Holland’s minute discusses the forwarded ordinance and suggests how to reply to Seymour’s despatch. I have the honor to forward an Authenticated and two plain Copies of an Ordinance of the Legislature of this Colony, entitled; No. 8. No. 8. An Ordinance authorizing the Sale of the Real Estate of Intestates, and for other purposes.

2. This measure appears to me well adapted to the circumstances of the Colony and I see no objection to its allowance.

Mr Elliot The Ordinance of 1867 has been repealed (though it is wrongly cited in this Ordinance) & this Ordinance adopts the amendments suggested by this Department. A new section—sect. 5—is added, which as it is confined to Estates under $500 dollars may perhaps be allowed upon the strong recommendation of the Attorney General. But I should be disposed to state that HG only allows the section in accorde with such strong recommendation, and that he wdwould not be prepared to sanction so novel a clause in cases of Estates of any larger value than that fixed by the Ordinance.
