I am directed by the Lords Commissioners of Her Majesty's
Treasury to transmit to you, herewith, for the information of
the Secretary of State copy of remarks by <persName ref="prs:pratt_t">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Tidd Pratt</persName> on the
<placeName ref="plc:british_columbia">British Columbia</placeName> Savings Bank Ordinance inclosed in your Letter
of the <date when="1869-05-22">22 May</date>; and I am to suggest that the attention of the
Governor should be drawn to <persName ref="prs:pratt_t">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Tidd Pratt</persName>'s observations with a
view to the amendment of the Ordinance in conformity therewith.

Send out copy of <persName ref="prs:pratt_t">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Tidd Pratt</persName>'s report. I do not attach
much importance to his comment on sec 9. The Commissioners need
not I apprehend receive a deposit from a child of 3, but if they
do there is no harm in their repaying the child—Sec 30 of the
Imperial Act (26 &amp; 27 <placeName ref="plc:victoria">Vict</placeName>. c. 87) is much to the same effect.

<p>
But I incline to think upon further consideration that his
comment upon sect. 10 is just. I thought when I read the
Ordinance that this was rather a matter for the Colonists to
decide for themselves than for us to decide for them, &amp; that if
they chose to give the Commiss<hi style="vertical-align: super; font-size: 80%;">rs</hi> the power—in the case for
example where the husband is a dissolute idle scoundrel—to hand
over the deposit to the woman who had made it, it was not

unreasonable that the C<hi style="vertical-align: super; font-size: 80%;">ers</hi> should have that power.
</p>
<p>
But perhaps the C<hi style="vertical-align: super; font-size: 80%;">ers</hi> should not have power to upset
pro tanto the law of Husband &amp; Wife, which, if defective, should be
remedied by express legislation.
</p>
<p>
Desire that the amendments suggested should be made.
