I have had the honor to receive your Grace's despatches
N<hi style="vertical-align: super; font-size: 80%;">o</hi> 68 of the <date when="1864-02-16">16<hi style="vertical-align: super; font-size: 80%;">th</hi></date>, and Separate of the <date when="1864-02-28">28<hi style="vertical-align: super; font-size: 80%;">th</hi> February</date>
announcing the appointment of <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Joseph William Trutch</persName> to
be Surveyor General of this colony. It appears from the
second of these communications that your<fw type="catchword" style="text-align: right;">Grace</fw><pb facs="co_60_18/co_60_18_00253v.jpg"/> Grace had been
informed that <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> was engaged in some contracts for
Public Works, and I am directed to report, in case there
was any such contracts which remained unfulfilled, how far
they were liable to conflict with his public duties, and
whether any plan can be suggested for enabling <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> to
divest himself, without undue sacrifice, of such of them
as would both<fw type="catchword" style="text-align: right;">continue</fw><pb facs="co_60_18/co_60_18_00254r.jpg"/> continue for a considerable time in execution,
and would appear also to be incompatible with his official duties.
</p>
<p>
2. The gazette notice of <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName>'s appointment,
copied into the colonial papers, reached him before
I received your Grace's first despatch. He called on me
in Victoria, and, in reply to my inquiries, stated that
he proposed such interest in the Tolls on bridges in <placeName ref="plc:british_columbia">British
Columbia</placeName> that<fw type="catchword" style="text-align: right;">he</fw><pb facs="co_60_18/co_60_18_00254v.jpg"/> he scarcely thought he could accept the
appointment intended to be conferred on him.
</p>
<p>
3. There are two great routes from <placeName ref="plc:new_westminster">New Westminster</placeName>
to the gold mines of <placeName ref="plc:cariboo_region">Cariboo</placeName>. They run together up the
<placeName ref="plc:fraser_river">Fraser</placeName> to the mouth of <placeName ref="plc:harrison_river">Harrison's River</placeName>. The "<placeName ref="plc:douglas">Douglas</placeName>
<placeName ref="plc:lillooet">Lillooet</placeName>" line here diverges and follows the last named
river into <placeName ref="plc:harrison_lake">Harrison's Lake</placeName>. By "portages," <placeName ref="plc:lillooet">Lillooet</placeName>, <placeName ref="plc:anderson_lake">Anderson</placeName>'s
and <placeName ref="plc:seton_lake">Seton's Lakes</placeName> are successively reached; then the line
rejoins the <placeName ref="plc:fraser_river">Fraser</placeName> which it<fw type="catchword" style="text-align: right;">crosses</fw><pb facs="co_60_18/co_60_18_00255r.jpg"/> crosses and runs over land to
<placeName ref="plc:clinton">Clinton</placeName> where it forms a junction with the conflicting
"<placeName ref="plc:yale">Yale</placeName>-<placeName ref="plc:lytton">Lytton</placeName>" route. From this point there is but one
established road to <placeName ref="plc:cariboo_region">Cariboo</placeName>. The alternative mode of proceeding
from the mouth of <placeName ref="plc:harrison_river">Harrison's River</placeName> to <placeName ref="plc:clinton">Clinton</placeName>, is by
navigating the <placeName ref="plc:fraser_river">Fraser</placeName> as far as <placeName ref="plc:yale">Yale</placeName>, and then travelling
by the great trunk road which crosses the main river at
<placeName ref="plc:spuzzum">Spuzzum</placeName>, and <placeName ref="plc:thompson_river">Thompson's River</placeName> a little above <placeName ref="plc:lytton">Lytton</placeName>.
Both of the rival routes<fw type="catchword" style="text-align: right;">are</fw><pb facs="co_60_18/co_60_18_00255v.jpg"/> are kept up by tolls. Vested and
conflicting interests have sprung up in each line. Newspaper
puffs endeavour to attract the traffic, and the boilers
of the several steamers are strained to their utmost to
insure speed and obtain custom. The number of passengers
and amount of freight annually going to the diggings being
now ascertained with an approach to correctness everything
that benefits<fw type="catchword" style="text-align: right;">the</fw><pb facs="co_60_18/co_60_18_00256r.jpg"/> the <placeName ref="plc:douglas">Douglas</placeName>-<placeName ref="plc:lillooet">Lillooet</placeName> road injures that
by <placeName ref="plc:hope">Hope</placeName>-<placeName ref="plc:yale">Yale</placeName> &amp; <placeName ref="plc:lytton">Lytton</placeName>. Conversely if the traffic on
the first named line be impaired, the profits on the Second increase.
</p>
<p>
4. <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> is the sole proprietor of the magnificent
suspension bridge which spans the <placeName ref="plc:fraser_river">Fraser</placeName> at <placeName ref="plc:spuzzum">Spuzzum</placeName>. He
levies certain tolls upon it for six years and a half under
Ordinance<fw type="catchword" style="text-align: right;">N<hi style="vertical-align: super; font-size: 80%;">o</hi></fw><pb facs="co_60_18/co_60_18_00256v.jpg"/> N<hi style="vertical-align: super; font-size: 80%;">o</hi> 10 of <date when="1863">1863</date>—after which it becomes the
property of the Government. The tolls upon this, the
<placeName ref="plc:alexandria">Alexandra</placeName> bridge, are now worth about four thousand pounds (£4000)
a year to <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName>, but the colony is tolerably prosperous,
the traffic is increasing and beginning to shew a decided
preference for the <placeName ref="plc:yale">Yale</placeName>-<placeName ref="plc:lytton">Lytton</placeName> line. In all probability
therefore<fw type="catchword" style="text-align: right;">M<hi style="vertical-align: super; font-size: 80%;">r</hi></fw><pb facs="co_60_18/co_60_18_00257r.jpg"/> <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName>'s receipts from the <placeName ref="plc:alexandria">Alexandra</placeName> bridge
will rise year by year. He likewise owns one half of the
bridge about to be opened to traffic over <placeName ref="plc:thompson_river">Thomson's River</placeName>
above <placeName ref="plc:lytton">Lytton</placeName>. The tolls on this bridge are likely to amount to
four thousand (£4000) a year also. Thus <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> has at present
an interest<fw type="catchword" style="text-align: right;">to</fw><pb facs="co_60_18/co_60_18_00257r.jpg"/> to the extent of six-thousand (£6000) a year in one of the
competing roads of the Colony.
</p>
<p>
5. It is difficult to imagine a case in which a man's
interests were more clearly against the Strict performance
of his public duties. Both lines of travel would be in his
charge as Surveyor General.<fw type="catchword" style="text-align: right;">As</fw><pb facs="co_60_18/co_60_18_00258r.jpg"/> As such he would receive a
salary of eight hundred (£800) a year. But let him neglect the
<placeName ref="plc:douglas">Douglas</placeName>-<placeName ref="plc:lillooet">Lillooet</placeName> route. Let him allow one of the many
portages between the lakes to become impassible, the whole
traffic rushes over his own bridges and <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName>'s private
income rises to ten or twelve<fw type="catchword" style="text-align: right;">thousand</fw><pb facs="co_60_18/co_60_18_00258v.jpg"/> thousand a year. But interests
to the extent of two million of dollars exist between <placeName ref="plc:douglas">Douglas</placeName>
and <placeName ref="plc:lillooet">Lillooet</placeName>. They are owned by men of Singular energy. I
enclose a hand-bill showing the competition which exists
between the rival routes, and I suggest for your Grace's
consideration that the framers of it<fw type="catchword" style="text-align: right;">would</fw><pb facs="co_60_18/co_60_18_00259r.jpg"/> would not tamely
see their fortunes placed at the mercy of the proprietor
of the <placeName ref="plc:yale">Yale</placeName>-<placeName ref="plc:lytton">Lytton</placeName> bridges. That M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch cannot accept the
office of Surveyor General and retain property in the Alexandra
and Thompson's Bridges was his own conviction in Victoria. In
New<fw type="catchword" style="text-align: right;">Westminster</fw><pb facs="co_60_18/co_60_18_00259v.jpg"/> Westminster he has applied to be installed in the office
conferred on him by your Grace stating that in his conscience he
feels he will do justice to both routes and knows how to
disregard common clamour and newspaper abuse.
</p>
<p>
6. I considered the matter in Council.<fw type="catchword" style="text-align: right;">It</fw><pb facs="co_60_18/co_60_18_00260r.jpg"/> It was without
hesitation agreed that <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> could not hold the office
and his bridges. I was pressed to appoint some one else. The
spring had come back. There were about one hundred thousand
pounds to be expended on Public Works and my predecessor had
virtually shut up the Lands and Works Office. It was<fw type="catchword" style="text-align: right;">indispensable</fw><pb facs="co_60_18/co_60_18_00260v.jpg"/> indispensable
that an appointment should be made at once. There were but two
men fit for the office in the colony, <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> and <persName ref="prs:holmes">Captain
Holmes</persName> of the Royal Artillery. It was unanimously urged upon
me to nominate the latter gentleman without delay. To this
course I said I would<fw type="catchword" style="text-align: right;">only</fw><pb facs="co_60_18/co_60_18_00261r.jpg"/> only resort as a last necessity. The two
names had been before your Grace together and <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> had
been preferred. I was bound therefore, if possible, to carry
out your selection. Again <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> has much greater knowledge
of the country than <persName ref="prs:holmes">Captain
Holmes</persName>, who accompanied me from
England in<fw type="catchword" style="text-align: right;">the</fw><pb facs="co_60_18/co_60_18_00261v.jpg"/> the capacity of Private Secretary, can as yet possibly
have. Besides <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> has shown in his roads and bridges great
engineering skill. Without therefore asserting any superiority
in Scientific or practical knowledge to be possessed by <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> I considered that he was the most fit man for the office
as the matter stood<fw type="catchword" style="text-align: right;">before</fw><pb facs="co_60_18/co_60_18_00262r.jpg"/> before us. I therefore requested the Council to
suggest some other means, if possible of meeting the difficulty. I
was advised, since I would not employ <persName ref="prs:holmes">Captain
Holmes</persName>, to purchase
<persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName>'s interest in the bridges over <placeName ref="plc:fraser_river">Fraser</placeName> and <placeName ref="plc:thompson_river">Thompson's River</placeName>.
</p>
<p>
7. It would be<fw type="catchword" style="text-align: right;">taking</fw><pb facs="co_60_18/co_60_18_00262v.jpg"/> taking up too much of your Grace's time if I were
to detail the most tedious, unsatisfactory and unpopular negotiations
which passed between <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> and myself on this subject, and how
I repeatedly sought the assistance of both Executive and
Legislative Councils, and had the matter<fw type="catchword" style="text-align: right;">thrown</fw><pb facs="co_60_18/co_60_18_00263r.jpg"/> thrown back upon me
for decision. I made most liberal offers. I would take this
favorable Season as an average and receive on behalf of the
Government the tolls of the <placeName ref="plc:alexandria">Alexandra</placeName> bridge this year, and pay
him the same amount now and annually during the continuance
of his rights. That is to<fw type="catchword" style="text-align: right;">say</fw><pb facs="co_60_18/co_60_18_00263v.jpg"/> say, supposing the receipts this year
to be four thousand pounds (£4000) <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> would receive payment
at that rate for six years and a half. That is, omitting last
years profits twenty six thousand pounds (£26,000) for a bridge which
cost eight thousand. I offered him further a bonus of from ten<fw type="catchword" style="text-align: right;">to</fw><pb facs="co_60_18/co_60_18_00264r.jpg"/>
to fifteen thousand pounds (£10,000/£15,000) at the end of his term of
incumbency should the amount of goods leaving <placeName ref="plc:new_westminster">New Westminster</placeName> for the
interior increase in the ratio upon which <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> based his
claims. He refused these extremely liberal terms, and the
negotiations to the great satisfaction I<fw type="catchword" style="text-align: right;">believe</fw><pb facs="co_60_18/co_60_18_00264v.jpg"/> believe of the public,
and certainly to my own relief, came to an end.
</p>
<p>
8. In the emergency I was about following the advice of
the Council and requesting <persName ref="prs:holmes">Captain
Holmes</persName> to act as Surveyor
General, and proceed at once to make the great road<fw type="catchword" style="text-align: right;">into</fw><pb facs="co_60_18/co_60_18_00265r.jpg"/> into
<placeName ref="plc:cariboo_region">Cariboo</placeName> a work on which other Surveyors had failed, when <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> proposed an entirely new arrangement. This has, subject
to certain modifications of my own, been accepted.
</p>
<p>
9. <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> has been appointed Surveyor General. He
retains his<fw type="catchword" style="text-align: right;">property</fw><pb facs="co_60_18/co_60_18_00265v.jpg"/> property in the bridges for the present. I will
therefore only employ him in works above the <placeName ref="plc:clinton">Clinton</placeName> Junction
or below the mouth of <placeName ref="plc:harrison_river">Harrison's River</placeName>. He will, with such
assistance as I can afford, at once lay out the line of road
into <placeName ref="plc:cariboo_region">Cariboo</placeName>. Time presses and <persName ref="prs:holmes">Captain
Holmes</persName><fw type="catchword" style="text-align: right;">has</fw><pb facs="co_60_18/co_60_18_00266r.jpg"/> has consented
to take charge of a portion of the work, being paid as an Ordinary
Surveyor. As soon as the Survey shall be completed <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName>
will go to England. He will report himself to your Grace and he
will further endeavour to sell the rights he holds in the
Columbian<fw type="catchword" style="text-align: right;">bridges</fw><pb facs="co_60_18/co_60_18_00266v.jpg"/> bridges. It seems irregular my granting him leave of
absence so early, but the case is peculiar. He cannot touch
either the <placeName ref="plc:douglas">Douglas</placeName>-<placeName ref="plc:lillooet">Lillooet</placeName> or <placeName ref="plc:yale">Yale</placeName>-<placeName ref="plc:lytton">Lytton</placeName> road as he is now
circumstanced, yet both require attention. <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> will draw
no salary when absent from the Colony. He<fw type="catchword" style="text-align: right;">will</fw><pb facs="co_60_18/co_60_18_00267r.jpg"/> will have to satisfy
me by the <date when="1865-03-01">1<hi style="vertical-align: super; font-size: 80%;">st</hi> March 1865</date> that he has parted with his interests
in the bridges, or else resign.
</p>
<p>
10. I will make the only arrangement possible during <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName>'s absence and place <persName ref="prs:holmes">Captain
Holmes</persName> in charge of the
Survey department.
</p>
<p>
11. I enclose a<fw type="catchword" style="text-align: right;">copy</fw><pb facs="co_60_18/co_60_18_00267v.jpg"/> copy of the letter written by my orders to
accompany <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName>'s commission when handed to him.

It will be observed from 10453 that I was apprehensive

with his appointment as Surveyor General.

It seems to me that <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> <persName ref="prs:seymour_f">Seymour</persName> has done all that lay
in his power to overcome the difficulties of the case, &amp; that
his proceedings to that end <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be app<hi style="vertical-align: super; font-size: 80%;">d</hi>.

result of his negotiations for getting rid of his property.

You will observe that <persName ref="prs:seymour_f">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Seymour</persName> was desirous of getting
the place of Surveyor for <persName ref="prs:holmes">Capt. Holmes</persName>. And you will remember
that <persName ref="prs:holmes">Capt Holmes</persName> was nominated to the Col<hi style="vertical-align: super; font-size: 80%;">l</hi> Secretaryship of
<placeName ref="plc:british_honduras">B Honduras</placeName>, but that the <placeName ref="plc:british_honduras">Honduras</placeName> people deprecated the
appointment, alleging that he drank.

<p>
My own impression is that unless <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName> is a very
honest man indeed, his apptmt as Surveyor is to be deprecated.
And that, if the B. Columbians are satisfied with <persName ref="prs:holmes">Capt Holmes</persName>
as to <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> it may be difficult to ascertain the truth it
m<hi style="vertical-align: super; font-size: 80%;">t</hi> be best to leave him where he is, &amp; not inflict him
on <placeName ref="plc:british_honduras">Honduras</placeName> <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> not (I suppose) be satisfied.
</p>

But the question must await <persName ref="prs:trutch_jw">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trutch</persName>'s arrival here.

State that <persName ref="prs:cardwell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> C</persName>. sees no reason to object to the course
<choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> <persName ref="prs:seymour_f">M<hi style="vertical-align: super; font-size: 80%;">r</hi> S</persName>. has found himself obliged to take.
