I have had the honor to receive Your Lordship's Despatch N<hi style="vertical-align: super; font-size: 80%;">o</hi> 61,
of the <date when="1871-06-17">17<hi style="vertical-align: super; font-size: 80%;">th</hi> June</date>, enclosing correspondence with <persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> G.E. Nias</persName>,
on the subject of the land in dispute between him and the
government of <placeName ref="plc:british_columbia">British Columbia</placeName>.<fw type="catchword" style="text-align: right;">A Lease</fw><pb facs="co_60_44/co_60_44_00168v.jpg"/> A Lease for a nominal Rent has
in accordance with Your Lordship's suggestion been offered to
<persName ref="prs:nias">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Nias</persName> who is in occupation of the land, and is acting under
legal advice, for her husband, but she is indisposed to accept
that arrangement.
</p>
<p>
2. The case of <persName ref="prs:trimble">D<hi style="vertical-align: super; font-size: 80%;">r</hi> Trimble</persName> is now under adjudication and will
probably be determined in a very short time, when the question
of <persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName>' title will also be decided. If the<fw type="catchword" style="text-align: right;">decision</fw><pb facs="co_60_44/co_60_44_00169r.jpg"/> decision, as
there can be little doubt, should be in favor of the government
it will then be more easy to effect some arrangement by which
<persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName> may be able to exhaust the value of the improvements
made upon the land.
</p>
<p>
3. I enclose a Copy of the Information filed in the Supreme
Court in the case of <persName ref="prs:trimble">D<hi style="vertical-align: super; font-size: 80%;">r</hi> Trimble</persName> which contains a clear
statement of the matter at issue, and may be useful if any
further reference is made to Your Lordship on the subject.

<persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName> &amp; the <placeName ref="plc:british_columbia">B. Columbia</placeName> <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> should be granted to him at a
nominal rent has been proposed to <persName ref="prs:nias">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Nias</persName> but she is
indisposed to accept the arrange<hi style="vertical-align: super; font-size: 80%;">t</hi>. <persName ref="prs:nias">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Nias</persName> is no doubt in
communication with her husband so it seems unnecessary to send a
copy of this despatch to <persName ref="prs:nias_ge">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Nias</persName>.
