<p><persName ref="prs:merivale_h">Merivale</persName> comments to <persName ref="prs:hawes_b">Hawes</persName> on the legalities discussed in a draft grant of <placeName ref="plc:vancouver_island">Vancouver Island</placeName> to the <orgName ref="org:hbc">HBC</orgName>, which he encloses. <persName ref="prs:merivale_h">Merivale</persName> appears wary of the simplicity of the grant, and its departure from <q>the original grant of Charles II.</q></p>
<p>Largely, the minutes call for further details on matters such as colonization, coal and land rights, and their respective legal and administrative requirements. <persName ref="prs:grey_hg">Grey</persName> considers the <q>early colonization</q> of <placeName ref="plc:vancouver_island">Vancouver Island</placeName> <q>an object of some importance,</q> in order to prevent the lands in question <q>from falling into the hands of the Americans.</q> </p>
<p>This file encloses a draft grant of <q>Territory in North America</q> to the <orgName ref="org:hbc">HBC</orgName>, authored by <persName ref="prs:crowder">Crowder</persName> and <persName ref="prs:maynard">Maynard</persName>, on behalf of <persName ref="prs:queen_victoria">the Queen</persName>. It contains extensive revisions and notation from several authors, and is dense with detail on the <orgName ref="org:hbc">HBC</orgName>'s North American presence, territorial issues, Indigenous relations, and more.</p>

<p>This is the draft grant<note xml:id="V485HB05_1">See <persName ref="prs:crowder">Crowder</persName> and <persName ref="prs:maynard">Maynard</persName>'s non-transcribed enclosure below.</note> of <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> to the Hudson's
Bay Company. I have not suggested any alteration of importance,
except striking out the Grant of jurisdiction, which is done in
red-ink. Perhaps this is to be regretted, but on looking into the Statutes it
appeared to me that it <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> require an Act of Parliament to effect this
object. Without going into details, the Chief obstacle is the Act
1<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">st</hi> &amp; 2<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">nd</hi> Geo: IV c: 66, which establishes Courts of Judicature
&amp;c for North West America, and saves the rights of the Hudson's Bay
Company only in their Charter Territory. I pointed out this to <persName ref="prs:maynard">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Maynard</persName>, the Solicitor of the Company, and the result is the letter
"N<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">o</hi> 979 North America", which I forward<pb facs="co_305_01/co_305_01_00079v.jpg"/> herewith, in which he says,
that the authorities at Hudson's Bay House prefer relying on <choice><orig>Govern=<lb/>=ment</orig><reg>Government</reg></choice> to appoint some of their own people to the necessary offices.</p>

<p>The result will be that The <orgName ref="org:hbc">Hudson's Bay Company</orgName> will legally
possess</p>

<p>1. In <placeName ref="plc:ruperts_land">Rupert's Land</placeName>, i.e. the territory East of the <placeName ref="plc:rocky_mountains">Rocky
Mountains</placeName> — Proprietorship of Soil, Jurisdiction and Exclusive Trade,
under the original grant of Charles II as usually <choice><orig>under=<lb/>=stood</orig><reg>understood</reg></choice>.</p>

<p>2. In the North West territory, between the <placeName ref="plc:rocky_mountains">Rocky Mountains</placeName> and
the Pacific, — exclusive trade only, without land or jurisdiction : under
the License of <date when="1838">1838</date> : which will expire in <date when="1859">1859</date>.</p>

<p>3. In <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>, the Land under this grant, the exclusive trade <add place="above">under</add> the License of 1838, but no jurisdiction.</p>

<p>It is to be observed, that the Grant<pb facs="co_305_01/co_305_01_00080r.jpg"/> is simple and without any
conditions like the original grant of Charles II. This, therefore,
requires to be considered. If it is intended to impose either any terms
in respect of Colonizing, or any Royalty on Coal or other Mines, this, I
apprehend, must be done in the grant. But I do not suggest this: on
the first point I collected <persName ref="prs:grey_hg">Lord Grey</persName>'s opinions rather to be, that the
Company should be left unfettered: on the second, inasmuch as the
Company must apply to Government to have any Civil Government
established, it may be enough to wait until the necessity arises to
impose on them terms for maintaining it?</p>

Should this proceed pending the Enquiry referred to <name>Lord Elgin</name>?</ab>

<p>And considering that many parties are now turning their attention
to the Colonization of <placeName ref="plc:vancouver_island">Vancouvers Island</placeName> is it consistent with imperial<pb facs="co_305_01/co_305_01_00080v.jpg"/>
policy to grant the Cy exclusive rights of trading. The License of 1838
I imagine did not include <placeName ref="plc:vancouver_island">Vancouvers Island</placeName>?</p>

<p><placeName ref="plc:vancouver_island">The Island</placeName> contains Coal, &amp; a great deal of good Land. Are the whole proceeds of the Land Coal &amp;c to become exclusively the
Companys — with no equivalent conditions as improv<hi style="vertical-align: super; font-size: 80%;">ts</hi> — price of
Land — in the encourag<hi style="vertical-align: super; font-size: 80%;">t</hi> of Settlers? The interests of the <choice><abbr>C<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">y</hi></abbr><expan>Company</expan></choice> may be
adverse to the establishment of free settlements &amp; good municipal
<choice><abbr>Gov<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice>. — <placeName ref="plc:vancouver_island">This Island</placeName> seems peculiarly the place considering its
proximity to the U States to establish a Colony with a good Charter?
Would the Company cooperate?</p>

 grant. — <seg type="snippet" xml:id="V485HB05_snippet_1">The early colonizat<hi style="vertical-align: super; font-size: 80%;">n</hi> of <placeName ref="plc:vancouver_island">Vancouver's island</placeName> is an object of
some importance to prevent it from falling into the hands of the
Americans, but as Parl<hi style="vertical-align: super; font-size: 80%;">t</hi> certainly would not &amp; ought not to make a
grant for the expenses of such an undertak<hi style="vertical-align: super; font-size: 80%;">g</hi> it can only be attempted
by a company, nor is there the slightest probability but this c<hi style="vertical-align: super; font-size: 80%;">d</hi> be
formed for the purpose.</seg> <choice><orig>X<lb/>X</orig><reg/></choice> But though I am not indisposed to make the grant I am of opin<hi style="vertical-align: super; font-size: 80%;">n</hi> that it <choice><abbr>sh<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> contain a recital that its object
is to promote the colonizat<hi style="vertical-align: super; font-size: 80%;">n</hi> of <placeName ref="plc:vancouver_island">Vancouver's island</placeName>, &amp; that in <unclear><del>consequence</del></unclear>
considerat<hi style="vertical-align: super; font-size: 80%;">n</hi> of this grant the Co undertakes to form a settlement upon
it &amp; to defray the whole expense of any civil &amp; military establishments
which may consequently be required there. — There <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> also I think be
a condit<hi style="vertical-align: super; font-size: 80%;">n</hi> that the grant <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> become void unless settlements <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> 
be formed within a definite time. The proposed grant as I understand is
to give no new rights of exclusive trade. It <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> therefore be
convenient to avoid <del><unclear>[…]</unclear></del> any reference to their exert<hi style="vertical-align: super; font-size: 80%;">g</hi> rights of this
descript<hi style="vertical-align: super; font-size: 80%;">n</hi> wh. is not absolutely necessary. These rights are highly
unpopular — some of those claimed by the Company are I believe disputed,
hence any words introduced into the grant wh <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> imply a fresh
recognit<hi style="vertical-align: super; font-size: 80%;">n</hi> of such rights <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> be highly objectionable. — It <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice>
likewise be desirable to have some general explanat<hi style="vertical-align: super; font-size: 80%;">n</hi> from the Company
as to the manner in which they propose to avail themselves of the
property to be conferred upon them. — If they really wish to colonize I
<choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> wish to afford them all the encouragement &amp; assistance I can. —
Perhaps <persName ref="prs:merivale_h">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Merivale</persName> had better see either their Solicitor or <persName ref="prs:pelly_jh">Sir J. Pelly</persName>.
