With reference to <persName ref="prs:elliot_tf">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Elliot</persName>'s letter of the <date when="1866-06-06">6<hi style="vertical-align: super; font-size: 80%;">th</hi>
instant</date>, transmitting a copy of a despatch from the Acting
Governor of <placeName ref="plc:british_columbia">British Columbia</placeName>, respecting the Ordinance N<hi style="vertical-align: super; font-size: 80%;">o</hi>
3 of <date when="1865">1865</date>, "To amend the Duties of Customs," I am directed
by the <orgName ref="org:treasury">Lords Commissoners of Her Majesty's Treasury</orgName> to
acquaint you, for the information of <persName ref="prs:cardwell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Secretary Cardwell</persName>,
that My Lords see no reason to modify the opinion expressed
in Their letter of the <date when="1865-10-31">31<hi style="vertical-align: super; font-size: 80%;">st</hi> of October last</date>, that a
regulation under which "ad valorem" duties are calculated
according to the value of the article at<fw type="catchword" style="text-align: right;">the</fw><pb facs="co_60_26/co_60_26_00163v.jpg"/> the place of
shipment, instead of at the place of entry, in effect,
if not in words, establishes a system of differential duties;
inasmuch as the result must be to subject articles identical
in all respects and of the same price to the consumer to
different rates of duty, according as they may have been
shipped from different countries. They regret to find that
there is a precedent for this legislation in the fiscal
system of the Canadian Provinces; and since Their letter
of the <date when="1865-10-31">31<hi style="vertical-align: super; font-size: 80%;">st</hi> of October last</date>, They have called attention
to similar provisions in Colonial Acts transmitted for
Their opinion before<fw type="catchword" style="text-align: right;">confirmation</fw><pb facs="co_60_26/co_60_26_00164r.jpg"/> confirmation by Her Majesty.
</p>
<p>
My Lords have only to suggest that the principle of
this regulation should receive full consideration by the
Secretary of State, and that the views at which Her Majesty's
Government may finally arrive should be communicated to the
Governments of all British Possessions in which "ad valorem"
duties of Customs are collected.

to pass a new Tariff, the Imperial Parl<hi style="vertical-align: super; font-size: 80%;">t</hi> will have
passed an Act for the Union of the two Colonies, under
the Authority of which there will be only one set of
Commercial Laws, HM <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> will not proceed to actual
disallowance of the Ord<hi style="vertical-align: super; font-size: 80%;">ce</hi> under present cons<hi style="vertical-align: super; font-size: 80%;">n</hi>.

Treasury, but so far as I know, we have all agreed with
them, and have so expressed our official letters, in objecting to the
Clause under discussion in the <placeName ref="plc:british_columbia">British Columbia</placeName> Ordinance.

Write to <placeName ref="plc:british_columbia">British Columbia</placeName> to tell the Acting
Governor that we adhere to our objections and do not
consider the precedent which he quotes from Canada a
sufficient reason for an exceptionable practice?

As to Colonies in general you will best know whether
we ought to write a Circular as <orgName ref="org:treasury">the Treasury</orgName> seem to wish.

If there are many instances of Acts levying ad valorem
duties according to the value of the articles at the place
of shipment, such a circular will probably be useful: if
the Canadian Act is the only instance I think it is
questionable whether it is worth taking any notice of the fact.

<hi style="text-decoration: underline;"><placeName ref="plc:gambia">Gambia</placeName></hi>, <placeName ref="plc:gold_coast">Gold Coast</placeName> &amp; <placeName ref="plc:lagos">Lagos</placeName>. At the <placeName ref="plc:gold_coast">G. Coast</placeName> the duty is
calculated on the <hi style="text-decoration: underline;">value of the Articles at the place of shipment</hi>—at <placeName ref="plc:lagos">Lagos</placeName> at
the value stated in the Invoice. I cannot find what the practice is
at the <placeName ref="plc:gambia">Gambia</placeName>.

by <orgName ref="org:treasury">the Treasury</orgName> in respect to the mode of fixing ad

This is a question whether we should send a circular to various
Colonies telling them (what is true) that to levy ad valorem duties
calculated on the cost of production in the country of production is
in effect to levy a differential duty in favour of countries where
production is cheap—<choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> is a thing not to be done.
</ab>

 This <orgName ref="org:treasury">the Treasury</orgName> wish us to announce generally. Vide 6015 <placeName ref="plc:british_columbia">B.C.</placeName>
</p>
<p>
 But contra (vide 5517 <placeName ref="plc:gambia">Gambia</placeName>) the Custom H. Authorities declare
 that this mode of levying a<pb facs="co_60_26/co_60_26_00170v.jpg"/>d valorem duties is the established mode
of levying them—&amp; probably on the whole the best that can be
adopted. Hence the <placeName ref="plc:gambia">Gambia</placeName> Ord<hi style="vertical-align: super; font-size: 80%;">ce</hi> <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> adopts this method is not
to be objected to.
</p>

 I think in acknowledging the Treas<hi style="vertical-align: super; font-size: 80%;">y</hi> letter on the <placeName ref="plc:gambia">Gambia</placeName>
Ord<hi style="vertical-align: super; font-size: 80%;">e</hi> we <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> add, that under the circumstances <persName ref="prs:carnarvon">L<hi style="vertical-align: super; font-size: 80%;">d</hi> C.</persName> does not
propose to send out the Circular suggested by the concluding parag of

By the 12<hi style="vertical-align: super; font-size: 80%;">th</hi> clause of the Order in Council of the <date when="1863-06-11">11
June 1863</date> H.M. may by Order in Council

If this ordinance is to be disallowed, it must therefore be

The question is whether under the circumstances it should be
disallowed or left alone. The state of the case is shortly this.

here under covering Despatch <date when="1865-03-18">18 March/65</date>. The ordinance was
submitted to the <orgName ref="org:board_trade">Board of Trade</orgName> &amp; <orgName ref="org:treasury">the Treasury</orgName>.

<orgName ref="org:treasury">The Treasury</orgName> objected to it on the ground that in effect it
imposed differential duties

A regulation under which ad valorem duties are calculated according
to the value of the article at the place of shipment, instead of at
the place of entry, establishes a system of differential duties
inasmuch as the result must be to<pb facs="co_60_26/co_60_26_00173v.jpg"/> subject articles identical in all
respects &amp; of the same price to the consumer, to different rates of
duty according as they may have been shipped from different countries.

<p>
In answer to their objection it was pointed out by the officer
administering the governm<hi style="vertical-align: super; font-size: 80%;">t</hi> of <placeName ref="plc:british_columbia">B. Columbia</placeName> that there was a
precedent for such legislation in Canada.

<p>
It appears also that the English Custom House Authorities declare
that this mode of levying ad valorem duties is the established &amp;
proper mode of levying them, and a <placeName ref="plc:gambia">Gambia</placeName> Ordinance which adopted
this mode was not objected to.

<p>
Under these circumstances it was determined not to send out a
Circular against this mode of levying duties, as suggested by the
Treasury.

<hi style="text-decoration: underline;">1;4650 <placeName ref="plc:british_columbia">B. Columbia</placeName></hi>

But before this was known, &amp; decided upon a despatch of the
<date when="1866-07-16">16<hi style="vertical-align: super; font-size: 80%;">th</hi> July</date> had been sent out to <placeName ref="plc:british_columbia">British Columbia</placeName> in which it was
stated that the Canadian precedent was not thought sufficient to
justify<pb facs="co_60_26/co_60_26_00174r.jpg"/> an exceptional practice in the case of <placeName ref="plc:british_columbia">British Columbia</placeName>, &amp;
that the law would be disallowed unless amendments were made to meet
the views of HM's Governm<hi style="vertical-align: super; font-size: 80%;">t</hi> before the expiration of 2 years from
the <date when="1865-06-29">29<hi style="vertical-align: super; font-size: 80%;">th</hi> June 1865</date>.

<p>
 The Governor of <placeName ref="plc:british_columbia">British Columbia</placeName> now writes word (Despatch of <date when="1867-03-18">18
March 1867</date>)
<milestone unit="section" rend=".ind on"/>
that a bill is before the Council repealing the clause objected to;
but that had it not been made a Governm<hi style="vertical-align: super; font-size: 80%;">t</hi> question of the
withdrawal of the provision which in the opinion of the Lords of the
Treasury imposed differential duties, he should be outvoted by a
large majority.

<p>
I may observe here that in <date when="1865">1865</date> <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> had not been
 united to <placeName ref="plc:british_columbia">B. Columbia</placeName>, &amp; there can be no doubt that the Ordinance was
 framed in a hostile spirit to <placeName ref="plc:vancouver_island">Vancouvers Island</placeName>, &amp; objected to by <persName ref="prs:douglas_j">Sir
J. Douglas</persName> on that account.
</p>
<p>
 This objection is now removed by the Union of <placeName ref="plc:vancouver_island">Vancouvers Island</placeName>
 &amp; <placeName ref="plc:british_columbia">B. Columbia</placeName> in <date when="1866">1866</date>.<pb facs="co_60_26/co_60_26_00174v.jpg"/> Under the circumstances the question is
whether to adhere to the despatch of <date when="1866-07">July/66</date> &amp; disallow the
Ordinance, or to leave it alone.
</p>
<p>
I confess I incline to the latter course. When that despatch
was sent off,
<hi style="text-decoration: underline;">the real facts were not known</hi>, viz that this was a usual &amp;
proper course adopted for levying ad valorem duties. Again, though
the amending Ordinance has not yet been received &amp; indeed may not
have passed, it is probable that it has passed by this time; and
according to <persName ref="prs:seymour_f"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Seymour</persName>s last Despatch of the <date when="1865-03-18">18<hi style="vertical-align: super; font-size: 80%;">th</hi> March</date> the <!-- WL 2018-08, re date 1865-03-18, cf line 344 -->
 Ordinance has worked well. The union of <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> &amp; <placeName ref="plc:british_columbia">B. Columbia</placeName> has removed the objection that it was framed in a hostile
 spirit to <placeName ref="plc:vancouver_island">V. Island</placeName>, and, in truth, that objection has not been put
forward by this Department.
</p>
<p>
I have framed &amp; send on 2 draft Despatches—one, on the
assumption that His Grace will not think it necessary under the
circumstances to advise a disallowance; the other on the assumption
that His Grace will think it necessary to enforce the views of the
Treasury, &amp; to adhere to the tenor of the <date when="1866-07">July</date> Despatch.

alternative drafts. I own that my leaning is in favor
of the one marked A, which disallows the law, chiefly
for the two following reasons—1<hi style="vertical-align: super; font-size: 80%;">st</hi> whatever may be
 the general practise on the subject, the <placeName ref="plc:british_columbia">B. Columbia</placeName>
law was evidently a manoeuver against <placeName ref="plc:vancouver_island">Vancouver</placeName> and
therefore one that deserved a mark of disapproval. 2<hi style="vertical-align: super; font-size: 80%;">nd</hi> the
Governor and his supporters will probably have made it one of their
arguments for the new Act that the previous one was sure to be
disallowed by HM's Government.

I do not see how consistently with the decision of
<date when="1866-07">July/66</date> any other course than disallowance can be
adopted. In that despatch after the arguments of the
Colony had been considered and the Union of the 2 Colonies decided
upon, 2 Secretaries of State in fact have written that the Act
<hi style="text-decoration: underline;">would be disallowed</hi> unless certain
things were done. Those things have not been done &amp;
it seems to me that I must either disallow in accordance with
that despatch or condemn the decision<pb facs="co_60_26/co_60_26_00176r.jpg"/> of my 2 predecessors—although
I think their policy may be questioned. Yet
that policy having been adopted I can not find sufficient
grounds for now condemning &amp; reversing it and therefore
disallow. The disallowance <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be deferred to the
last moment if there is a possibility of and the mail
being received before the <date when="1867-06-29">29<hi style="vertical-align: super; font-size: 80%;">th</hi></date>.
