<p>The subject of coal rights on <placeName ref="plc:vancouver_island">Vancouver Island</placeName> is raised in a letter by one <persName ref="prs:cunard_s">Mr. Cunard</persName>, which <persName ref="prs:ward_hg">Ward</persName> forwards to <persName ref="prs:hawes_b">Hawes</persName> in hopes of reaching <persName ref="prs:grey_hg">Lord Grey</persName>'s eyes.</p>
<p>In the minutes, <persName ref="prs:blackwood_aj">Blackwood</persName> reiterates the <orgName ref="org:hbc">HBC</orgName>'s land-claim proposal, and arguments, following the 1846 Oregon Treaty.</p>
<p><persName ref="prs:hawes_b">Hawes</persName> expresses urgency on the matter, provided that the coal proves to be <q>good.</q> <persName ref="prs:grey_hg">Lord Grey</persName> calls for <persName ref="prs:hawes_b">Hawes</persName> to communicate privately with <persName ref="prs:pelly_jh">Pelly</persName> in order that <persName ref="prs:pelly_jh">the latter</persName> provide a detailed colonization proposal, especially in light of the coal discovery.</p>

<p>Observing in the public papers that Coal is to be had at <placeName ref="plc:vancouver_island">Vancouvers Island</placeName> I hope I may not be considered as intruding by bringing the
subject under the notice of the <orgName ref="org:admiralty">Lords of the Admiralty</orgName>. Individuals in
the <placeName ref="plc:oregon_territory">Oregon territory</placeName> will be alive to the advantages resulting from the
possession of this valuable article and will endeavour to obtain the
best situations or acquire any right <name type="ip" subtype="group">the natives</name> may have or suppose
they may have.</p>

<p>It may therefore be well, in granting Lands on this Island to
reserve the mines for the use of the crown, and to take such measures as
may prevent <fw type="catchword" style="text-align: right;">the</fw> <pb facs="co_305_01/co_305_01_00144v.jpg"/><name type="ip" subtype="group">the natives</name>, or others, from acquiring or ceding, rights to
these mines</p>

<p>This subject will not long escape the vigilance of the Americans in
that neighbourhood</p>

My note on 259. North America. was written without having the necessary
documents before me, but having since referred to them, I find that the
statement, I have already made is correct.</ab>

<p>The question relative to the occupation of <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> stands at present in this posture.</p>

<p>The dispute with America concerning the <placeName ref="plc:oregon_territory">Columbia Territory</placeName> being settled, <persName ref="prs:pelly_jh">Sir John Pelly</persName>, as the organ of the Hudson's <fw type="catchword" style="text-align: right;">Bay.</fw> <pb facs="co_305_01/co_305_01_00145v.jpg"/>Bay
Company enquired, on the <date when="1846-09-07">7<hi style="vertical-align: super; font-size: 80%;">th</hi> of September 1846</date>,
the intentions of the Government as to the acquisition of Lands or
formation of Settlements on the North side of the British Boundary Line.
He stated that the <orgName ref="org:hbc">Hudson's Bay Company</orgName> had formed an establishment on
the Southern part of <placeName ref="plc:vancouver_island">VanCouver's Island</placeName>, which they were annually
enlarging, and that therefore he was anxious to know whether they would
be confirmed in the possession of such Lands <fw type="catchword" style="text-align: right;">as</fw> <pb facs="co_305_01/co_305_01_00146r.jpg"/>as they might find it
expedient to add to those which they already possessed.</p>

<p>This enquiry gave rise to various minutes on the part of <persName ref="prs:stephen_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Stephen</persName> and <persName ref="prs:hawes_b">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Hawes</persName> on the subject both of the proprietary rights of
the Company, and of the policy of settling <placeName ref="plc:vancouver_island">VanCouver's Island</placeName>. I send
<add place="above">those minutes</add> for your perusal.</p>

<p>They are attached to 1074 North America. 1846.</p>

<p>The information <fw type="catchword" style="text-align: right;">seeming</fw> <pb facs="co_305_01/co_305_01_00146v.jpg"/>seeming however to be defective, <persName ref="prs:pelly_jh">Sir J. Pelly</persName> was
called upon to state what were the limits of the Territory the Company
sought to obtain, and whether he was legally advised, that they could
receive and hold in their Corporate Capacity any Lands in the Dominion's
of the British Crown westward of <placeName ref="plc:rocky_mountains">the Rocky Mountains</placeName>.</p>

<p>The answer returned by <persName ref="prs:pelly_jh">Sir John Pelly</persName> on the 24<hi style="vertical-align: super; font-size: 80%;">th</hi> of October
 1846, was that in his opinion the Company might legally <fw type="catchword" style="text-align: right;">hold</fw> <pb facs="co_305_01/co_305_01_00147r.jpg"/>hold any portion of the Territory to the West of <placeName ref="plc:rocky_mountains">the Rocky Mountains</placeName> which the Crown might choose to annex to <placeName ref="plc:ruperts_land">Rupert's Land</placeName>.</p>

<p>On the question of the limits he forwarded certain reports which
do not explain with adequate precision the extent of Country sought for.</p>

<p><persName ref="prs:grey_hg">Lord. Grey</persName> then replied, <del>that</del> (<date when="1846-12-14">14 Dec<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">r</hi> 1846</date>,)
that as he could not announce the decision of the Government. on the
question of colonizing the <placeName ref="plc:oregon_territory">Oregon Territory</placeName>, his Lordship wished to have a <fw type="catchword" style="text-align: right;">specific</fw> <pb facs="co_305_01/co_305_01_00147v.jpg"/>specific proposal from the Company — that he was prepared to assent on
behalf of <persName ref="prs:queen_victoria">the Queen</persName> to a grant to the <orgName ref="org:hbc">Hudson's Bay Company</orgName> of certain
Lands in <placeName ref="plc:vancouver_island">Van Couver's Island</placeName> or in other parts of the <placeName ref="plc:oregon_territory">Oregon Territory</placeName>
but that before the issue of such grant, he would require the production
by the Company of an opinion from the <orgName ref="org:law_officers">Law Officers</orgName> of the Crown, to the
effect that the acceptance by the Company of such grant would be
consistent with their Charter of Incorporation.<fw type="catchword" style="text-align: right;"> Other</fw></p>

<p><pb facs="co_305_01/co_305_01_00148r.jpg"/>Other stipulations were
also mentioned which though important in themselves, are not material to
the immediate question.</p>

<p>On the <date when="1847-01-22">22 January 1847</date>. <persName ref="prs:pelly_jh">Sir J. Pelly</persName> sent to this Office the case
proposed to the <orgName ref="org:law_officers">Law Officers</orgName> of the Crown, and their opinion was that<lb/> 
"If, as was stated, the Charter <choice><orig><lb/>"</orig><reg/></choice>of the Company contained <choice><orig><lb/>"</orig><reg/></choice>no limitation preventing <choice><orig><lb/>"</orig><reg/></choice>them from acquiring Land <choice><orig><lb/>"</orig><reg/></choice>beyond a particular district <choice><orig><lb/>"</orig><reg/></choice>they (the <orgName ref="org:law_officers">Law Officers</orgName> of <fw type="catchword" style="text-align: right;">the</fw> <pb facs="co_305_01/co_305_01_00148v.jpg"/>the Crown), considered that <choice><orig><lb/>"</orig><reg/></choice>the Company might receive <choice><orig><lb/>"</orig><reg/></choice>and hold in its corporate <choice><orig><lb/>"</orig><reg/></choice>capacity Lands in the<choice><orig><lb/>"</orig><reg/></choice>Queen's Dominions to the <choice><orig><lb/>"</orig><reg/></choice>west of
the <placeName ref="plc:rocky_mountains">Rocky Mountains</placeName>."</p>

<p>This opinion being regarded as satisfactory, <persName ref="prs:grey_hg">Lord Grey</persName> wrote (<date when="1847-02-02">2. Feb<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">y</hi> 1847</date>) to <persName ref="prs:pelly_jh">Sir J. Pelly</persName> to say that he was ready to receive, and consider the draft of such a grant as the Company would accept.</p>

<p>On the <date when="1847-03-05">5<hi style="vertical-align: super; font-size: 80%;">th</hi> of March 1847</date>, <persName ref="prs:pelly_jh">Sir J. Pelly</persName> sent his Scheme for the proposed<fw type="catchword" style="text-align: right;">grant</fw> <pb facs="co_305_01/co_305_01_00149r.jpg"/> grant which underwent criticism here, and <persName ref="prs:grey_hg">Lord Grey</persName> decided that the Company had made too
extensive a proposal. The last minute on the last paper in the North
American Department on this subject states. "I have seen <persName ref="prs:pelly_jh"><choice><orig>Sir J.<lb/>"Pelly</orig><reg>Sir J. Pelly</reg></choice></persName> who will communicate <choice><orig><lb/>"</orig><reg/></choice>with M<hi style="vertical-align: super; font-size: 80%;">r</hi> Hawes and <choice><orig><lb/>"</orig><reg/></choice>submit some less extensive<choice><orig><lb/></orig><reg/></choice><choice><orig> "</orig><reg/></choice> demand.<choice><orig>"</orig><reg/></choice><lb/> 
<persName ref="prs:grey_hg">G.</persName> <date when="1847-03-25">25/3/47</date>."</p> 

<p>This closes the correspondence<fw type="catchword" style="text-align: right;"> and</fw> <pb facs="co_305_01/co_305_01_00149v.jpg"/> and it seems to
rest <add place="above">now</add> with <persName ref="prs:pelly_jh">Sir J Pelly</persName> to revive the subject.</p>

<persName ref="prs:pelly_jh">Sir J. Pelly</persName> called yesterday. He desires that some proposition <choice><abbr>sh<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> 
be made by this office to the <orgName ref="org:hbc">H.B. Company</orgName>. The Company it appears
<choice><abbr>w<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> be willing, to colonise <placeName ref="plc:vancouver_island">this Island</placeName>, towards which there are many
parties directing their attention, &amp; there is already formed a Company
(the Pugets Sound Cy I think) which has capital &amp; which <choice><abbr>w<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> be willing to join with &amp; <choice><orig>co-<lb/>operate</orig><reg>cooperate</reg></choice> with the H.B.<choice><abbr>C<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>Company</expan></choice> in this undertaking.
