<persName ref="prs:seymour_f">Seymour</persName> explains that the rivalry between <placeName ref="plc:vancouver_island">Vancouver Island</placeName> and the mainland stops <persName ref="prs:seymour_f">Seymour</persName> from using a local enactment from solving the question of who is chief justice of <placeName ref="plc:british_columbia">British Columbia</placeName>. <persName ref="prs:seymour_f">Seymour</persName> describes circumstances where the current situation with <persName ref="prs:needham">Needham</persName> and <persName ref="prs:begbie_mb">Begbie</persName> has caused judicial issues in <placeName ref="plc:british_columbia">British Columbia</placeName>. <persName ref="prs:seymour_f">Seymour</persName> proposes <q>the removal of one of the Judges.</q> <persName ref="prs:holland_ht">Holland</persName>’s minute describes the situation in <placeName ref="plc:british_columbia">British Columbia</placeName> regarding the position of <persName ref="prs:needham">Needham</persName> and <persName ref="prs:begbie_mb">Begbie</persName> and suggests how to reply to <persName ref="prs:seymour_f">Seymour</persName>’s despatch. <persName ref="prs:rogers_f">Rogers</persName>’s minute discusses how <persName ref="prs:seymour_f">Seymour</persName> could solve this issue alone and how removing on judge may be a viable solution to the current circumstances in <placeName ref="plc:british_columbia">British Columbia</placeName>. <persName ref="prs:grenville_r">Buckingham</persName> minutes that <persName ref="prs:needham">Needham</persName> refused the position in Singapore.

I have had the honor to receive Your Grace's despatch No. 28
of the <date when="1867-05-24">24<hi style="vertical-align: super; font-size: 80%;">th</hi> May</date> stating that the relative positions of <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Begbie</persName> and <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName><fw type="catchword" style="text-align: right;">should</fw><pb facs="co_60_29/co_60_29_00304v.jpg"/> should be explained by a local enactment.
</p>
<p>
2. I do not see my way to the carrying out Your Grace's
instructions. If I throw the question open for discussion in the
Council, it will take a purely personal turn. <placeName ref="plc:victoria">Victoria</placeName> will
support <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName>. The mainland probably <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName>. Not
from any certainty as to the superior merits of the former<fw type="catchword" style="text-align: right;">will</fw><pb facs="co_60_29/co_60_29_00305r.jpg"/> will
<persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName> be supported by <placeName ref="plc:victoria">Victoria</placeName> but because he is known to
be more a party man than <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName>.
</p>
<p>
3. Another great difficulty is that <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName> will not
acknowledge that the Legislature of the Colony has any power over
his Court. He holds that the Order in Council is supreme. <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Begbie</persName>, and I beg to say myself, believe that <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName>'s
Court was abolished<fw type="catchword" style="text-align: right;">on</fw><pb facs="co_60_29/co_60_29_00305v.jpg"/> on Union.
</p>
<p>
4. I found an instance of the inconvenience of the present state
of things recently when <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName> went up to the <placeName ref="plc:cariboo_region">Cariboo</placeName> to hear
the case of the Flume Company against the Canadian Company. <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Needham</persName> heard cases where <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName> had determined there was no
appeal. <persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName> being in <placeName ref="plc:new_westminster">New Westminster</placeName>, I suggested that
he should take <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName>'s<fw type="catchword" style="text-align: right;">place</fw><pb facs="co_60_29/co_60_29_00306r.jpg"/> place in <placeName ref="plc:victoria">Victoria</placeName>, but he refused
stating that it would be very unpleasant for him to have to declare
in <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName>'s absence that he was no Judge at all, his Court
having been swept away on the Union of the Colonies. My own belief
is that Your Grace will find yourself compelled to withdraw one
of these Gentlemen. I apprehend a very unpleasant discussion<fw type="catchword" style="text-align: right;">in</fw><pb facs="co_60_29/co_60_29_00306v.jpg"/> in
the Legislative Council at its next sitting respecting the mode in
which the Judicial arrangements of the Colony are left.
</p>
<p>
5. The present position of things is this—<persName ref="prs:begbie_mb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Begbie</persName> holds
that the proclamation of Union abolished the Supreme Court of <placeName ref="plc:vancouver_island">Vancouver
Island</placeName> and extended that of <placeName ref="plc:british_columbia">British Columbia</placeName> over the whole Colony.
He was until <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi><fw type="catchword" style="text-align: right;">Needham</fw><pb facs="co_60_29/co_60_29_00307r.jpg"/> Needham</persName> accepted a Commission from me previous
to his departure for <placeName ref="plc:cariboo_region">Cariboo</placeName>, sole Judge of that Court.
</p>
<p>
6. <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName> on the other hand holds that the Supreme
Court of <placeName ref="plc:vancouver_island">Vancouver Island</placeName> is untouched by the Act of Union, and is
independent of the Local Legislature. If the Order in Council which
creates the Court of the Island is still in force perhaps Your
Grace<fw type="catchword" style="text-align: right;">will</fw><pb facs="co_60_29/co_60_29_00307v.jpg"/> will be good enough to inform me if I am in the appointment
of Judges under it to use the Public Seal of <placeName ref="plc:vancouver_island">Vancouver Island</placeName> which
is still in my possession.
</p>
<p>
7. I have just received a letter from the Police Magistrate
of <placeName ref="plc:victoria">Victoria</placeName> in which he says,

I had an interview with <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName> today (<date when="1867-10-16">16<hi style="vertical-align: super; font-size: 80%;">th</hi> October</date>) at
which he told me that he did not consider himself to be a Judge
of <placeName ref="plc:british_columbia">British<fw type="catchword" style="text-align: right;">Columbia</fw><pb facs="co_60_29/co_60_29_00308r.jpg"/> Columbia</placeName> but was Chief Justice of <placeName ref="plc:vancouver_island">Vancouver Island</placeName>
and could not act as County Court Judge under the Ordinance of <date when="1867">1867</date>.

Yet <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName> accepted a Commission from me creating him a Judge
of the Supreme Court of <placeName ref="plc:british_columbia">British Columbia</placeName> and as such Judge has
reversed some of the decisions of the Gold Comm<hi style="vertical-align: super; font-size: 80%;">r</hi> of <placeName ref="plc:cariboo_region">Cariboo</placeName>.
</p>
<p>
8. I shall make the<fw type="catchword" style="text-align: right;">best</fw><pb facs="co_60_29/co_60_29_00308v.jpg"/> best of the present state of things but
I see no satisfactory issue from it save in the removal of one of
the Judges. The case is becoming more embarrassing every day.

In this despatch the difficulties arising from the uncertainty

 whether it can be affected by Local<pb facs="co_60_29/co_60_29_00309r.jpg"/> Ordinance are restated.
Acknowledge &amp; refer to the despatch of <date when="1867-11-13">13 Nov.</date> in which the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice>
was informed of the opinion of the <orgName ref="org:law_officers">Law Officers</orgName>, &amp; a draft ordinance
was enclosed.

<persName ref="prs:seymour_f"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Seymour</persName> seems to me to have been raising one difficulty after
another &amp; I cannot help believing that if he chose to settle the
difficulty he could do so. I would not therefore be inclined to
give him more help than he has had.
</ab>
<p>
I should be much inclined (if <persName ref="prs:needham">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Needham</persName> refuses Singapore)
to write out that the question [is one] <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> presented no real
difficulty whatever and that the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> by Legislation were
perfectly competent to extricate themselves from the difficulty
&amp; that H.G. could give them no further advice on the subject. But
I think it m<hi style="vertical-align: super; font-size: 80%;">t</hi> be properly added that if any officer of the
Colony, whether Judge or otherwise refused to conform his conduct to
the Law of the Colony passed in the opinion of HM's advisers by a
competent authority it <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> become a question whether the public
interest <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> not require that HM should be advised to remove him.
