I have the honor to forward a letter addressed to you by
<persName ref="prs:newton_wh">M<hi style="vertical-align: super; font-size: 80%;">r</hi> W.H. Newton</persName>, complaining of the injustice which he considers
he has received from the Government<fw type="catchword" style="text-align: right;">of</fw><pb facs="co_60_22/co_60_22_00329v.jpg"/> of this Colony and expressing
a hope that you will be pleased to order an investigation of his
case, with a view to compensation being awarded for the losses he
alleges he has sustained.
</p>
<p>
2. As the transactions to which <persName ref="prs:newton_wh">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Newton</persName> refers took
place previous to my arrival in the Colony, I do not consider it
necessary to trouble you with any lengthened statement<fw type="catchword" style="text-align: right;">of</fw><pb facs="co_60_22/co_60_22_00330r.jpg"/> of my own
on the merits of this case. I will only refer you to the enclosed
letter written by <persName ref="prs:douglas_j">Sir J. Douglas</persName> on a former petition presented to
<persName ref="prs:seymour_f">Governor Seymour</persName> on his arrival in this Colony. I can however
bear testimony from personal observation that the valuation placed
upon the improvements by <persName ref="prs:douglas_j">Sir James Douglas</persName> is far more correct than
the one given in <persName ref="prs:newton_wh">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Newton</persName>'s letter.
</p>
<p>
3. The statement as to<fw type="catchword" style="text-align: right;">the</fw><pb facs="co_60_22/co_60_22_00330v.jpg"/> the Survey of the <name type="ip" subtype="group">Indian Village</name><!-- LILS This a place not group --> in the
summer of <date when="1862">1862</date>, is I believe, perfectly true, but the then Commissioner
of Lands and Works acted without Authority, and no one could have
known better than <persName ref="prs:newton_wh">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Newton</persName> the dissatisfaction expressed by the
<name type="ip" subtype="group">Indians</name> at the paucity of the Reserve laid out, and upon their
representing the facts to <persName ref="prs:douglas_j">Sir James Douglas</persName>, Authority was immediately
issued to the<fw type="catchword" style="text-align: right;">Survey</fw><pb facs="co_60_22/co_60_22_00331r.jpg"/> Survey Department to increase the Reserve to the full
extent claimed by the <name type="ip" subtype="group">Indians</name>. Delay may have occurred in carrying
out these instructions but the decision arrived at by <persName ref="prs:douglas_j">Sir James
Douglas</persName> was well known at the time, consequently <persName ref="prs:newton_wh">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Newton</persName> must
have been aware that his tenure of the land was uncertain, and
any improvements he might make would be subject to forfeiture.
</p>
<fw type="catchword" style="text-align: right;">4. Under</fw><pb facs="co_60_22/co_60_22_00331v.jpg"/>
<p>
4. Under these circumstances <persName ref="prs:newton_wh">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Newton</persName>, has, in my opinion,
no claim to compensation other than was offered in my letter of the
<date when="1865-05-19">19<hi style="vertical-align: super; font-size: 80%;">th</hi> May 1865</date>.
</p>
<p>
5. It is somewhat ingenious of the writer of this Letter to
appeal to your sympathy as a "struggling Colonist." <persName ref="prs:newton_wh">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Newton</persName> is
in the Hudson Bay Company's Service and until within the last few
months was Chief Trader at <placeName ref="plc:fort_langley">Fort Langley</placeName>, one of the Company's Posts.<fw type="catchword" style="text-align: right;">He is</fw><pb facs="co_60_22/co_60_22_00332r.jpg"/>
He is now employed in the Head Establishment at <placeName ref="plc:victoria">Victoria</placeName> and I
cannot suppose he would leave so certain and permanent an employment
for the vicissitudes of a Settler's life, and have always considered
the land held by him in this Colony was merely for speculative
purposes.

<salute>My dear <persName ref="prs:seymour_f">Governor Seymour</persName>.</salute>
<p>I have received your letter and now return the enclosures. <persName ref="prs:newton_wh">Newton</persName>’s claim is familiar to me, and I have already decided on its merits; as you will see by referring to the correspondence on that subject.</p>
 
<p>As against <name type="ip" subtype="group">the Indians</name> he has no claim whatever, there can be no pretense for narrowing the very <fw type="catchword" style="text-align: right;">limited</fw><pb facs="co_60_22/co_60_22_00344v.jpg"/>limited area (about 100 acres) assigned to them as a Reserve; the real question is between <persName ref="prs:newton_wh">Newton</persName> and Her Majesty’s Government. This will be better understood by the following brief history of the case — <placeName ref="plc:katzie">The Katsy Village</placeName> has been on <name type="ip" subtype="group">Indian Settlement</name> <!-- LILS Should probably be tagged as land title -->from time immemorial, and <name type="ip" subtype="group">the Natives</name> though occasionally absent, have never relinquished, or by any act of the contumacy forfeited their right to the land — All <name type="ip" subtype="group">Indian settlements</name><!-- LILS Should be tagged as land title --> are expressly exempted from occupation by the Pre-emption Acts, and no Settler can legally enter upon land occupied or cultivated by <name type="ip" subtype="group">Indians</name> <fw type="catchword" style="text-align: right;">or</fw><pb facs="co_60_22/co_60_22_00345r.jpg"/>or establish any legal claim thereto. The first Settler at <placeName ref="plc:katzie">Kaitsy</placeName> was a Mr Manson, who it appears transferred his right to <persName ref="prs:newton_wh">Newton</persName>. the former made no claim to the Village site, but <persName ref="prs:newton_wh">Newton</persName> did consult me about occupying it, stating that it had been abandoned by <name type="ip" subtype="group">the Indian Inhabitants</name>; but knowing this to be a fallacy, I advised him not to occupy it, and told him most distinctly that the land was secured to <name type="ip" subtype="group">the Indians</name> and could not be alienated by the Government.</p>
 
<p><persName ref="prs:newton_wh">Newton</persName> cannot therefore plead ignorance as to the legal status of the land. Now comes the gist <fw type="catchword" style="text-align: right;">of</fw><pb facs="co_60_22/co_60_22_00345v.jpg"/>of the matter the Commissioner of Lands &amp; Works was directed to mark out that and other <name type="ip" subtype="group">Indian Reserves</name><!-- LILS This should be tagged thematically as land title -->. It appears that through some mistake only 10 acres were included in the land laid out as <q><placeName ref="plc:katzie">Kaitsy Reserve</placeName></q>; though it was notorious that <name type="ip" subtype="group">the Indians</name> occupied and claimed a larger area.</p>
 
<p><persName ref="prs:newton_wh">Newton</persName> taking advantage of that error notwithstanding <name type="ip" subtype="group">the protests of the Indians</name>, and without waiting to ascertain from the Commissioner of Lands &amp; Works as to the fact of the remaining portion of the Reserve being open to Pre-emption immediately added it to his own <fw type="catchword" style="text-align: right;">claim</fw> <pb facs="co_60_22/co_60_22_00346r.jpg"/>claim — but on <name type="ip" subtype="group">the complaint of the Indians</name> the true line was, by my orders restored, and if <persName ref="prs:newton_wh">Newton</persName> was a sufferer I think, under the circumstances he has nobody but himself to blame as he could not be ignorant of the risks he wilfully incurred by that unjustifiable proceeding.. It is clear that <name type="ip" subtype="group">the Indians</name> could not be legally deprived of their inheritance by the unauthorised act of the Commissioner of Lands &amp; Works — the only question that remains is, if by the act of that office, liability was incurred on the part of the Government; and I should simply leave <persName ref="prs:newton_wh">Newton</persName> to <fw type="catchword" style="text-align: right;">test</fw><pb facs="co_60_22/co_60_22_00346v.jpg"/>test that point, and to seek his remedy by appeal to the Law Court of the Colony — a course that will deter other attempts at imposition.</p>
 
<p>Let <persName ref="prs:trutch_jw">Trutch</persName> visit the <placeName ref="plc:katzie">Kaitsy Village</placeName> and value <persName ref="prs:newton_wh">Newton</persName>s improvements I am sure they will not amount to fifty dollars in all.</p>
