I have had the honor to receive Your Lordship's Despatch N<hi style="vertical-align: super; font-size: 80%;">o</hi>
101, of the <date when="1870-11-03">3<hi style="vertical-align: super; font-size: 80%;">rd</hi> November</date>, enclosing copies of correspondence
between <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName>, the <orgName ref="org:colonial_office">Colonial Office</orgName> and <orgName ref="org:treasury">the Treasury</orgName>
respecting his application for a gratuity on<fw type="catchword" style="text-align: right;">account</fw><pb facs="co_60_38/co_60_38_00011v.jpg"/> account of the loss
of his Office and authorizing me to recommend to the Council
that a gratuity equivalent to not more than six months Salary
should be voted to <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName>.
</p>
<p>
2. Having regard to the peculiar legislative constitution of
this Colony, which enables any grant however exceptional in its
character to be obtained from the Council if the Official
Members are ordered to vote as the Governor directs, I think it<fw type="catchword" style="text-align: right;">my</fw><pb facs="co_60_38/co_60_38_00012r.jpg"/> my
duty to call Your Lordship's attention to some circumstances in
this case before the vote is brought forward at Your Lordship's
instance.
</p>
<p>
3. <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName>'s case is not in fact analogous to those of other
Officials who have received compensation for loss of Office.
That from which <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName> was removed has not been abolished.
The Colony has derived no financial advantage from his removal;
on the contrary it has been put to the expense of<fw type="catchword" style="text-align: right;">several</fw><pb facs="co_60_38/co_60_38_00012v.jpg"/> several
hundred pounds for passage money; and neither the Legislature
nor the public desired that he should be removed. Under these
circumstances I fear that the Council will not regard it as a
case in which compensation can fairly be claimed from the
Colony, especially when through the circumstances attending <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Young</persName>'s removal it has already been charged with the expense of
two Colonial Secretarys

for<fw type="catchword" style="text-align: right;">several</fw><pb facs="co_60_38/co_60_38_00013r.jpg"/> several months—full Salary having
been paid to <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName> up to the <date when="1869-04-07">7<hi style="vertical-align: super; font-size: 80%;">th</hi> April</date>, while half Salary
was paid to <persName ref="prs:hankin_p">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Hankin</persName> from <date from="1869-11-21" to="1869-12-31">21<hi style="vertical-align: super; font-size: 80%;">st</hi> November, to 31<hi style="vertical-align: super; font-size: 80%;">st</hi> December</date>,
the date of his arrival in the Colony, and full Salary from that
date to <date when="1870-04-07">7<hi style="vertical-align: super; font-size: 80%;">th</hi> April</date> when he assumed the duties of his Office.
</p>
<p>
4. On the Union of <placeName ref="plc:vancouver_island">Vancouver Island</placeName> with <placeName ref="plc:british_columbia">British Columbia</placeName> it
was not the intention of Her Majesty's Government or of the
community to abolish Offices<fw type="catchword" style="text-align: right;">simply</fw><pb facs="co_60_38/co_60_38_00013v.jpg"/> simply in order to dismiss all
public servants who had the misfortune to belong to one section
of the United Colony, so much as to consolidate the double
official departments for the sake of economy. In the case of
the Colonial Secretary's Office, a vacancy was created in that
of <placeName ref="plc:british_columbia">British Columbia</placeName> (Mainland) by the resignation of <persName ref="prs:birch">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Birch</persName>
which readily enabled such consolidation. <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName>, Colonial
Secretary of <placeName ref="plc:vancouver_island">Vancouver Island</placeName><fw type="catchword" style="text-align: right;">was</fw><pb facs="co_60_38/co_60_38_00014r.jpg"/> was therefore appointed Acting
Colonial Secretary of the United Colony and he discharged the
duties of his Office for two years, nor was there any public
objection to his continuing to hold the appointment. If he had
done so he would then have been the only Official formerly
holding any Office of importance in <placeName ref="plc:vancouver_island">Vancouver Island</placeName> who had
been retained in the Service except the Chief Justice. I need
not conceal from Your Lordship that considerable<fw type="catchword" style="text-align: right;">soreness</fw><pb facs="co_60_38/co_60_38_00014v.jpg"/> soreness of
feeling exists in <placeName ref="plc:vancouver_island">Vancouver Island</placeName> as to the manner in which the
rearrangement of the public departments was effected on the
Union of the Colonies, and I am sure that the irritation will be
reawakened by any application for compensation to <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName>; who
was not removed for the advantage of the Colony; and who was
replaced by another Officer sent from England, not by anyone
within the<fw type="catchword" style="text-align: right;">Government</fw><pb facs="co_60_38/co_60_38_00015r.jpg"/> Government for whom it was expedient to provide.
I am satisfied that the Unofficial Members of the Council will
not approve of the proposed grant and if passed by the Official
Vote only the proceeding will be regarded as an arbitrary
exercise of the authority of the Government.
</p>
<p>
5. I annex an Extract from the Minutes of the Executive Council
from which it appears that the grant of passage money to <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Young</persName> was<fw type="catchword" style="text-align: right;">intended</fw><pb facs="co_60_38/co_60_38_00015v.jpg"/> intended as compensation in full for all claim.
</p>

I think it would have been better if <persName ref="prs:musgrave_a">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Musgrave</persName> had submitted
the case for the consideration &amp; decision of the
Council—leaving the officials to vote as they pleased—it
certainly was not one to force on the Council. I think also
that <persName ref="prs:musgrave_a">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Musgrave</persName> loses sight of the fact that <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName> did
 lose his app<hi style="vertical-align: super; font-size: 80%;">t</hi> as Colonial<pb facs="co_60_38/co_60_38_00016v.jpg"/> <choice><abbr>Se<choice><abbr>c<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>company</expan></choice></abbr><expan>Secretary</expan></choice> of Vancouver Island on the
abolition of that app<hi style="vertical-align: super; font-size: 80%;">t</hi>. Had <persName ref="prs:birch">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Birch</persName> remained as Colonial
<choice><abbr>Se<choice><abbr>c<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>company</expan></choice></abbr><expan>Secretary</expan></choice> <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName> would have been without Office &amp; most fairly
entitled to some gratuity for his loss.

exposing <persName ref="prs:leveson_g">L<hi style="vertical-align: super; font-size: 80%;">d</hi> G.</persName> to a refusal.

I <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> answer <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName> that <persName ref="prs:leveson_g">Lord G</persName> had communicated with the
Gov. of B.C. and found that there was no chance of carrying the
gratuity, except by the means<pb facs="co_60_38/co_60_38_00017r.jpg"/> of the official majority, of <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice>
in such a case it <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> not be proper for a Governor to avail himself.
