<p><persName ref="prs:seymour_f">Seymour</persName> submits a report from <persName ref="prs:birch">Birch</persName> on <persName ref="prs:birch">Birch</persName>’s travels to the <placeName ref="plc:kootenay_region">Kootenay</placeName> gold mining operations. He reports that <persName ref="prs:birch">Birch</persName> <q>at considerable personal risk</q> returned to <placeName ref="plc:new_westminster">New Westminster</placeName> with about 75 lbs of gold. Included with this document is the Code of Laws of <placeName ref="plc:wild_horse_river">Wild Horse Creek</placeName>, concerning mining regulations
 and rules of conduct, <date when="1864-04-10">10 April 1864</date>.</p>

With reference to my despatches mentioned in the Margin,

<ref target="#marg1">*</ref>

I have now much pleasure in laying before you the very interesting
Account furnished by <persName ref="prs:birch">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Arthur Birch</persName>, the Colonial Secretary, of
his visit to the<fw type="catchword" style="text-align: right;">Kootenay</fw><pb facs="co_60_19/co_60_19_00406v.jpg"/> <placeName ref="plc:kootenay_region">Kootenay</placeName> Gold Mines.
</p>
<p>
2. It is with particular satisfaction that I call your
attention to <persName ref="prs:birch">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Birch</persName>'s account of the Admirable manner in which
<persName ref="prs:haynes_jc">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Haynes</persName> has performed the very difficult duties imposed upon
him. As but little work is performed in our Gold mines during
the winter I have, as stated in my despatch No. 70 of the <date when="1864-11-24">24<hi style="vertical-align: super; font-size: 80%;">th</hi>
Instant</date>, appointed <persName ref="prs:haynes_jc">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Haynes</persName> to be a member of the Legislative
Council. His<fw type="catchword" style="text-align: right;">knowledge</fw><pb facs="co_60_19/co_60_19_00407r.jpg"/> knowledge of the new diggings will prove very
valuable to us. <persName ref="prs:young_wc">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName> who acted with <persName ref="prs:haynes_jc">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Haynes</persName> at <placeName ref="plc:osoyoos">Osooyos</placeName>
will take his place on the <placeName ref="plc:kootenay_region">Kootenay</placeName> until relieved by <persName ref="prs:cox_w">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cox</persName>,
whom I have appointed, subject to your pleasure, to be police
Magistrate and Assistant Gold Commissioner of the District.
</p>
<p>
3. The Mining Laws of this Colony have been framed mainly
on the recommendation of a Board sitting in <placeName ref="plc:cariboo_region">Cariboo</placeName>. Our
Ordinances<fw type="catchword" style="text-align: right;">have</fw><pb facs="co_60_19/co_60_19_00407r.jpg"/> have been enacted to meet the particular circumstances
growing out of each successive discovery of Gold in that district,
and are now a crude mass which I propose to reduce into shape
during the next Legislative Session. Adapted to the peculiar
wants of <placeName ref="plc:cariboo_region">Cariboo</placeName>, they will probably be found to require little
change as regards that district, but <placeName ref="plc:kootenay_region">Kootenay</placeName> will require special
legislation of its own. In <placeName ref="plc:cariboo_region">Cariboo</placeName> the richest "leads" are found
at an average of<fw type="catchword" style="text-align: right;">from</fw><pb facs="co_60_19/co_60_19_00408r.jpg"/> from 70 to 90 feet below the surface of the
ground and thus a large capital is required to work them. At
<placeName ref="plc:kootenay_region">Kootenay</placeName> both the rich leads on the Bed rock and the lighter
ores are found to be but little buried. The whole question
shall engage my earnest attention.
</p>
<p>
4. We have set on foot four exploring expeditions to discover
the best way of connecting the newly discovered mines with <placeName ref="plc:new_westminster">New
Westminster</placeName>, so as to get a fair portion of the trade into<fw type="catchword" style="text-align: right;">English</fw><pb facs="co_60_19/co_60_19_00408v.jpg"/>
English hands. <persName ref="prs:jenkins_x">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Jenkins</persName>, late of the Royal Engineers, was
despatched by <persName ref="prs:birch">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Birch</persName> from the <placeName ref="plc:kootenay_region">Kootenay</placeName> to reach the <placeName ref="plc:fraser_river">Fraser</placeName>
at <persName ref="prs:lytton_egeb">Lytton</persName> by way of the <placeName ref="plc:upper_columbia_river_district">Upper Columbia</placeName>, <placeName ref="plc:arrow_lakes">Arrow Lakes</placeName> and the
<placeName ref="plc:shuswap_lake">Shushwap</placeName>. He descended the river from its parent Lakes and
found it navigable for 180 miles for Steamers of a moderate
draught of water. At the great bend where the stream passes
round the Northern extremity of the <placeName ref="plc:selkirk_mountains">Selkirk Range</placeName>, I regret to
find that a Series of rapids of a total length of nearly 66
miles occurs<fw type="catchword" style="text-align: right;">in</fw><pb facs="co_60_19/co_60_19_00409r.jpg"/> in which no Steamer could live. <persName ref="prs:jenkins_x">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Jenkins</persName> however
discovered a pass in the <placeName ref="plc:selkirk_mountains">Selkirk Mountains</placeName> where a road of 36
miles might be made by which the falls and rapids of the <placeName ref="plc:columbia_river">Columbia</placeName>
would be avoided.
</p>
<p>
5. The exploring party I sent out under <persName ref="prs:turner_x">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Turner</persName>, as
reported in the 4<hi style="vertical-align: super; font-size: 80%;">th</hi> paragraph of my despatch No. 59 of <date when="1864-10-07">7<hi style="vertical-align: super; font-size: 80%;">th</hi>
of October</date>, had reached the <placeName ref="plc:columbia_river">Columbia</placeName> by way of <placeName ref="plc:thompson_river">Thompson River</placeName> and
<placeName ref="plc:kamloops_lake">Kamloops</placeName> and <placeName ref="plc:shuswap_lake">Shushwap Lakes</placeName>. They<fw type="catchword" style="text-align: right;">found</fw><pb facs="co_60_19/co_60_19_00409v.jpg"/> found these two large bodies
of water and the connecting river, perfectly adapted to steam
navigation. When last I heard from <persName ref="prs:turner_x">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Turner</persName> he was constructing
Canoes to ascend the <placeName ref="plc:columbia_river">Columbia</placeName>, but we are now aware that unfortunately
the loop in the river is not navigable. The party finding that
resource fail them will probably explore more thoroughly the pass
already discovered by <persName ref="prs:jenkins_x">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Jenkins</persName>.
</p>
<p>
6. The certainty that steam navigation can be established<fw type="catchword" style="text-align: right;">for</fw><pb facs="co_60_19/co_60_19_00410r.jpg"/>
for 120 miles between the <placeName ref="plc:thompson_river">Thompson</placeName> and the <placeName ref="plc:columbia_river">Columbia</placeName>, and that
the latter river fails to be any Service to us for 60 miles, has
induced me to accept the services of <persName ref="prs:houghton">Captain Houghton</persName>, late of
the 20<hi style="vertical-align: super; font-size: 80%;">th</hi> Regiment, and a small party to explore the Southern
bend of the river connecting the two great Lakes to the head of
<placeName ref="plc:okanagan_lake">Lake Okanagan</placeName>. From this latter point he will proceed nearly
due East towards the <placeName ref="plc:kootenay_region">Kootenay</placeName>, through a pass which<fw type="catchword" style="text-align: right;">he</fw><pb facs="co_60_19/co_60_19_00410v.jpg"/> he has
observed in the <placeName ref="plc:gold_range">Gold Range</placeName>. Finally <persName ref="prs:jenkins_x">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Jenkins</persName> has been sent back
to examine a line of Country from <placeName ref="plc:statapoosten">Statapoosten</placeName> across the <placeName ref="plc:grande_prairie">Grande
Prairie</placeName>; spoken highly of in <persName ref="prs:birch">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Birch</persName>'s report. You will see
that we are using every means of making the new discoveries
profitable to the Colony. The trail opened by the Hudson's Bay
Company is, in <persName ref="prs:birch">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Birch</persName>'s opinion likely to remain unserviceable.
</p>
<p>
7. In addition to his having performed the objects of his
mission<fw type="catchword" style="text-align: right;">perfectly</fw><pb facs="co_60_19/co_60_19_00411r.jpg"/> perfectly satisfactorily and furnished a most useful
report, <persName ref="prs:birch">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Birch</persName> has done a service to the Colony at considerable
personal risk in bringing about seventy five pounds weight (75 lbs) of
Gold, received as Taxes on the <placeName ref="plc:kootenay_region">Kootenay</placeName>, from the <placeName ref="plc:rocky_mountains">Rocky Mountains</placeName>
to <placeName ref="plc:new_westminster">New Westminster</placeName>.

gratification in perusing his interesting &amp; doubtless
valuable account of his expedition into the <placeName ref="plc:kootenay_region">Kootanie Country</placeName>.
