<p><persName ref="prs:cardwell">Cardwell</persName> acknowledges receipt of <persName ref="prs:douglas_j">Douglas</persName>’s despatch which includes three ordinances from the Legislature of <placeName ref="plc:british_columbia">British Columbia</placeName>. Regarding a clause in the ordinance <q>to encourage the construction of a telegraph line connecting <placeName ref="plc:british_columbia">British Columbia</placeName> with the telegraph lines of the United States and for other purposes,</q> that gives a monopoly over telegraph use to an American company, <persName ref="prs:cardwell">Cardwell</persName> confirms that <q>the exclusive right of telegraphic communication can under no circumstances be allowed.</q> He also states that <q>if the clause giving that right be not repealed [he] shall have no other alternative left than that of advising Her Majesty to disallow the whole Ordinance.</q></p>

I have received your predecessor's despatch No. 14 of the <date when="1864-05-04">4th
ultimo</date> accompanied by three Ordinances of the Legislature of <placeName ref="plc:british_columbia">British
Columbia</placeName> including No. 9 of <date when="1864">1864</date> intituled
<milestone unit="section" rend=".ind on"/>
An Ordinance to encourage the
construction of a telegraph line connecting <placeName ref="plc:british_columbia">British Columbia</placeName> with<fw type="catchword" style="text-align: right;">the</fw><pb facs="rg7_g8c_11/rg7_g8c_11_00062v.jpg"/> the
telegraph lines of the United States and for other purposes.

<p>
I observe that by the 5th clause of this Ordinance there is secured
to the <orgName ref="org:cst_company">California State Telegraph Company</orgName>, for a period of twenty years
after the completion of a certain telegraph<!--<pb facs="co_398_02/co_398_02_00113r.jpg"/>--> line, the exclusive right of
sending and receiving<fw type="catchword" style="text-align: right;">messages</fw><pb facs="rg7_g8c_11/rg7_g8c_11_00063r.jpg"/> messages between any place within the Colony of
<placeName ref="plc:british_columbia">British Columbia</placeName> and any other place within the territory of the United
States of America to the West of the <placeName ref="plc:rocky_mountains">Rocky Mountains</placeName>.
</p>
<p>
From the Parliamentary Paper noted in the margin

of which a copy is enclosed you will learn (what, from the correspondence
between this department and <persName ref="prs:collins_p">Mr.<fw type="catchword" style="text-align: right;">Collins</fw><pb facs="rg7_g8c_11/rg7_g8c_11_00063v.jpg"/> Collins</persName>, respecting the construction of
a telegraph line to <placeName ref="plc:british_columbia">British Columbia</placeName> across the North of Asia, which
correspondence was communicated to you on the <date when="1864-02-10">10th of February last</date>, you
will already have inferred) that Her Majesty's Government are unable to
sanction the establishment of any exclusive<fw type="catchword" style="text-align: right;">privileges</fw><pb facs="rg7_g8c_11/rg7_g8c_11_00064r.jpg"/> privileges in regard to
telegraphic communication, and you cannot fail to see that the strict
enforcement of this principle is peculiarly indispensable in <placeName ref="plc:british_columbia">British
Columbia</placeName> through<!--<pb facs="co_398_02/co_398_02_00113v.jpg"/>--> which Her Majesty's Government may have to communicate
in very critical times and on very important matters with Her Majesty's<fw type="catchword" style="text-align: right;">Naval</fw><pb facs="rg7_g8c_11/rg7_g8c_11_00064v.jpg"/>
Naval Forces on the Pacific. It will therefore be impossible that the
5th clause of the Ordinance under consideration should be allowed to
remain in operation, and the <orgName ref="org:cst_company">California State Telegraph Company</orgName> should
be at once so informed.
</p>
<p>
I have hesitated to recommend the immediate disallowance of this
Ordinance<fw type="catchword" style="text-align: right;">because</fw><pb facs="rg7_g8c_11/rg7_g8c_11_00065r.jpg"/> because it appears to me that by allowing it for the present
to remain in operation I shall facilitate those negotiations between the
Government and the Company which will be necessary to provide either for
the continuance or for the abandonment of the enterprise.
</p>
<p>
I hope that you<fw type="catchword" style="text-align: right;">will</fw><pb facs="rg7_g8c_11/rg7_g8c_11_00065v.jpg"/> will be able to make arrangements under which the
understanding may proceed,<!--<pb facs="co_398_02/co_398_02_00114r.jpg"/>--> but it must be clearly understood that the
exclusive right of telegraphic communication can under no circumstances
be allowed, and that if the clause giving that right be not repealed I
shall have no other alternative left than<fw type="catchword" style="text-align: right;">that</fw><pb facs="rg7_g8c_11/rg7_g8c_11_00066r.jpg"/> that of advising Her Majesty
to disallow the whole Ordinance.
