<persName ref="prs:dundas_f">Dundas</persName> forwards <q>additional Papers in reference to the Application for a Grant of Land at <placeName ref="plc:victoria">Victoria</placeName>, for Church Purposes by Members of the Church of Scotland</q> in <placeName ref="plc:british_columbia">British Columbia</placeName> for <persName ref="prs:grenville_r">Buckingham</persName>. <persName ref="prs:cox_c">Cox</persName>’s minute relates that the additional papers discuss why the Church of Scotland should receive a land grant on <placeName ref="plc:vancouver_island">Vancouver Island</placeName>, similar to the Church of England. <persName ref="prs:rogers_f">Rogers</persName> minutes instructions regarding how to reply to <persName ref="prs:dundas_f">Dundas</persName> and the Church of Scotland, relating why the government was obligated to grant land to the Church of England but is not obligated to grant land to the Church of Scotland. Included documents describe the grant of land to the Church of England on <placeName ref="plc:vancouver_island">Vancouver Island</placeName> and discuss the proposition for a grant of land to the Church of Scotland.

I beg to forward for the further Consideration of the <persName ref="prs:grenville_r">Duke of
Buckingham</persName>, additional Papers in reference to the Application
for a Grant of Land at <placeName ref="plc:victoria">Victoria</placeName>, for Church Purposes by Members
of the Church of Scotland in that Colony.

You will oblige me by bringing the Subject under his Grace's

See minutes on Land B<hi style="vertical-align: super; font-size: 80%;">d</hi> 10805—on the claim of the Church of
Scotland to a grant of Land in <placeName ref="plc:vancouver_island">Vancouvers Island</placeName> to put them on
an equality with the Church of England who had <choice><abbr>rec<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>received</expan></choice> one.
</ab>
<p>
In reply they were informed the latter was made by the Hudson's
Bay Company,<pb facs="co_60_34/co_60_34_00479v.jpg"/> &amp; that the Crown did not make such Grants.
</p>
<p>
They now reply that the Grant was made after the <date when="1862-02-03">3<hi style="vertical-align: super; font-size: 80%;">rd</hi> Feb 1862</date>
when the Crown resumed the Lands of the Company, including that
part subsequently granted to the Ch. of E. &amp; that that Grant
tho' made in <date when="1864">1864</date> by the Company was made on the part of the
Crown—but it would appear that the Grant was merely to
complete an agreement made by the Company before <date when="1862">1862</date><pb facs="co_60_34/co_60_34_00480r.jpg"/> to give this Land.

Answer to the above effect, viz that the Hudson B.C. before <placeName ref="plc:vancouver_island">V.C.I.</placeName>
was resumed by the Crown had come or was considered to have come
under an obligation to grant certain lands to the Church of
E.—and that the Crown permitted or directed the Comp<hi style="vertical-align: super; font-size: 80%;">y</hi> to
fulfil their obligation just as it <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> have permitted or directed
the Company to fulfil any other obligation, binding on its
lands, to any other person or body of persons—that if no such
obligation had existed in favour of the Ch. of E, the Crown
would not have sanctioned such a grant of land to the Ch of E,
and as no such obligation exists in favour of the Ch of Scotland
HG does not consider<pb facs="co_60_34/co_60_34_00480v.jpg"/> the Crown at liberty to direct such a grant
to be made to the Church of Scotland.
