A Notice of Action given to <persName ref="prs:verney_eh">Lieutenant Verney</persName>, Commanding
Her Majesty's Ship "<name ref="vsl:grappler" type="vessel">Grappler</name>," for the alleged illegal seizure
of a vessel suspected of smuggling, raised the question as to
the limits of the respective Colonies of <placeName ref="plc:british_columbia">British Columbia</placeName> and
<placeName ref="plc:vancouver_island">Vancouver<fw type="catchword" style="text-align: right;">Island</fw><pb facs="co_60_21/co_60_21_00057r.jpg"/> Island</placeName> in the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>. As the one Government
is supported mainly by heavy Customs duties, and the other by
direct taxation, the matter is of considerable importance.
</p>
<p>
2. My Commission gives me authority over <placeName ref="plc:haida_gwaii">Queen Charlotte's
Island</placeName> and "all other Islands adjacent to" this "territory,
except <placeName ref="plc:vancouver_island">Vancouver Island</placeName> and the Islands Adjacent thereto." My
Attorney-General is of opinion that the exception<fw type="catchword" style="text-align: right;">must</fw><pb facs="co_60_21/co_60_21_00058r.jpg"/> must be
construed in the narrowest manner and that all the Islands in
the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>, with the exception of those immediately
contiguous to <placeName ref="plc:vancouver_island">Vancouver Island</placeName> must be considered as within the
Government of <placeName ref="plc:british_columbia">British Columbia</placeName>. I observe too that <persName ref="prs:kennedy_a">Governor
Kennedy</persName>'s Commission specially withdraws from his jurisdiction
any of the Islands South of the forty-ninth degree of North Latitude.
</p>

3. It would be a great assistance to the Government if
you would inform me which of the Islands adjoining this Coast
are within its jurisdiction and are consequently subject to
the operation of our Customs Laws.

A provoking kind of question. In <date when="1849">1849</date> <placeName ref="plc:vancouver_island">V.C. Island</placeName> (with<hi style="vertical-align: super; font-size: 80%;">t</hi>
appurtenances) was granted to the <orgName ref="org:hbc">HBC</orgName>.
</ab>
<p>
In the same year <persName ref="prs:blanshard"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Blanshard</persName> was by his commission
declared <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> of "<placeName ref="plc:vancouver_island">V.C.I.</placeName> and the islands adjacent." This was
repeated in <persName ref="prs:douglas_j"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Douglas</persName>' commission <date when="1851">1851</date>. 21 &amp; 22 Victoria,
c. 99 <date when="1858">1858</date> defined <placeName ref="plc:british_columbia">B. Columbia</placeName> declaring that no part of the
"Colony of <placeName ref="plc:vancouver_island">V.C.I.</placeName>" <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be comprised therein and 26 &amp; 27
Vict. c. 83 (<date when="1863">1863</date>) defined <placeName ref="plc:british_columbia">B. Columbia</placeName> to comprise such &amp; such
Territories "except <placeName ref="plc:vancouver_island">V.C.I.</placeName> <hi style="text-decoration: underline;">and the Islands adjacent thereto</hi>."
</p>
<p>
I should be disposed to include in VCI 1. All those island
(being in HM's dominion) <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> are south of the 49<hi style="vertical-align: super; font-size: 80%;">th</hi> Parallel.
2. Those <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> are on the Vancouver side of<pb facs="co_60_21/co_60_21_00059r.jpg"/> the main channel
between that Island &amp; the mainland.
</p>
<p>
The word "adjacent"—being used in an Act of Parl<hi style="vertical-align: super; font-size: 80%;">t</hi>
cannot be conclusively interpreted by the Executive—but I <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> 
think the question m<hi style="vertical-align: super; font-size: 80%;">t</hi> be practically settled by asking the
<orgName ref="org:admiralty">Admiralty</orgName> to advise us as to a line, and directing the two
Governors to adopt it.

The department have br<hi style="vertical-align: super; font-size: 80%;">t</hi> to my notice an Act of Parl<hi style="vertical-align: super; font-size: 80%;">t</hi> (12 &amp;
13 Vict. c. 48) of the existence of <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> I was unaware when
I wrote my minute upon 4583 <placeName ref="plc:british_columbia">B. Columbia</placeName>, &amp; also when I drafted
the <placeName ref="plc:british_columbia">B. Columbia</placeName> Act 26 &amp; 27 Vict. c. 83.
</ab>
<p>
The result is, that the boundary question is more perplexed
than I thought.
</p>
<p>
The Act 12 &amp; 13 Vict. c. 48. SS 4 defines <placeName ref="plc:vancouver_island">V.C.I.</placeName> to contain
"all such Islands adjacent to <placeName ref="plc:vancouver_island">V.C.I.</placeName>
<hi style="text-decoration: underline;">or to the western coast of N. America</hi> &amp; forming part of the
Dominion of H.M. as and to the southward of the 52<hi style="vertical-align: super; font-size: 80%;">nd</hi> degree of N.
Lat."
</p>
<p>
The Act 21 &amp; 22 Vict. c 99. SS 6 declared that "no part of
the Colony of <placeName ref="plc:vancouver_island">V.C.I.</placeName> as at present established shall be comprised
within <placeName ref="plc:british_columbia">B. Columbia</placeName>" leaving all the above Islands to <placeName ref="plc:vancouver_island">V.C.I.</placeName>
</p>
<p>
But the Act 26 &amp; 27 Vict. c. 83. SS 3<pb facs="co_60_21/co_60_21_00061v.jpg"/> repealed the 1<hi style="vertical-align: super; font-size: 80%;">st</hi>
section of the Act 21 &amp; 22 Vict.—continued the remaining
Sections including of course SS 6.1 till <date when="1863-12-31">31 Dec 1863</date> (SS 2) and
then enacted (SS 3) that <placeName ref="plc:british_columbia">B. Columbia</placeName> should comprise "<placeName ref="plc:haida_gwaii">Queen
Charlottes Island</placeName> &amp; all other Islands adjacent to the said
Territories" (viz the mainland of <placeName ref="plc:british_columbia">B. Columbia</placeName>) "except
<placeName ref="plc:vancouver_island">Vancouvers Island</placeName> &amp; the Islands adjacent thereto" omitting to
except &amp; therefore, it may be argued, including in <placeName ref="plc:british_columbia">B Columbia</placeName>
the islands in the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName> &amp;c which are adjacent to
the "W. Coast of North America" than to <placeName ref="plc:vancouver_island">V.C.I.</placeName>
</p>
<p>
The Governors Commission (by <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> I was guided when
drafting the Act of 26 &amp; 27 Vict) defines the Colony as
including <placeName ref="plc:vancouver_island">V.C.I.</placeName> &amp; the<pb facs="co_60_21/co_60_21_00062r.jpg"/> Islands adjacent thereto, with<hi style="vertical-align: super; font-size: 80%;">t</hi>
mention of the W. Coast of N.A.
</p>
<p>
I believe it will be safest to ask the L.O. whether under
these Acts the Islands adjacent to the W.C. of N America belong
to <placeName ref="plc:british_columbia">B. Columbia</placeName> or to <placeName ref="plc:vancouver_island">V.C.I.</placeName>
</p>
<p>
If they all continue to belong to <placeName ref="plc:vancouver_island">V.C. Island</placeName> it will
simplify the question, &amp; also I suppose will much facilitate
smuggling into <placeName ref="plc:british_columbia">B.C.</placeName> But it will not be a natural division.
