I have the honor to forward a letter addressed to you
by <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> James Cooper</persName>, complaining that the expectations held
out to him by the Secretary of State have not been realized,
and<fw type="catchword" style="text-align: right;">praying</fw><pb facs="co_60_22/co_60_22_00279v.jpg"/> praying that compensation may be awarded to him.
</p>
<p>
2. <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName> performs the light duties devolving upon the
Harbour Master of <placeName ref="plc:new_westminster">New Westminster</placeName> fully to my satisfaction. The
Salary he receives is an extremely small one, and were the business
of the Port greater I should recommend the Legislative Council to
increase the pay. It is <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName>'s<fw type="catchword" style="text-align: right;">misfortune</fw><pb facs="co_60_22/co_60_22_00280r.jpg"/> misfortune, not his fault,
that he has much idle time on his hands.

This seems to me a plain case.
</ab>
<p>
The allegation of a promise breaks down, and ought on
general grounds never to be admitted on the mere personal
assertion of the interested part.
</p>
<p>
All allegations of mere oral promises ought in my judgement
to be summarily dismissed.
</p>
<p>
But unless we suppose that a Secretary of State had promised
a man money whether he earned it or not, there really remains no
question to be discussed. <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName> has almost nothing to do,
and enjoys for it a moderate salary. He wishes that he had a
larger salary, and the Governor says that he would have no
objection to give him a larger salary, it he had more extensive
duties. But there evidently is not the shadow of an excuse for
making the Public pay for duties which do not exist.

How it was that <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName> obtained <persName ref="prs:lytton_egeb">Sir E. Lytton</persName>'s favor,
who recommended him, or what the man had done to entitle him to
any office at all I could never learn. However when <placeName ref="plc:british_columbia">B. Columbia</placeName>
was formed into a Colony <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName>, who had been a Captain of
a trading vessel and a resident at <placeName ref="plc:vancouver_island">V.C. I<hi style="vertical-align: super; font-size: 80%;">d</hi></placeName> was to have been
made Collector of Customs. The rumour of this appointment having
reached the ears of the <orgName ref="org:hbc">Hudson's Bay C<hi style="vertical-align: super; font-size: 80%;">o</hi></orgName>, they personally and
by Letter represented that <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName> both had been &amp; then was
in their debt. From the statement of the C<hi style="vertical-align: super; font-size: 80%;">o</hi> <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName>s
transactions in other respects did not appear in a very favorable
light. He was<pb facs="co_60_22/co_60_22_00284v.jpg"/> called upon for an explanation. <persName ref="prs:merivale_h">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Merivale</persName>
fully investigated it, and came to the conclusion that it was
not satisfactory enough to justify an office of pecuniary
trust being conferred on him. So in a short time the Harbor
Master Ship of <placeName ref="plc:british_columbia">B. Columbia</placeName> (where there really was no harbor
&amp; consequently nothing to do) was created for him. Salary £400 a year.
The Collector's Office is now £650. At first the Collectors
Salary was £400. <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName>, who resided in <placeName ref="plc:vancouver_island">V.C.I.</placeName> having been
called upon to go &amp; live at <placeName ref="plc:new_westminster">New Westminster</placeName> with other <placeName ref="plc:british_columbia">B.C.</placeName> officials,
remonstrated against this order, but was overruled. He has<pb facs="co_60_22/co_60_22_00285r.jpg"/>
since that time lived, I suppose, at <placeName ref="plc:new_westminster">N.W<hi style="vertical-align: super; font-size: 80%;">r</hi></placeName>, holding a perfect
sinecure office. He now complains that he has lost money by
his apptment to the Office of Harbor Master instead of that of
Collector of Customs, &amp; asks for compensation for the money
loss he computes himself to have sustained. He refers to me
as having heard <persName ref="prs:lytton_egeb">Sir E. Lytton</persName> promise him an appointment of
"equal honor &amp; emolument." If those terms have been used in
the correspondence they <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> be much in favor of <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName>'s
view: I can not say that I recollect the employment by <persName ref="prs:lytton_egeb">Sir E.L.</persName>
of the expression quoted. If they are not in the correspondence,<pb facs="co_60_22/co_60_22_00285v.jpg"/>
which should be looked to, I can only say that, in my opinion,
<persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName> has preferred a monstrous claim. But a precis of
the corresp<hi style="vertical-align: super; font-size: 80%;">ce</hi> had better be prepared, as I am only writing
from memory.

<p>
I have searched the correspondence relative to the
appointment of <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName> to the Office of Harbor Master for
<placeName ref="plc:british_columbia">British Columbia</placeName>. I find nothing on record to shew that <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Cooper</persName> was told by <persName ref="prs:lytton_egeb">Sir E. Lytton</persName> that he would find the
appointment conferred upon him to be of equal honor and
emolument with that of the Collector of Customs to which it
was originally intended that he should be appointed.<pb facs="co_60_22/co_60_22_00286v.jpg"/> It
is not however unlikely that he may have been verbally told
so by <persName ref="prs:lytton_egeb">Sir E. Lytton</persName>, for at the time of the creation of the
two offices in <date when="1858">1858</date> the Salary attached to each was the same
viz<hi style="vertical-align: super; font-size: 80%;">t</hi> £400. But in <date when="1861">1861</date> the Salaries of several of the Officers
of <placeName ref="plc:british_columbia">British Columbia</placeName> were increased, and among them that of the
Collector of Customs from £400 to £650—(see statement E
annexed).<fw type="catchword" style="text-align: right;">Why</fw><pb facs="co_60_22/co_60_22_00287r.jpg"/> Why the Harbour Master was excepted in this
general increase of Salaries does not appear, but possibly
it may have been owing to the refusal of the Secretary of State
a year previously to increase his salary under the then
financial circumstances of <placeName ref="plc:british_columbia">British Columbia</placeName> and because he
notoriously had scarcely anything to do in return for his Salary.
</p>
<p>
I annex the following extracts of the correspondence
bearing on <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName>'s character and case generally.</p><pb facs="co_60_22/co_60_22_00287v.jpg"/>

<p>A. As to his appointment &amp; doubts as to his character
resulting in the opinion, expressed to him in the letter
of the <date when="1858-09-08">8<hi style="vertical-align: super; font-size: 80%;">th</hi> of September, 1858</date>, that although <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Cooper</persName> left <placeName ref="plc:vancouver_island">Vancouver Island</placeName> (before his appointment)
in circumstances of some embarrassment no discreditable
conduct was proved against him in respect of those circumstances.</p>

<p>B. Extract of despatch to <persName ref="prs:douglas_j"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Douglas</persName> <date when="1859-03-24">24<hi style="vertical-align: super; font-size: 80%;">th</hi> March/59</date>,
(<placeName ref="plc:vancouver_island">V.C.I.</placeName><hi style="vertical-align: super; font-size: 80%;">d</hi>) shewing that H.M. <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> was pledged to <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName>
in a salary of £400.</p>

<p>C. <persName ref="prs:cooper_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cooper</persName>'s application for an increase of Salary in <date when="1859">1859</date>
and refusal.</p>

was not a safe man to put into a revenue place. We thought
him more than fortunate in securing an Office of £400 a year.
