<p><persName ref="prs:newcastle">Newcastle</persName> informs <persName ref="prs:seymour_f">Seymour</persName> that if <persName ref="prs:trutch_jw">Trutch</persName> accepts the position of Surveyor General and Commissioner of Lands he <q>will not be at liberty to enter into any fresh contracts for the execution of Public Works</q> and that he should <q>divest himself</q> of any current contracts that would <q>appear incompatible with his official position.</q> </p>

With reference to my despatch No. 68 of the <date when="1864-02-26">16th of February</date>
addressed to <persName ref="prs:douglas_j">Sir James Douglas</persName>, in which I informed him that I had
selected <persName ref="prs:trutch_jw">Mr. Trutch</persName> for the office of Surveyor General and Commissioner
of Lands, I wish to point out to you that if <persName ref="prs:trutch_jw">Mr. Trutch</persName> should accept
the office he will not be at liberty to enter into any fresh contracts
for the execution of Public Works. In case he should have any such
contracts which remain to be fulfilled, I have to request that you will
consider and report to me how far they are liable to conflict with his
public duties, and whether any plan can be suggested for enabling <persName ref="prs:trutch_jw">Mr. Trutch</persName> to divest himself, without undue sacrifice, of such of them as
would<pb facs="co_398_02/co_398_02_00105v.jpg"/> both continue for a considerable time in execution and would also
appear incompatible with his official position.
