</fw><pb facs="co_60_12/co_60_12_00159v.jpg"/> in reference to certain proposals made by
<persName ref="prs:douglas_j">Governor Douglas</persName> for the Settlement of the Land claims of the
Company in <placeName ref="plc:british_columbia">British Columbia</placeName>.
</p>
<p>
<persName ref="prs:elliot_tf">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Elliot</persName> states that Your Grace is willing to
adopt this arrangement, and request to be informed whether the
Directors are in like manner prepared to express their assent
to it, in order that in that case the requisite steps may be
taken for carrying it into effect without delay.
</p>
<p>
In reply I have the honour to inform Your Grace that I
have laid a Copy of the said Memorandum of Agreement,<fw type="catchword" style="text-align: right;">together</fw><pb facs="co_60_12/co_60_12_00160r.jpg"/> together
with <persName ref="prs:elliot_tf">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Elliot</persName>'s letter, before my Colleagues in the
direction of the <orgName ref="org:hbc">Hudson's Bay Company</orgName>, and that I am now
empowered by the Board to give the assent of this Company to
the proposed arrangement.
</p>
<p>
The Memorandum of Agreement will be communicated, without
delay, to the Company's Officers in <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> with
instructions to use their best endeavours to carry the same into effect.
</p>

But there remains the important point of the selection
of the arbitrator on the part of the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice>. <persName ref="prs:walcott_s">M<hi style="vertical-align: super; font-size: 80%;">r</hi> <hi style="text-decoration: underline;">Walcott</hi></persName>
has suggested the name of <persName ref="prs:moody_rc">Colonel Moody</persName> merely because he
knows of no other. I confess however that I should strongly
deprecate that selection; the objections to him are I think
these, first that he is not sufficiently clear-headed, secondly,
that he has not the gift of prospering in what he undertakes,
&amp; thirdly that he is on bad terms with <persName ref="prs:douglas_j">the
Governor</persName>, which is
in itself a most weighty reason against his employment. It
would be a source of discord and an obstacle in the way of
all his recommendations.
</p>
<p>
The only other person of adequate position in the Colony
that I know of; is <persName ref="prs:gosset_wd">Capt. Gosset</persName> R.E. His capacity cannot be
doubted, and his acquirements as an Engineer &amp; a surveyor would
be very appropriate. Out of fear that he might be deficient
in conciliation and I entirely feel the desirableness of not
having differences with the other arbitrators unless they be
really both important and inevitable.
</p>
<p>
Still if as I apprehend, the choice lied between<pb facs="co_60_12/co_60_12_00161r.jpg"/> the two, I should much prefer <persName ref="prs:gosset_wd">Capt<hi style="vertical-align: super; font-size: 80%;">n</hi> Gosset</persName> to <persName ref="prs:moody_rc">Colonel Moody</persName>,
for the simple reason that, with equal integrity, the abler
of the two men appears to me the right one to select for a
difficult public employment.
</p>
<p>
A paragraph will have to be added to the Draft to <persName ref="prs:douglas_j">the
Governor</persName> naming <persName ref="prs:gosset_wd">Captain Gosset</persName>, if he should be the person chosen.

conduct the ordinary business; he will therefore be,
as it were, one of the <hi style="text-decoration: underline;">disputants</hi> in case of differences,
&amp; therefore not fit to be selected as arbitrator. This
seems to facilitate the matter, &amp; I have shaped the last
paragraph accordingly.
