<persName ref="prs:seymour_f">Seymour</persName> forwards two applications addressed <q>praying for compensation</q> due to losses resulting from <q>permanently removing from <placeName ref="plc:new_westminster">New Westminster</placeName> to <placeName ref="plc:victoria">Victoria</placeName>.</q> <persName ref="prs:seymour_f">Seymour</persName> describes why each man in the applications has a reason to ask for compensation, but <persName ref="prs:seymour_f">Seymour</persName> looks more favourably on the men in the first application than the second. <persName ref="prs:seymour_f">Seymour</persName> makes no specific recommendations for providing compensation to the men who made the applications. <persName ref="prs:robinson_w">Robinson</persName>’s minute summarizes why each man is making a claim for compensation to the <orgName ref="org:colonial_office">Colonial Office</orgName> and relates why the <orgName ref="org:colonial_office">Colonial Office</orgName> probably will not be able to offer any type of compensation. <persName ref="prs:rogers_f">Rogers</persName>’s minute discusses how the men who made the application for compensation could receive compensation for their hardships in moving from <placeName ref="plc:new_westminster">New Westminster</placeName> to <placeName ref="plc:victoria">Victoria</placeName>.

I have the honor to forward two applications addressed to me by
Officers of this Government praying for compensation for the
losses they have sustained<fw type="catchword" style="text-align: right;">by</fw><pb facs="co_60_33/co_60_33_00252v.jpg"/> by permanently removing from <placeName ref="plc:new_westminster">New
Westminster</placeName> to <placeName ref="plc:victoria">Victoria</placeName>.
</p>
<p>
2. The first application is signed by:

<persName ref="prs:good_c">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Charles Good</persName>, Assistant Colonial Secretary.
<lb/>
<persName ref="prs:calder_a">M<hi style="vertical-align: super; font-size: 80%;">r</hi> A. Calder</persName>, Clerk in <orgName ref="org:treasury">the Treasury</orgName>.
<lb/>
<persName ref="prs:graham_jo">M<hi style="vertical-align: super; font-size: 80%;">r</hi> John Graham</persName>, Officer in Charge of <orgName ref="org:treasury">the Treasury</orgName>.

</p><fw type="catchword" style="text-align: right;">3. I</fw><pb facs="co_60_33/co_60_33_00253r.jpg"/>
<p>
3. I have but little to add to the perfectly accurate
statements of these Gentlemen. They were forced to proceed to
<placeName ref="plc:new_westminster">New Westminster</placeName>. But the so called <placeName ref="plc:new_westminster">New Westminster</placeName> was at that
time a dense forest out of which each public officer had to hew
a spot for his residence. I fear nearly all of them performed
the operation on borrowed money.
</p>
<p>
4. After living for<fw type="catchword" style="text-align: right;">some</fw><pb facs="co_60_33/co_60_33_00253v.jpg"/> some time in a hut, <persName ref="prs:ker">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Ker</persName> purchased a
very pretty cottage from a Captain of the Royal Engineers. By
dint of labour, he has made his garden one of the prettiest in
the Colony. He has bought and cleared an acre of land
adjoining. All this is for the present valueless.
</p>
<p>
5. <persName ref="prs:good_c">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Charles Good</persName> has built himself a house on the
outskirts of the town and cleared a considerable piece<fw type="catchword" style="text-align: right;">of</fw><pb facs="co_60_33/co_60_33_00254r.jpg"/> of land
of rock and forest. He could not sell his house nor find a
tenant for it.
</p>
<p>
6. <persName ref="prs:calder_a">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Calder</persName> has likewise built a very good house.
</p>
<p>
7. <persName ref="prs:graham_jo">M<hi style="vertical-align: super; font-size: 80%;">r</hi> John Graham</persName> purchased a town lot, cleared it and
built a house upon it for a residence. I understand that he has
spent between three and four thousand dollars in this way.
</p>
<p>
8. <persName ref="prs:westgarth">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Westgarth</persName>'s case is one of equal hardship. He<fw type="catchword" style="text-align: right;">formerly</fw><pb facs="co_60_33/co_60_33_00254v.jpg"/>
formerly resided in <placeName ref="plc:victoria">Victoria</placeName>, but the Legislative Council of
<placeName ref="plc:british_columbia">British Columbia</placeName> passed the Resolution that they would increase
his Salary if he came to reside in <placeName ref="plc:new_westminster">New Westminster</placeName> or refuse to
vote it at all if he remained in <placeName ref="plc:victoria">Victoria</placeName>. He came to the
former town, bought a house and now resides in <placeName ref="plc:victoria">Victoria</placeName> having
had his Salary abolished and being supported by Fees. The case<fw type="catchword" style="text-align: right;">of</fw><pb facs="co_60_33/co_60_33_00255r.jpg"/>
of these Gentlemen appears to me to be one of extreme hardship.
</p>
<p>
8. [sic] I add for Your Grace's consideration the Salaries
drawn respectively by each of these Officers and the length of
their period of Service:

<persName ref="prs:ker">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Ker</persName> $2,400. <date when="1859-05">May 1859</date>.
<lb/>
<persName ref="prs:good_c">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Good</persName> $2,540. <date when="1859-04">April 1859</date>.
<lb/>
<persName ref="prs:calder_a">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Calder</persName> $1,450. <date when="1860-02">February 1860</date>.
<lb/>
<persName ref="prs:graham_jo">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Graham</persName> $1,700. <date when="1859-04">April 1859</date>.
<lb/>
<persName ref="prs:westgarth">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Westgarth</persName>. Fees. <date when="1864-01">January 1864</date>.

</p><fw type="catchword" style="text-align: right;">9. With</fw><pb facs="co_60_33/co_60_33_00255v.jpg"/>
<p>
9. With the exception of the officer whose name appears first
on the list, the signers of the Second petition do not appear to
me to have the same claim to Your Grace's consideration as those
of the first. <persName ref="prs:crease">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Crease</persName>, however has every claim to any
indulgence which the Government can extend. He too was ordered
to live at <placeName ref="plc:new_westminster">New Westminster</placeName> and he<fw type="catchword" style="text-align: right;">too</fw><pb facs="co_60_33/co_60_33_00256r.jpg"/> too built a house, exceeding in
size and comfort that of any other applicant for compensation.
I fear not entirely with cash. He has not the means of even
paying the passages of his wife and large family down to
<placeName ref="plc:victoria">Victoria</placeName>. Much less of providing a house for them if they come.
He has now to begin the work again and alone.
</p>
<p>
10. The case of <persName ref="prs:hamley_wo">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Hamley</persName><fw type="catchword" style="text-align: right;">I</fw><pb facs="co_60_33/co_60_33_00256v.jpg"/> I do not think can be very widely
separated from the General question of compensation to the
proprietors in <placeName ref="plc:new_westminster">New Westminster</placeName> for the losses they have
sustained by the withdrawal of the Public Officers and the
almost total ruin of their town. <persName ref="prs:hamley_wo">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Hamley</persName> had quarters
provided for him in the Custom House and having no reason to
suppose that he would ever<fw type="catchword" style="text-align: right;">be</fw><pb facs="co_60_33/co_60_33_00257r.jpg"/> be removed invested considerably in
land in the town, cleared it at a large expense and it is now
almost valueless. Yet <persName ref="prs:hamley_wo">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Hamley</persName> was specially sent from
England to reside at <placeName ref="plc:new_westminster">New Westminster</placeName> and it was not at his own
choice that he was moved.
</p>
<p>
11. <persName ref="prs:bushby">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Bushby</persName> has not been brought down from <placeName ref="plc:new_westminster">New
Westminster</placeName>, nor his position changed. There his land is much
deteriorated in<fw type="catchword" style="text-align: right;">value</fw><pb facs="co_60_33/co_60_33_00257v.jpg"/> value by the late great change, but he cannot be
separated from the general claim of all householders. I do not
ask for Your Grace's special consideration for him.
</p>
<p>
12. <persName ref="prs:mccrea">M<hi style="vertical-align: super; font-size: 80%;">r</hi> M<hi style="vertical-align: super; font-size: 80%;">c</hi>Crea</persName> has bought land and built a house on the
faith of his permanent appointment to New Westminster.
</p>
<p>
13. <persName ref="prs:frye">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Fry [Frye]</persName> the same.
</p>
<p>
14. <persName ref="prs:brew_c">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Brew</persName> has unquestionably been a loser by the change<fw type="catchword" style="text-align: right;">in</fw><pb facs="co_60_33/co_60_33_00258r.jpg"/>
in the Seat of Government. At the same time it has always been
held that the Magistrates are liable to be removed from one
Station to another. His house and land have undoubtedly lost a
considerable amount of their value by the removal of the Capital
from <placeName ref="plc:new_westminster">New Westminster</placeName>.
</p>
<p>
15. I hardly know what specific recommendations to make to Your
Grace in<fw type="catchword" style="text-align: right;">this</fw><pb facs="co_60_33/co_60_33_00258v.jpg"/> this matter. There can be no doubt that most of the
petitioners, all those who signed the first petition and <persName ref="prs:crease">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Crease</persName>, have suffered very great losses from no fault of their own.
</p>

The principal officers under the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> of <placeName ref="plc:british_columbia">B. Columbia</placeName> ask for
compensation for the losses occasioned to them by the change of
their residences to the new Capital of the Colony.
</ab>
<p>
Nine years ago they were desired by the S of S to remove from
<placeName ref="plc:victoria">Victoria</placeName> to <placeName ref="plc:new_westminster">N Westminster</placeName> or to resign if they declined to do so.
</p>
<p>
 Their<pb facs="co_60_33/co_60_33_00260r.jpg"/> case is doubtless of considerable hardship but I really do
not see how it can be ameliorated though the circumstances of
the Colony are so peculiar that a compliance with their
application would hardly form a precedent.
</p>
<p>
<persName ref="prs:seymour_f">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Seymour</persName> makes no recommendation either in favour of
compensation by a grant of money or of land, neither is there
any estimate of the individual loss.
</p>

These are certainly very lamentable cases: and any of H.G's
patronage <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> may be available <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> be well bestowed
in lightening the loss of some of these gentlemen. But I am not
aware that Imperial funds can be applied [to?] relieve them and
it is for the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> rather than for H.G. to suggest how
Colonial funds can be obtained or made applicable to that
object. I should answer that H.G.<pb facs="co_60_33/co_60_33_00260v.jpg"/> sincerely lamented the losses
to which these gentlemen had been subjected by the consolidation
of the two Colonies and would gladly learn that the Colonial
Legislature had voted them in land or money some compensation
for those losses. But that it was for the Col <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> &amp;
Legislature to consider how &amp; to what extent this could be done,
as it was not in HG's power to recommend that any indemnity
<choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be given them from Imperial Funds.
