<persName ref="prs:hamilton_ga">Hamilton</persName> writes <persName ref="prs:rogers_f">Rogers</persName> to inform <persName ref="prs:newcastle">Newcastle</persName> that the
<orgName ref="org:treasury">Treasury</orgName> does not wish to be involved in negotiations between the government and the <orgName ref="org:hbc">HBC</orgName> regarding the
<orgName ref="org:hbc">company</orgName>'s land claims on <placeName ref="plc:vancouver_island">Vancouver Island</placeName> unless the <orgName ref="org:hbc">HBC</orgName>
is offered a financial settlement. The minutes show that the negotiating path the <orgName ref="org:colonial_office">Colonial Office</orgName> intended to follow was to
have the Judicial Committee of the Privy Council address <q>the question of <hi style="text-decoration: underline;">title</hi> only,</q> and then have negotiations with
the <orgName ref="org:hbc">HBC</orgName> to settle <q>the question of the amount of indemnity.</q>

With reference to <persName ref="prs:elliot_tf">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Elliot</persName>'s letter of <date when="1861-02-15">15<hi style="vertical-align: super; font-size: 80%;">th</hi>
inst</date>, respecting the title of The <orgName ref="org:hbc">Hudson's Bay Company</orgName> to
certain tracts of land in <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>, and <placeName ref="plc:british_columbia">British Columbia</placeName>; I am directed by The Lords Commissioners of Her
Majesty's Treasury to request, that you will state to The
<persName ref="prs:newcastle">Duke of Newcastle</persName>, that, if the proposed Reference to The Judicial Committee of the Privy Council comprehends merely
the question of Title to the Lands in question, My Lords<fw type="catchword" style="text-align: right;">are</fw><pb facs="co_60_12/co_60_12_00195v.jpg"/>
are of opinion that They are not called upon to become Parties
to the Reference; but if any question relating to Compensation,
to be awarded to the <orgName ref="org:hbc">Hudson's Bay Company</orgName>, in respect of such
lands, is involved in the Reference; then, before My Lords can
give Their consent to the proposed proceeding, They request
to be furnished with the precise claim of The Company, and the
actual reply, which The Secretary of State has directed to be
made to it, as well as the grounds, on which it is proposed to
oppose the claims of the Company before The Privy Council.

Some confusion and misapprehension appears to have
arisen on this subject. When <persName ref="prs:reeve">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Reeve</persName>s' letter of
<date when="1861-07-09">9 July</date> was received, pointing out that the H.B.Co's
petitions raised the question of pecuniary indemnity &amp;
therefore that the concurrence of <orgName ref="org:treasury">the Treasury</orgName> in the
reference to the Judicial Committee was necessary, I
saw <persName ref="prs:reeve">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Reeve</persName>s, by <persName ref="prs:fortescue">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Fortescue</persName>'s desire—and explained to him that the intention of the Col<hi style="vertical-align: super; font-size: 80%;">l</hi> Office
had been to refer to the Judicial Comm<hi style="vertical-align: super; font-size: 80%;">ee</hi> the question of
<hi style="text-decoration: underline;">title</hi> only—leaving the question of the amount of indemnity to be afterwards settled between the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice>
&amp; the C<hi style="vertical-align: super; font-size: 80%;">o</hi>. He recommended that a letter to that effect
should be written and I understood that if that was done
the<pb facs="co_60_12/co_60_12_00197v.jpg"/> Order of reference to the Judicial Committee would be
so limited. Accordingly the letter of <date when="1861-07-31">31 July</date> was written.
It seems to me that that letter states with sufficient
clearness the proposed limitation of the reference—but if
not, I can only suggest that <persName ref="prs:reeve">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Reeve</persName>s should be requested
to point out what further communication would be necessary
for the purpose, and to suggest the terms in which the limitation
should be expressed. Is it possible that he may have altogether
overlooked the letter of <date when="1861-07-31">31 July</date>?
</ab>
<p>
I assume that the intention to limit the reference to the
question of title is still adhered to. I do not see how the
Judicial Committee could enter on the question of the amount of
indemnity. To assess it elsewhere than on the spot would
involve the expense &amp; delay of bringing witnesses from<pb facs="co_60_12/co_60_12_00198r.jpg"/> the
Colony to this Country—and even then with an unsatisfactory
result. <orgName ref="org:treasury">The Treasury</orgName> were, I think, right in considering that
the letter to them of <date when="1861-07-31">31 July</date> was not intended to elicit an answer.
