I have had the honor to receive Your Lordship's Despatch N<hi style="vertical-align: super; font-size: 80%;">o</hi> 14
of the <date when="1870-09-01">1<hi style="vertical-align: super; font-size: 80%;">st</hi> September</date>, with a copy of a further Letter received
by your Department from <persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName>, and expressing a desire to be
informed whether <persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName> has any ground for claiming a title to
the land in question.
</p><fw type="catchword" style="text-align: right;">2.</fw><pb facs="co_60_41/co_60_41_00203v.jpg"/>
<p>
2. I am advised by the Crown <orgName ref="org:law_officers">Law Officers</orgName> that <persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName> has
not; and this is the point at issue between the Government and
other parties as well as <persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName>, who are in the same position.
I enclose a Memorandum prepared by the Colonial Secretary which
will I think afford Your Lordship the necessary information as
to the circumstances of the case. There is not any desire to
withhold from <persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName> what he may be legally entitled to,
but any concession to him of more than he can<fw type="catchword" style="text-align: right;">legally</fw><pb facs="co_60_41/co_60_41_00204r.jpg"/> legally establish
would immediately be made a precedent in other instances.

incline to think thought, with others, that he was doing a clever thing.

<persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName> should have a copy of this Mem<hi style="vertical-align: super; font-size: 80%;">o</hi> by the Colonial
<choice><abbr>Se<choice><abbr>c<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>company</expan></choice></abbr><expan>Secretary</expan></choice>, &amp; be told that the <choice><abbr>Se<choice><abbr>c<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>company</expan></choice></abbr><expan>Secretary</expan></choice> of State cannot interfere any
 further? This might be<pb facs="co_60_41/co_60_41_00205v.jpg"/> done in ackn<hi style="vertical-align: super; font-size: 80%;">g</hi> q[uery] <choice><abbr>rec<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>received</expan></choice>

were afraid of going to a jury (vide p. 5) but would merely say that
the S. of State having enquired into the matter found that the
<choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> disputed <persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName>'

title—that the right in a case similar to his own
(that of <persName ref="prs:trimble">D<hi style="vertical-align: super; font-size: 80%;">r</hi> Trimble</persName>) was under
 arbitration and that his case will<pb facs="co_60_41/co_60_41_00206r.jpg"/> be dealt with by <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> when a
decision on that arbitration is obtained.
</ab>
<p>
&amp; that in any case the matter appears to be one to be
settled by a Court of Law &amp; not by the Secretary of State.
