 <p><persName ref="prs:lugard">Lugard</persName> reports that he has transmitted to the Secretary of State for War a letter with enclosures concerning <persName ref="prs:mc_coll">McColl</persName>’s request for remission of charges to transport <persName ref="prs:mc_coll">McColl</persName>’s wife and children to <placeName ref="plc:british_columbia">British Columbia</placeName>. <persName ref="prs:lugard">Lugard</persName> clarifies, however, that the decision to approve this remission lies with the <persName ref="prs:newcastle">Duke of Newcastle</persName> and <orgName ref="org:treasury">the Treasury</orgName>. <persName ref="prs:elliot_tf">Elliot</persName> minutes to send the letter to <orgName ref="org:treasury">the Treasury</orgName> along with a statement of <persName ref="prs:mc_coll">McColl</persName>’s <q>good character,</q> informing <orgName ref="org:treasury">the Treasury</orgName> that <q>it was by misfortune and not by any fault of [<persName ref="prs:mc_coll">McColl</persName>’s] own that he was deprived.</q>

I have laid before the Secretary of State for War your
letter of the <date when="1864-01-15">15 Instant</date> with its enclosures from the Governor
of <placeName ref="plc:british_columbia">British Columbia</placeName> relative to an application from <persName ref="prs:mc_coll">Serjeant
M<hi style="vertical-align: super; font-size: 80%;">c</hi>Coll</persName> of the Royal Engineers<pb facs="co_60_20/co_60_20_00268v.jpg"/> for the remission of the whole
or part of the Sum (£105) charged for the conveyance of his
wife and children from this country to that Colony.
</p>
<p>
In reply I am to request that you will remind the <persName ref="prs:newcastle">Duke
of Newcastle</persName> that when the detachment of Royal Engineers
first proceeded to the Colony in <date when="1858">1858</date>, accom<pb facs="co_60_20/co_60_20_00269r.jpg"/>modation was,
at the instance of the Secretary of State for the Colonies,
provided in the Transport for 35 women with their children,
being considerably in excess of the regulated number. It
may be true, as urged by <persName ref="prs:mc_coll">Serjeant M<hi style="vertical-align: super; font-size: 80%;">c</hi>Coll</persName>, that had it not been
[for] the state of his wife's health at the time, she would have
accompanied<pb facs="co_60_20/co_60_20_00269v.jpg"/> him. But this in itself affords no sufficient
ground for a compliance with the present request; for had
<persName ref="prs:mc_coll_ms">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> M<hi style="vertical-align: super; font-size: 80%;">c</hi>Coll</persName> and her children been taken out free, it
could only have been to the exclusion of the family of some other man.
</p>
<p>
It appears however that the expenses of the passage of
<persName ref="prs:mc_coll_ms">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> M<hi style="vertical-align: super; font-size: 80%;">c</hi>Coll</persName> and her children<pb facs="co_60_20/co_60_20_00270r.jpg"/> and the two other women
who accompanied them were paid over to the Emigration
Commissioners, by whom the service was conducted, by the
Paymaster General acting, not on behalf of this department,
but on behalf of <orgName ref="org:treasury">the Treasury</orgName>.
</p>
<p>
The remission of the balance of the debt due by
<persName ref="prs:mc_coll">Serjeant M<hi style="vertical-align: super; font-size: 80%;">c</hi>Coll</persName> is therefore rather a<pb facs="co_60_20/co_60_20_00270v.jpg"/> matter for the
consideration of the <persName ref="prs:newcastle">Duke of Newcastle</persName> in concert with
the <orgName ref="org:treasury">Lords Commissoners of the Treasury</orgName>.

I think that we may send <orgName ref="org:treasury">the Treasury</orgName> a copy of the
Governor's despatch N<hi style="vertical-align: super; font-size: 80%;">o</hi> 64. We may give them an outline
of the case and state the circumstances which make in favor
of <persName ref="prs:mc_coll">Serjeant M<hi style="vertical-align: super; font-size: 80%;">c</hi>Coll</persName>, very much<pb facs="co_60_20/co_60_20_00271r.jpg"/> founded on the model of our
letter to the <orgName ref="org:war_office">War Office</orgName>.

I should then say that the passage of <persName ref="prs:mc_coll_ms">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> M<hi style="vertical-align: super; font-size: 80%;">c</hi>Coll</persName>
and her children was defrayed out of the money transferred
to the Emigration Commrs by the Paymaster General
(specifying <orgName ref="org:treasury">the Treasury</orgName> letter at the time) and adverting
to <persName ref="prs:mc_coll">Serjeant M<hi style="vertical-align: super; font-size: 80%;">c</hi>Coll</persName>'s good character and to the fact that it
was by misfortune and not by any fault of his own that he
was deprived <hi style="text-decoration: underline;">&amp;c</hi>. I should submit to their Lordships that
as he has now ceased to be in the receipt of pay and has
already repaid one half of the cost of the passage of his
wife and family, it may be a reasonable indulgence to remit
to him the remainder of the debt which must fall heavily
on a man in humble circumstances who ceased to derive any
income from public sources.
