In <date when="1871-02">February last</date>, <persName ref="prs:ball_hm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Ball</persName> the Magistrate of the <placeName ref="plc:cariboo_region">Cariboo
District</placeName>, who relieved the late <persName ref="prs:brew_c">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Brew</persName> in that capacity a few
months before, reported to me in a Letter of which I annex a
Copy, that<fw type="catchword" style="text-align: right;">he</fw><pb facs="co_60_43/co_60_43_00486v.jpg"/> he had detected the abstraction of a large sum from
the Revenue during the years <date when="1868">1868</date> and <date when="1869">1869</date>, by the late Clerk
and Recorder of Mining claims, <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cochrane</persName>, who was, it is
believed lost in the "<name ref="vsl:city_of_boston" type="vessel">City of Boston</name>" Steamer on his way to England.
</p>
<p>
2. As <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cochrane</persName>, and <persName ref="prs:brew_c">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Brew</persName>—through whose
carelessness—arising I believe<fw type="catchword" style="text-align: right;">only</fw><pb facs="co_60_43/co_60_43_00487r.jpg"/> only from the extremely feeble state of
his health for a long time, this embezzlement has occurred, are both
dead, it seemed very improbable that the defalcations could be
recovered, but I directed the Auditor General to communicate at
once with <persName ref="prs:ball_hm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Ball</persName>, to furnish him with all the information and
Documents<fw type="catchword" style="text-align: right;">he</fw><pb facs="co_60_43/co_60_43_00487r.jpg"/> he asked for and to ascertain as fully as possible the
amount and particulars of the sums received by <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cochrane</persName> and
unaccounted for. These are now reported to amount to Five
thousand, seven hundred, and Forty-five Dollars, received for
Records of Mining Claims, and "Leaves of Absence" from Mining
claims under the Gold<fw type="catchword" style="text-align: right;">Mining</fw><pb facs="co_60_43/co_60_43_00488r.jpg"/> Mining Ordinance.
</p>
<p>
3. It appears that in the year <date when="1868">1868</date> two insignificant errors of
$5 each were discovered in the Accounts of the <placeName ref="plc:cariboo_region">Cariboo</placeName> Station,
for that Year, and the smallness of the amount and the
explanation given did not cause any distrust. Further queries
upon the <date when="1869">1869</date> accounts, which reached <placeName ref="plc:cariboo_region">Cariboo</placeName> after <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi><pb facs="co_60_43/co_60_43_00488v.jpg"/> Cochrane</persName>
had left, where certain Leaves of Absence were entered on the
Counterfoils but not entered on the Cash Book, amounting to
$27.50, caused <persName ref="prs:ball_hm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Ball</persName> to make further comparison in the Record
Books kept in the Office, disclosing in the end the deficiencies
now reported.
</p>
<p>
4. It has always been manifest to me that there<fw type="catchword" style="text-align: right;">must</fw><pb facs="co_60_43/co_60_43_00489r.jpg"/> must be great
difficulty in exercising efficient supervision over the Accounts
of the distant Districts; but extensive fraud was scarcely
possible except through collusion, or great carelessness in the
Magistrate. To this latter cause and over confidence in the
integrity of <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cochrane</persName> on the part of <persName ref="prs:brew_c">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Brew</persName>, must the present case<fw type="catchword" style="text-align: right;">be</fw><pb facs="co_60_43/co_60_43_00489v.jpg"/> be attributed, and
if he were still alive he would be responsible, and liable to
refund the deficiency.
</p>
<p>
5. I had feared that the amount embezzled would be totally lost
to the Colony; but on enquiry I have ascertained that <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Cochrane</persName> on leaving <placeName ref="plc:victoria">Victoria</placeName> for England had obtained Bills from
the Bank of<fw type="catchword" style="text-align: right;">British</fw><pb facs="co_60_43/co_60_43_00490r.jpg"/> British North America on their Office in London for
about Three thousand, two hundred pounds Sterling, reported to
have been acquired in mining speculations, which have not been
presented for payment, and are supposed to have been lost with
<persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cochrane</persName> in the "<name ref="vsl:city_of_boston" type="vessel">City of Boston</name>." I have caused the Manager<fw type="catchword" style="text-align: right;">of</fw><pb facs="co_60_43/co_60_43_00490v.jpg"/>
of the Branch here to be notified that this Government has a
claim against that sum of about Six thousand Dollars.
</p>
<p>
6. I am informed that <persName ref="prs:mellors_rwb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Robert Mellors</persName>, of Brittania
Chambers, Pelham Street, <placeName ref="plc:nottingham">Nottingham</placeName>, holds a Power of Attorney
from <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cochrane</persName>, and that <persName ref="prs:mellors_rwb">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Mellors</persName> has written to the<fw type="catchword" style="text-align: right;">Bank</fw><pb facs="co_60_43/co_60_43_00491r.jpg"/> Bank
of British North America in <placeName ref="plc:london">London</placeName>, stating that he holds this
power, and, understanding that a large sum of money is at <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Cochrane</persName>'s credit at their Bank, and as <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cochrane</persName> was lost in
the "<name ref="vsl:city_of_boston" type="vessel">City of Boston</name>," that he intends to apply for Letters of
Administration on behalf of the nearest of kin.
</p>
<p>
7. Under these circumstances the object of my present Despatch
to<fw type="catchword" style="text-align: right;">Your</fw><pb facs="co_60_43/co_60_43_00491v.jpg"/> Your Lordship is to request that steps may be taken through
the <orgName ref="org:ocac">Crown Agents</orgName>, or otherwise as seems most desirable, for the
purpose of attaching the money in the hands of the Bank, or of
the Administrator, and so recovering the sum of $5745, or
£1184.10/9 due to this Government from <persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi><fw type="catchword" style="text-align: right;">Cochrane</fw><pb facs="co_60_43/co_60_43_00492r.jpg"/> Cochrane</persName>. It is
possible that even preliminary proceedings may have the effect
of at once procuring a return of the amount, but if necessary
any further particulars required can be furnished for the
prosecution of the claim.

<persName ref="prs:cochrane_wm">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cochrane</persName> who was Clerk &amp; Recorder of Mining claims is

England. A large defalcation has been discovered in his
Accounts, &amp; also that he has a considerable sum in the Bank of
B.N. America, &amp; <persName ref="prs:musgrave_a"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Musgrave</persName> asks that steps may be taken to
attach the sum in order that the Crown may recover what is due.

into the hands of the Solicitor to <orgName ref="org:treasury">the Treasury</orgName> in preference to
the <orgName ref="org:ocac">Crown Agents</orgName>.
