I have to acknowledge your letter of <date when="1867-10-08">8<hi style="vertical-align: super; font-size: 80%;">th</hi> inst</date>, with a
despatch from the Governor of <placeName ref="plc:british_columbia">B. Columbia</placeName> on the subject of certain
land in dispute between the Government of the Colony and the Hudsons
Bay C<hi style="vertical-align: super; font-size: 80%;">o</hi>.
</p>
<p>
2. This land consists of two lots—one known as lot Z, the
other a small portion of the <placeName ref="plc:beacon_hill">Beacon Hill</placeName> Park. In respect to lot Z,
although the Governor treats it as still open to consideration, the
question is in fact closed. Upon this point I<pb facs="co_60_30/co_60_30_00228v.jpg"/> would beg to
refer to my report of <date when="1866-12-18">18<hi style="vertical-align: super; font-size: 80%;">th</hi> Dec<hi style="vertical-align: super; font-size: 80%;">r</hi> 1866</date>—and your answer of <date when="1867-01-02">2<hi style="vertical-align: super; font-size: 80%;">nd</hi>
Janry</date> last. In respect to the portion of <placeName ref="plc:beacon_hill">Beacon Hill</placeName> Park, it
will be remembered that the land had been cut off from the Park by an
error in running the boundary and had been sold by the Hudsons Bay
C<hi style="vertical-align: super; font-size: 80%;">o</hi>. I submitted that under these circumstances the price obtained
for this land, which was said to be $1700, ought to be repaid by the
<orgName ref="org:hbc">Hudsons Bay C<hi style="vertical-align: super; font-size: 80%;">o</hi></orgName> to the public. This suggestion was approved by the
<persName ref="prs:carnarvon">Earl of Carnarvon</persName> and accepted by the <orgName ref="org:hbc">Hudsons Bay C<hi style="vertical-align: super; font-size: 80%;">o</hi></orgName> who only
 stipulated that the amount to be repaid, not exceeding<pb facs="co_60_30/co_60_30_00229r.jpg"/> $1700, should
be determined by us. The Governor was in consequence requested to
furnish the necessary information to enable us to settle the
claim—and he does so in his despatch of the <date when="1867-09-24">24 Sept<hi style="vertical-align: super; font-size: 80%;">r</hi></date>.
</p>
<p>
3. He states that the extent of land cut off from the Park was
5 1/4 Acres of an average value of $400 an Acre—but that the claim
of the Colony would be fairly satisfied by a payment of $1700. The
way in which he arrives at this result is explained in the letters
from the Colonial Secretary and the Acting Surveyor General which
accompany his despatch. The actual price of the land at $400 an
acre would of course be $2100 but it is<pb facs="co_60_30/co_60_30_00229v.jpg"/> proposed to deduct from that
sum $400 for a narrow strip of land marked on a sketch which
accompanies the Surveyor General's letter, which it is desired to add
to the Park. As this seemed a fair arrangement we proposed it to
the <orgName ref="org:hbc">Hudsons Bay C<hi style="vertical-align: super; font-size: 80%;">o</hi></orgName> and they informed us in answer that they accept
it, and that the necessary instructions will be sent to their Agent
by the next mail. To prevent the possibility of mistake I enclose a
copy of the letter which we addressed to them on the subject and of
their answer, which I would submit should be communicated to<pb facs="co_60_30/co_60_30_00230r.jpg"/> the
Governor.
</p>
<p>
4. I infer from the Governor's despatch that he has not been
informed of the decision of the <persName ref="prs:carnarvon">Earl of Carnarvon</persName> in regard to lot
Z. If so I presume that the present opportunity would be taken
for explaining that decision to him.

In a despatch dated <date when="1866-10-26">26 Oct 1866</date> the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> of <placeName ref="plc:vancouver_island">Vancouver Island</placeName>
called attention to three points arising out of the reconveyance of
that Island to the Crown by the Hudson Bay <choice><abbr>C<hi style="vertical-align: super; font-size: 80%;">y</hi>.</abbr><expan>Company</expan></choice>
.off 1. the sale of a portion of <placeName ref="plc:beacon_hill">Beacon Hill</placeName> Park.
.off 2. Sale of a portion of the foreshore on the South side of <placeName ref="plc:james_bay">James
Bay</placeName>.
.off 3. Sale of the herein mentioned lot Z.

<p>
As regards the 1<hi style="vertical-align: super; font-size: 80%;">st</hi> the land on <placeName ref="plc:beacon_hill">Beacon Hill</placeName> the L &amp; E Com<hi style="vertical-align: super; font-size: 80%;">rs</hi>,
to whom the Gov<hi style="vertical-align: super; font-size: 80%;">rs</hi> despatch was referred, recommended that the
Company should be requested to refund the amount they <choice><abbr>rec<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>received</expan></choice>
for the Land.
</p>
<p>
2<hi style="vertical-align: super; font-size: 80%;">nd</hi> as regards the foreshore sale they were of opinion
 that the sale could not be contested,<pb facs="co_60_30/co_60_30_00231r.jpg"/> as recommended by the
Committee of Board of Officers in the Island.
</p>
<p>
3<hi style="vertical-align: super; font-size: 80%;">rd</hi> as regards lot Z the Comm<hi style="vertical-align: super; font-size: 80%;">rs</hi> were also of opinion that
the sale by the <choice><abbr>C<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>Company</expan></choice> could not be contested, &amp; they therefore
recommended that the money to be <choice><abbr>rec<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>received</expan></choice> from the <choice><abbr>C<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>Company</expan></choice> for <placeName ref="plc:beacon_hill">Beacon
Hill</placeName> should be spent in purchasing lot Z.
</p>
<p>
<persName ref="prs:carnarvon">Lord Carnarvon</persName> concurred &amp; instructed the Com<hi style="vertical-align: super; font-size: 80%;">rs</hi> to communicate
with the <choice><abbr>C<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>Company</expan></choice> accordingly.
</p>
<p>
The <choice><abbr>C<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>Company</expan></choice> consented to refund for <placeName ref="plc:beacon_hill">Beacon Hill</placeName>, but as the
Com<hi style="vertical-align: super; font-size: 80%;">rs</hi> had not sufficient information to enable them to fix the
amount, a further reference was made to the Colony.
</p>
<p>
That information has been supplied the <choice><abbr>C<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>Company</expan></choice> have consented to
 pay back $1700<pb facs="co_60_30/co_60_30_00231v.jpg"/> &amp; have instructed their Agent in the Colony to make
that payment.
</p>
<p>
On this point it is only necessary to inform the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> in
answer to his despatch 10835 what has been done.
</p>
<p>
In his despatch the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> called attention to the question of
lot Z, as regards which he had <choice><abbr>rec<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>received</expan></choice> no instructions. He must
therefore be informed that there is no claim ag<hi style="vertical-align: super; font-size: 80%;">t</hi> the <choice><abbr>C<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>Company</expan></choice> for this
sale—but it is also necessary to consider &amp; decide what instructions
should be given for its repurchase.
</p>
<p>
As to the foreshore sale I suppose the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> must also be told
that the sale by the <choice><abbr>C<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>Company</expan></choice> was a valid one.

the sale could not be impeached. The B<hi style="vertical-align: super; font-size: 80%;">d</hi> of Officers appeal ag<hi style="vertical-align: super; font-size: 80%;">t</hi>
the decision—&amp; it is on that appeal that <persName ref="prs:seymour_f"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Seymour</persName> says he has
<choice><abbr>rec<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>received</expan></choice> no instructions. The Gov. <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> therefore I think be told
the question has been already decided &amp; cannot be reopened.

in his dph of <date when="1865-08-14">14 Aug</date> must be adhered to.

That the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> will have already perceived
from HGs dph N<hi style="vertical-align: super; font-size: 80%;">o</hi> 23 of <date when="1866-05-11">11 May</date> that HMG have not considered themselves
entitled to require any modification of the Deed of Reconveyance of
<placeName ref="plc:vancouver_island">V.C.I.</placeName> with the object of avoiding the sale of certain portions of
foreshore referred to in the 5<hi style="vertical-align: super; font-size: 80%;">th</hi> parag of the report of certain
public officers enclosed in <persName ref="prs:kennedy_a">Gov Kennedy</persName>'s dph N<hi style="vertical-align: super; font-size: 80%;">o</hi> 81 of <date when="1866-10-20">20 Oct. 1866</date>.
