<p><persName ref="prs:pelly_jh">Pelly</persName> responds to a request by the <orgName ref="org:colonial_office">Colonial Office</orgName> to explain the extent of the land claimed by <orgName ref="org:hbc">HBC</orgName> following the establishment of the colony on <placeName ref="plc:vancouver_island">Vancouver Island</placeName>. <persName ref="prs:pelly_jh">Pelly</persName> adds that it is <persName ref="prs:grey_hg">Grey</persName>’s responsibility to instruct <persName ref="prs:douglas_j">Douglas</persName> on matters of import duties.</p>
<p>The minutes seek to clarify the usage of land claimed by the <orgName ref="org:hbc">HBC</orgName> on <placeName ref="plc:vancouver_island">Vancouver Island</placeName>. <persName ref="prs:grey_hg">Grey</persName> suggests that such claims should be <q>strictly confined to land actually occupied and made use of.</q></p>
<p>Of the two enclosures, the first is a request to <persName ref="prs:pelly_jh">Pelly</persName> for information on the <orgName ref="org:hbc">HBC</orgName>’s land claims on <placeName ref="plc:vancouver_island">Vancouver Island</placeName>, and the second is <persName ref="prs:grey_hg">Grey</persName>’s draft reply to <persName ref="prs:douglas_j">Douglas</persName>.</p>

I have had the honour of receiving <persName ref="prs:peel_f">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Peel</persName>s letter dated the
<date when="1852-02-02">2<hi style="vertical-align: super; font-size: 80%;">nd</hi> Instant</date>, in which it is stated that your Lordship would be glad
of some further explanation as to the distinction between the lands
which the <orgName ref="org:hbc">Hudson's Bay Company</orgName> possessed before the "Boundary Treaty"
and others, and also as to the meaning of the expression "lands which
the Fur Trade of the <orgName ref="org:hbc">Hudson's Bay Company</orgName> propose to take."
</p>

<p>
In compliance with Your Lordship's wishes I hasten to afford you
the required explanation.
</p>

<p>
During the period that elapsed between the original connection of
the <orgName ref="org:hbc">Hudson's Bay Company</orgName> with the Country west of the <placeName ref="plc:rocky_mountains">Rocky Mountains</placeName>
and the division of the Territory by the Boundary Treaty of <date when="1846-06">June 1846</date>,
while <fw type="catchword" style="text-align: right;">in</fw><pb facs="co_305_03/co_305_03_00437v.jpg"/>in fact the sovereignty was in abeyance, the Company reclaimed
from the Wilderness and occupied portions of land wherever their trading
Establishments were planted. These lands they claim as theirs without
purchase and the possessory rights thus acquired in that portion of the
Territory which is situated to the south of the 49<hi style="vertical-align: super; font-size: 80%;">th</hi> parallel of
North Latitude have been guaranteed to them by the Boundary Treaty.
Among the lands occupied by the Company North of the 49<hi style="vertical-align: super; font-size: 80%;">th</hi> parallel is
that situated at <placeName ref="plc:victoria">Fort Victoria</placeName> in <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> where they formed
an Establishment in the year 1843 and this is the land alluded to in the
4<hi style="vertical-align: super; font-size: 80%;">th</hi> Paragraph of my letter of the <date when="1852-12-14">14<hi style="vertical-align: super; font-size: 80%;">th</hi> December</date>. Its exact extent
has not yet been ascertained by the Company's Surveyor, but whatever
that may be the Company consider they have a right to hold that land
without paying for it, while for any additional quantity that may be
required to be taken by the "Fur Trade" (which is merely a subordinate
branch of the <orgName ref="org:hbc">Hudson's Bay Company</orgName>) the same price will <fw type="catchword" style="text-align: right;">be</fw><pb facs="co_305_03/co_305_03_00438r.jpg"/>be paid as is
paid by other purchasers of land.
</p>

<p>
With regard to the levying of Import Duties, of the legality of
which Your Lordship still entertains doubts I need only say that it
rests entirely with Your Lordship to instruct the Governor of <placeName ref="plc:vancouver_island">the Island</placeName>
as to the extent and mode in which he is to exercise the powers
conferred upon him.

This is the explanation of a passage in <persName ref="prs:pelly_jh">Sir J. Pelly</persName>'s letter asked for
by <persName ref="prs:grey_hg">Lord Grey</persName>. Of course it could not be intended that land actually
occupied by the <orgName ref="org:hbc">HBC</orgName> in <placeName ref="plc:vancouver_island">Vanc. I<hi style="vertical-align: super; font-size: 80%;">d</hi></placeName> at the date of their agreement with
Government should be charged for &amp; paid for like other land. The only
question that can arise will be as to the amount of such land.

me with any informat<hi style="vertical-align: super; font-size: 80%;">n</hi> in his power on the subject.
