I am honoured with Your commands, signified in <persName ref="prs:rogers_f">Sir F.
Rogers</persName>' Letter of the <date when="1865-09-27">27<hi style="vertical-align: super; font-size: 80%;">th</hi> Ultimo</date>, stating that he was
directed to transmit to me an Ordinance passed by the
Legislature of <placeName ref="plc:british_columbia">British Columbia</placeName> entitled "N<hi style="vertical-align: super; font-size: 80%;">o</hi> 21—An
Ordinance respecting Marriages in <placeName ref="plc:british_columbia">British Columbia</placeName>,"
together with the local Attorney General's Report thereon;
and <persName ref="prs:rogers_f">Sir F. Rogers</persName> was pleased to request that I<fw type="catchword" style="text-align: right;">would</fw><pb facs="co_60_23/co_60_23_00110v.jpg"/> would
furnish you with my opinion, whether this Ordinance may
properly be confirmed by Her Majesty.
</p>
<p>
In obedience to Your commands, I have taken these papers
into consideration, and have the honour to <hi style="text-decoration: underline;">Report</hi>,
</p>
<p><hi style="text-decoration: underline;">That</hi> in the opinion of the Attorney General of
<placeName ref="plc:british_columbia">Columbia</placeName> it is stated that there is "<name type="ip" subtype="group">a large Indian Community
in this Colony</name>." The Act speaks of "Ministers" and "Religious
denominations," and expressly excludes from its operations Jews
and Quakers. I am not<fw type="catchword" style="text-align: right;">sure</fw><pb facs="co_60_23/co_60_23_00111r.jpg"/> sure whether it is intended to include
Indians within the provisions of this Statute, and to permit
them to be married before the Registrar. But such would I
think be the effect of the Statute.
</p>
<p>
Looking to the 17<hi style="vertical-align: super; font-size: 80%;">th</hi> Clause, it is difficult to say
that the effect of this Statute would not be to render
invalid for the future <name type="ip" subtype="group">all Marriages celebrated by Native
Indians among themselves</name>. I think it would be expedient to
ascertain whether this point has been considered by the
Legislature of <placeName ref="plc:british_columbia">Columbia</placeName> before the Act be confirmed by Her Majesty.

<persName ref="prs:cardwell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> C</persName>. <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> be glad to learn what is its intended effect upon
<name type="ip" subtype="group">the Indian population</name> some of whom appear to be under Christian
teaching—and that <persName ref="prs:cardwell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> C</persName>. <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> suggest that this
Act <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be made clear in this respect. Also
(I think, though the QA does not suggest it) that the L<hi style="vertical-align: super; font-size: 80%;">r</hi> <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> 
be invited to consider whether it will not be difficult to secure
any efficient notice of marriage beforehand or any proper record
subsequently, if they may be celebrated and the banns published in
any place calling itself a place of worship and whether therefore
it <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> not be wise to require that these ceremonies <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> take
place in some place of worship licensed for the celebration of marriages.
