I have laid before The <persName ref="prs:clarendon">Earl of Clarendon</persName> your letter of the
<date when="1869-03-17">17<hi style="vertical-align: super; font-size: 80%;">th</hi> instant</date>, marked Confidential, and I am, in reply, to
request that you will state to <persName ref="prs:leveson_g">Earl Granville</persName> that there is
nothing in the correspondence of this Office to show the precise
relative positions of the Naval Commander in Chief and of the
Governor of <placeName ref="plc:british_columbia">British<fw type="catchword" style="text-align: right;">Columbia</fw><pb facs="co_60_37/co_60_37_00204v.jpg"/> Columbia</placeName> in regard to the occupancy of the
<placeName ref="plc:san_juan_island">Island of San Juan</placeName>.
</p>
<p>
I am, however, to observe that, by the agreement come to by
<persName ref="prs:scott">General Scott</persName> and <persName ref="prs:douglas_j">Governor Douglas</persName> in <date when="1859">1859</date>, the occupation
of the <placeName ref="plc:san_juan_island">Island of San Juan</placeName> was to be a joint military occupation,
and the arrangements with the United States' Military Commander,
for placing the Island in the joint occupation of the
detachments of British Marines and United<fw type="catchword" style="text-align: right;">States</fw><pb facs="co_60_37/co_60_37_00205r.jpg"/> States infantry, were
undertaken by the then Admiral on the Station, <persName ref="prs:baynes_rl">Admiral Baynes</persName>,
who issued the orders to the Officer of Marines, under which the
Officer commanding the British force has since acted, and which
were communicated by him to the United States' Commander on the
<date when="1860-03-20">20<hi style="vertical-align: super; font-size: 80%;">th</hi> of March 1860</date>. <persName ref="prs:douglas_j">Governor Douglas</persName> had originally proposed
that it should be a civil occupation, but <persName ref="prs:scott">General Scott</persName> objected
to<fw type="catchword" style="text-align: right;">this</fw><pb facs="co_60_37/co_60_37_00205v.jpg"/> this on the ground that, in that case, the civil magistrate
would be under the control of the local Government of <placeName ref="plc:washington_territory">Washington
Territory</placeName>, which, for obvious reasons, would be inexpedient,
while a military force would be under the direct command of the
central Government.
</p>
<p>
It will be seen from the letter from the <orgName ref="org:colonial_office">Colonial Office</orgName> of the
<date when="1861-03-19">19<hi style="vertical-align: super; font-size: 80%;">th</hi> of March 1861</date>, that the British Civil Magistrate<fw type="catchword" style="text-align: right;">was</fw><pb facs="co_60_37/co_60_37_00206r.jpg"/> was
withdrawn at the suggestion of <persName ref="prs:douglas_j">Governor Douglas</persName> in that year.
</p>
<p>
Moreover, it appears from the papers laid before the Senate, of
which a copy was forwarded to you in my letter of the <date when="1868-07-06">6<hi style="vertical-align: super; font-size: 80%;">th</hi>
of July 1868</date>, that the civil
Authorities of <placeName ref="plc:washington_territory">Washington Territory</placeName> and the district Revenue
Officers claim to exercise jurisdiction over the Island,
notwithstanding the agreement of <date when="1859">1859</date>, which, although approved
by the executive,<fw type="catchword" style="text-align: right;">they</fw><pb facs="co_60_37/co_60_37_00206v.jpg"/> they do not consider legally binding on them
without the authority of an Act of Congress. Under instructions
from the State Department, the United States' military Officers
have forcibly resisted these pretensions, and, in <date when="1867">1867</date>, <persName ref="prs:graves">Brevet
Major Graves</persName> was arrested and put under heavy bonds for this
resistance to the civil Jurisdiction of the Territory.
</p>
<p>
Under these circumstances,<fw type="catchword" style="text-align: right;">Lord</fw><pb facs="co_60_37/co_60_37_00207r.jpg"/> <persName ref="prs:clarendon">Lord Clarendon</persName> considers that it
would not be advisable to make any change in the manner in which
the British occupancy has hitherto been carried on. The Officer
of Marines must necessarily be dependent for many purposes on
the Admiral, under whose orders he should remain, while the
Governor and the Admiral should act in concert with regard to
any political questions that may arise.
</p>
<p>
If the authority of the<fw type="catchword" style="text-align: right;">Governor</fw><pb facs="co_60_37/co_60_37_00207v.jpg"/> Governor of <placeName ref="plc:british_columbia">British Columbia</placeName> over the
Island is asserted by the British Government, the local
Government of <placeName ref="plc:washington_territory">Washington Territory</placeName> may be further encouraged to
assert their Civil Jurisdiction over it, and the agreement of
<date when="1859">1859</date> be disturbed.
</p>
<p>
I am to suggest that copies of this correspondence should be
furnished for the information of the <orgName ref="org:admiralty">Board of Admiralty</orgName>.
