<persName ref="prs:douglas_j">Douglas</persName> forwards <persName ref="prs:newcastle">Newcastle</persName> a statement from <persName ref="prs:begbie_mb">Begbie</persName> denying any involvement in mining
speculation and complaining that he is not obligated to answer questions concerning his <q>own private property.</q> <persName ref="prs:douglas_j">Douglas</persName> writes that he
informed <persName ref="prs:begbie_mb">Begbie</persName> that public officials must avoid conflicts of interest. <persName ref="prs:elliot_tf">Elliot</persName> minutes that <q>Begbie's denial
appears to me to be as complete a one as could be expected, although he has conveyed it in rather lawyerlike language.</q>

Adverting to my Despatch N<hi style="vertical-align: super; font-size: 80%;">o</hi> 45 of the <date when="1862-11-04">4<hi style="vertical-align: super; font-size: 80%;">th</hi> Ultimo</date>,
wherein I submitted to Your Grace copy of two Circulars which I had caused to be issued in connection with the subject of Gold Commissioners holding an interest in Mining<fw type="catchword" style="text-align: right;">claims</fw><pb facs="co_60_13/co_60_13_00543v.jpg"/> claims, I have the honor to acquaint Your Grace that in consequence of a report being generally circulated that <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName>, the Judge of <placeName ref="plc:british_columbia">British Columbia</placeName>, had, during his recent absence on Circuit in <placeName ref="plc:cariboo_region">Carribou</placeName>, purchased an interest in a Mining claim, I deemed it right to call upon him to state whether there existed any foundation for such report.

2. The reply of <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName>, which I here enclose, contains, I am happy to say, the most<fw type="catchword" style="text-align: right;">unqualified</fw><pb facs="co_60_13/co_60_13_00543r.jpg"/> unqualified contradiction of the report in question.
</p>
<p>
3. Your Grace will observe <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName>'s remarks upon the right which may exist to inquire into matters in connection with private property. I have informed <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName> very distinctly that in all cases in which it may be considered that the private interests of public servants conflict with the due discharge of
their public duties, it is the undoubted right of the Executive to institute the fullest inquiry not only as an<fw type="catchword" style="text-align: right;">obligation</fw><pb facs="co_60_13/co_60_13_00543v.jpg"/> obligation due the public, but also as an act of justice to the individual concerned.

It seems to me that the Governor has acted quite rightly
in this matter. In a Colony especially the Chief Judge should
keep himself disengaged from speculative transactions.

I <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> rather suspect from what <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName> says ab<hi style="vertical-align: super; font-size: 80%;">t</hi>
his having advanced money to a certain <persName ref="prs:walker_xx">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Walker</persName> to enable him
to buy a mining claim that the Judge has not been able to resist
employing his spare cash to advantage. The rate at wh<hi style="vertical-align: super; font-size: 80%;">h</hi> money
is lent in <placeName ref="plc:british_columbia">B.C.</placeName> is from 10 to 20, &amp; 30 p<hi style="vertical-align: super; font-size: 80%;">r</hi> cent.

express entire approval of the Governor's declaration of the
right of the Executive <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> to inquire at any time into a
question of property which might cause the private interests of
public servants to conflict with the due discharge of their
public duties.
