<p><persName ref="prs:douglas_j">Douglas</persName> writes <persName ref="prs:pakington">Pakington</persName> on his intent to use a forthcoming steamship to pursue the murderers of <persName ref="prs:brown_p">Peter Brown</persName>, and requests <q>instructions and directions</q> on how to deal with American traders in the <placeName ref="plc:san_juan_islands">San Juan Islands</placeName>, and on the west coast of <placeName ref="plc:vancouver_island">Vancouver Island</placeName>.</p>
<p>The minutes mention that sovereignty of the <placeName ref="plc:san_juan_islands">San Juan Islands</placeName> remains unclear.</p>
<p>The enclosures contain a duplicate of <persName ref="prs:douglas_j">Douglas</persName>’ previous letter to <persName ref="prs:pakington">Pakington</persName>, <persName ref="prs:douglas_j">Douglas</persName>’ letter to <persName ref="prs:kuper">Kuper</persName> regarding the murder of <persName ref="prs:brown_p">Peter Brown</persName>, three draft forwards to <persName ref="prs:addington_hu">Addington</persName>, each addressing an issue raised in <persName ref="prs:douglas_j">Douglas</persName>’ letter, a draft reply from Newcastle to <persName ref="prs:douglas_j">Douglas</persName>, and a draft to the <orgName ref="org:hbc">HBC</orgName> regarding <persName ref="prs:douglas_j">Douglas</persName>’ report on illicit trade between Americans and <name type="ip" subtype="group">Indigenous peoples on the west coast of <placeName ref="plc:vancouver_island">Vancouver Island</placeName></name>.</p>

<p>
I have the honor of <choice><orig>trans=<lb/>=mitting</orig><reg>transmitting</reg></choice> herewith Duplicate of my Despatch
of the <date when="1852-11-11">11<hi style="text-decoration: underline; vertical-align: super; font-size: 80%;">th</hi> November</date>, with the accompanying Documents.
</p>

<p>
Our relations with <name type="ip" subtype="group">the Native Tribes</name> have undergone no material
change since that date, they have been uniformly quiet and friendly in
their intercourse with the settlement and appear to regret the unhappy
event which occurred last month. We have not <ref target="#marg1"/>yet taken any active
measures to secure the murderers of <persName ref="prs:brown_p">Brown</persName>, owing to the non arrival of
the <name ref="vsl:beaver" type="vessel">Hudson's Bay Companys Steam vessel</name>, which except Boats, is the only
means of transport at my disposal capable of conveying an adequate force
to the part of the coast, where the criminals are reported to have taken
refuge; and it would not be advisable, at this inclement season of the
year, to undertake an expedition, of so much importance, in open Boats,
which would neither represent <fw type="catchword" style="text-align: right;">the</fw><pb facs="co_305_03/co_305_03_00158v.jpg"/>the dignity of the Government nor afford
shelter and protection to the men, and might probably end in disaster
and defeat. I have therefore deferred the expedition until it can be
dispatched with all the means at our disposal.
</p>

<p>
A question has lately arisen here relative to the sovereignty of
<placeName ref="plc:san_juan_island">the Islands</placeName> in the <placeName ref="plc:haro_strait">Canal de Arro</placeName>, situated between <placeName ref="plc:vancouver_island">Vancouvers Island</placeName> and
the Continent, to which some American citizens have set up a claim in
the name of the United States.
</p>

<p><ref target="#marg2"/>
I propose to lay the question before you in my next despatch and in
the mean time <hi style="text-decoration: underline;">I shall assert the Sovereignty of Great Britain, to all
<placeName ref="plc:san_juan_islands">the Islands</placeName></hi> in the <placeName ref="plc:haro_strait">Arro Archipelago</placeName> situated to the eastward of
<placeName ref="plc:strawberry_bay">Strawberry Bay</placeName>, so named by <persName ref="prs:vancouver_g">Vancouver</persName>, which is the usual ship channel
into the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>.<ref target="#marg3"/><!--<ref target="#marg1"></ref> -->
</p>

<p>
I would also observe for the information of Her Majesty's
Government that several American Merchant vessels were engaged last
summer in trafficking with <name type="ip" subtype="group">the natives</name> and fishing on the west coast of
<placeName ref="plc:vancouver_island">Vancouver's Island</placeName>, the produce of those voyages being carried into the
Ports of California. That traffic is not hurtful to any existing
British interest as there are no settlements on that coast, but as it
may soon become<pb facs="co_305_03/co_305_03_00159r.jpg"/> a lucrative branch of British Trade and as it cannot be
carried on by American citizens without a manifest violation of British
Territory, I think it would be advisable to place a check upon such
proceedings, before they acquire, from custom, the force of national
rights.
</p>

<p>
If such should be Her Majesty's pleasure I beg to receive such
instructions and directions on the subject as may be requisite
for our guidance.
</p>

Americans to the <placeName ref="plc:san_juan_islands">Isl<hi style="vertical-align: super; font-size: 80%;">ds</hi></placeName> in the <placeName ref="plc:haro_strait">Canal De Arro</placeName>: &amp; to his request for
instructions as to <del>the</del> stopping the trade the Americans are carrying on with

<p>
On referring to the Treaty I fear it is doubtful to whom the

Blackwood</persName> correctly surmises, been raised before. <persName ref="prs:lawrence">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Lawrence</persName> when
<choice><abbr>Am<hi style="vertical-align: super; font-size: 80%;">n</hi></abbr><expan>American</expan></choice> minister here paid some attention to it. but I am not
certain that it was ever officially investigated.

<p>
As to the other points: is it unlawful for Americans to trade with
<name type="ip" subtype="group">Indians on an unoccupied portion of the coast of British N. America</name>. I
suppose it is, but am not sufficiently familiar with the principles of
international law applicable to the question.
</p>
