<p><persName ref="prs:douglas_j">Douglas</persName> writes to <persName ref="prs:newcastle">Newcastle</persName> to offer a remarkably cogent and detailed argument that the boundary line between British and US territories should run through the <placeName ref="plc:rosario_strait">Rosario Strait</placeName>, what <persName ref="prs:douglas_j">Douglas</persName> refers to as <q><placeName ref="plc:rosario_strait">Vancouver Straits</placeName>.</q> Thus, according to <persName ref="prs:douglas_j">Douglas</persName>’s interpretation, the <q><placeName ref="plc:san_juan_islands">Arro Islands</placeName></q> remain <q>a de facto dependency of <placeName ref="plc:vancouver_island">Vancouvers Island</placeName>.</q> <persName ref="prs:douglas_j">Douglas</persName> notes the inclusion of several maps, though only one map appears to be included in the file.</p>
<p>The minutes discuss the question of the boundary between US and British territory and, in particular, note the interpretation of a key clause in the Oregon Treaty of 1846: <q>to the middle of the channel which separates the continent from <placeName ref="plc:vancouver_island">Vancouver Island</placeName>.</q></p>
<p>Of the two documents included in the file, the first is a draft letter, from the <orgName ref="org:colonial_office">Colonial Office</orgName> to <persName ref="prs:addington_hu">Addington</persName>, of the <orgName ref="org:foreign_office">Foreign Office</orgName>, that forwards a copy of <persName ref="prs:douglas_j">Douglas</persName>’s despatch; the second is a traced map that marks the boundary line through the middle of the <placeName ref="plc:rosario_strait">Rosario Strait</placeName>.</p>

<p>
In a Despatch to Secretary <persName ref="prs:pakington">Sir John S Packington [Pakington]</persName> dated
the <date when="1853-12-09">9<hi style="vertical-align: super; font-size: 80%;">th</hi> December last</date>, I had the honor of submitting for the
information of Her Majesty's Government that certain American citizens,
had set up a claim to the <placeName ref="plc:san_juan_islands">Islands on the Canal de Arro</placeName>, on behalf of the
United States, and that it was my intention to assert the sovereignty of
Her Majesty <persName ref="prs:queen_victoria">the Queen</persName> to all <placeName ref="plc:san_juan_islands">the Islands of the Arro Archipelago</placeName>, lying
to the westward of <placeName ref="plc:strawberry_bay">Strawberry Bay</placeName> (<placeName ref="plc:cypress">Cypress Island</placeName>), as named by
"<persName ref="prs:vancouver_g">Vancouver</persName>," situated in "<placeName ref="plc:rosario_strait">Vancouver Strait</placeName>," the usual ship channel from
the <placeName ref="plc:juan_de_fuca_strait">Straits of Juan de Fuca</placeName><fw type="catchword" style="text-align: right;">into</fw><pb facs="co_305_04/co_305_04_00097v.jpg"/> 
into the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>, which has always
been considered the boundary between the possessions of Great Britain,
and the Territories of the United States.
</p>
<p>
2. Having received no reply to that, or any of my subsequent
communications to Her Majesty's Government, in consequence I suppose of
the non arrival of the ship "<name ref="vsl:colinda" type="vessel">Colinda</name>," bound to this port, by which the
Secretary of the <orgName ref="org:hbc">Hudson's Bay Company</orgName>, in a letter transmitted by the
way of <placeName ref="plc:panama">Panama</placeName> informs me that five packets from the Colonial office had
been forwarded.

<p>
I nevertheless beg to apprize your Grace that I have acted in
accordance with the views above expressed; and have succeeded in
defeating every attempt made to pre-occupy the <placeName ref="plc:gulf_islands">Arro Islands</placeName>, through the
agency of American squatters, so that those Islands still remain a de
facto dependency of <placeName ref="plc:vancouver_island">Vancouvers Island</placeName>, unoccupied by any settlement of
whites, except a fishing station, which was established some years ago
by the <orgName ref="org:hbc">Hudson's Bay Company</orgName>, on the <placeName ref="plc:san_juan_island">Island of San Juan</placeName>.
</p>

3. If I may take the liberty of referring your Grace to
<persName ref="prs:arrowsmith">Arrowsmith</persName>s improved map of <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>, you will observe that
the three principal Islands of the <placeName ref="plc:san_juan_islands">Arro Archipelago</placeName>, "<placeName ref="plc:san_juan_island">San Juan</placeName>,"
"<placeName ref="plc:lopez_island">Lopez</placeName>," and "<placeName ref="plc:orcas_island">Orcas</placeName>," are of considerable extent, and I may add from my
own knowledge that they are exceedingly valuable, not only on account of
their relative position to <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>, but also from the fact
that their shores and Inlets, abound with Salmon and other fish, which
form a productive export, and inexhaustible source of wealth.
</p>
<p>
They contain a great extent of arable land, are capable of
supporting a large population, and form an appendage of incalculable
importance to this Colony.
</p>
<p>
4. In reference to their geological structure the most southerly
<placeName ref="plc:san_juan_islands">Islands of the Archipelago</placeName>, are chiefly composed of Trap or Greenstone
but sandstone and other strata, similar in character to those found in
the Coal District of <placeName ref="plc:nanaimo">Nanaimo</placeName>, mark the more northerly Islands as
belonging<fw type="catchword" style="text-align: right;">to</fw><pb facs="co_305_04/co_305_04_00098v.jpg"/> 
to the same geological series.
</p>
<p>
Some fine specimens of serpentine and auriferous quartz have also
been found there.
</p>
<p>
5. According to the intention expressed in my said Despatch to <persName ref="prs:pakington">Sir
John S Packington</persName> of the <date when="1853-12-09">9<hi style="vertical-align: super; font-size: 80%;">th</hi> December last</date>, I shall proceed to lay
before your Grace the grounds which led me to assume without positive
instructions on that head, that the <placeName ref="plc:san_juan_islands">Islands of the Archipelago de Arro</placeName>,
did of right belong to Her Majesty <persName ref="prs:queen_victoria">the Queen</persName>.
</p>
<p>
I was led to take that view of the question by a fair construction
of the Oregon Treaty which defines the territorial limits of the
contracting Powers on this coast; the common opinion of the day; and the
maps published in both countries exhibiting the boundary line in the
middle of "<placeName ref="plc:rosario_strait">Vancouver Strait</placeName>," the only direct channel which connects the
<placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName> with the <placeName ref="plc:juan_de_fuca_strait">Straits of Juan De Fuca</placeName>.
</p>
<p>
6. The first article of that Treaty, declares that the line<fw type="catchword" style="text-align: right;">of</fw><pb facs="co_305_04/co_305_04_00099r.jpg"/> 
of boundary
<milestone unit="section" rend=".ind on"/>
shall be continued westward along the said forty ninth parallel of north
latitude to the middle of the Channel, which separates the continent
from <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> and thence <hi style="text-decoration: underline;">southerly</hi> through the middle of
said channel, and <placeName ref="plc:juan_de_fuca_strait">Fuca Straits</placeName> to the Pacific Ocean, provided however,
that the navigation of the <hi style="text-decoration: underline;">whole</hi> of the said channel and <hi style="text-decoration: underline;">Straits</hi>, south of the forty ninth parallel of latitude remain free and
open to both parties.

<p>
The letter of the Treaty clearly implies the existence of a
<hi style="text-decoration: underline;">navigable channel</hi>, extending from the point in the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>,
where the westerly line ceases, to the <placeName ref="plc:juan_de_fuca_strait">Straits of Juan De Fuca</placeName>, and also
declares that the said channel runs in a southerly direction.
</p>
<p>
8. On that head I wish to observe that "<persName ref="prs:vancouver_g">Vancouver</persName>'s" Chart, to
which I beg to refer your Grace, shews that no navigable channel,
leading from the <placeName ref="plc:juan_de_fuca_strait">Straits of Juan De fuca</placeName>, into the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>, was
known to exist when the Treaty was made, neither had any channel, which
can be safely navigated by sailing ships, been<fw type="catchword" style="text-align: right;">discovered</fw><pb facs="co_305_04/co_305_04_00099v.jpg"/> 
discovered, even to this
day, except "<placeName ref="plc:rosario_strait">Vancouver Straits</placeName>," which up to this hour, is the route
invariably taken by sailing ships, bound to and from the <placeName ref="plc:strait_of_georgia">Gulf of
Georgia</placeName>.
</p>
<p>
9. The Treaty also declares that the boundary line shall run,
"thence," (i.e. from the middle of the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>),"
<hi style="text-decoration: underline;">southerly</hi>, through the said channel." The chart will here again
shew that none of the passages, in the <placeName ref="plc:san_juan_islands">Arro Archipelago</placeName>, run continuously
in a southerly direction, and that no other outlet, from the <placeName ref="plc:strait_of_georgia">Gulf of
Georgia</placeName>, answers the description given of the channel, through which the
boundary line, was to be carried, except "<placeName ref="plc:rosario_strait">Vancouver Strait</placeName>."
</p>
<p>
10. The Treaty moreover provides,
<milestone unit="section" rend=".ind on"/>
that the navigation of the whole of the said channel and <placeName ref="plc:juan_de_fuca_strait"><hi style="text-decoration: underline;">straits</hi>
(of De Fuca)</placeName>, south of the forty ninth parallel of latitude remain free
and open to both parties.

</p>
<p>
I would observe in respect to that article that there could be no
object for leaving the navigation, of the "whole" of the <placeName ref="plc:juan_de_fuca_strait">Straits of Juan
De Fuca</placeName>, as far east as<fw type="catchword" style="text-align: right;">Whitby</fw><pb facs="co_305_04/co_305_04_00100r.jpg"/> 
<placeName ref="plc:whidbey_island">Whitby Island</placeName> and <placeName ref="plc:deception_pass">Deception passage</placeName>, free and
open to British Vessels, unless it was intended, that "<placeName ref="plc:rosario_strait">Vancouver
Strait</placeName>," should be the boundary Channel, and I cannot suppose that any
other consideration would have induced the American Plenipotentiary, so
tenacious on all other points affecting the interests of his country, to
make in that instance an important concession in favour of British
commerce, a concession affecting the navigation laws of the United
States; by throwing open a large extent of the American coast to British
Vessels; without any real or apparent necessity, arising from the nature
of the navigation, and without securing thereby, any reciprocal
advantage for his own country.
</p>
<p>
11. In respect to the evidence derivable from public opinion, we
who have lived almost on the spot, have ever believed that<fw type="catchword" style="text-align: right;">Vancouvers</fw><pb facs="co_305_04/co_305_04_00100v.jpg"/> 
<placeName ref="plc:rosario_strait">Vancouvers Strait</placeName>, is the sure line of boundary, between the two countries, and as
a proof that we are not alone in that opinion, I herewith transmit a Map
of the <placeName ref="plc:san_juan_islands">Arro Archipelago</placeName>, being a section faithfully copied from a
<milestone unit="section" rend=".ind on"/>
Map of Oregon and Upper California, from the surveys of <persName ref="prs:fremont">John
Charles Fremont</persName>, and other authorities, drawn by <persName ref="prs:preuss">Charles Preuss</persName>,
<hi style="text-decoration: underline;">under</hi> the <hi style="text-decoration: underline;">order</hi> of the <hi style="text-decoration: underline;">Senate</hi> of the <hi style="text-decoration: underline;">United States</hi>
Washington City 1848
<milestone unit="section" rend=".ind off"/>
on which the boundary line is carefully traced, exactly as your Grace
will observe on the section, through the middle of "<placeName ref="plc:rosario_strait">Vancouver Strait</placeName>"
into the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>. The original map is now in my possession and
may be consulted if necessary.
</p>
<p>
12. "<placeName ref="plc:rosario_strait">Vancouver Strait</placeName>" is thus shewn to be the only channel,
answering to the description given of the boundary channel, in the
Treaty—being a navigable channel—running southerly—and from its
position requiring for the safety and convenience of the vessels
frequenting it, the free navigation of the whole of the<fw type="catchword" style="text-align: right;">Straits</fw><pb facs="co_305_04/co_305_04_00101r.jpg"/> 
<placeName ref="plc:juan_de_fuca_strait">Straits of Juan De Fuca</placeName>, and the description is applicable to no other channel in that
quarter.
</p>
<p>
The Map published at Washington City in <date when="1848">1848</date>, under the orders of
the Senate also shews that "<placeName ref="plc:rosario_strait">Vancouver Strait</placeName>," was supposed to be the
boundary channel, by the highest authority in the United States.
</p>
<p>
13. The question of right appearing thus clearly in favour of the
claims of Great Britain, I conceived it my positive duty to assert them,
and I was also influenced in coming to that decision, by another
pressing consideration that "<placeName ref="plc:rosario_strait">Vancouver Strait</placeName>," is the present navigable
outlet from the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>, and without it, that noble inland sea,
bounded on every side by the Territories of Great Britain, would be in a
measure, sealed to British commerce.
</p>
<p>
14. I also have the honor of transmitting herewith a section
embracing the Territory herein described, of "<persName ref="prs:vancouver_g">Vancouver</persName>s chart," of the
north west coast of America, shewing the route<fw type="catchword" style="text-align: right;">taken</fw><pb facs="co_305_04/co_305_04_00101v.jpg"/> 
taken by the vessels
under his command, into the <placeName ref="plc:strait_of_georgia">Gulf of Georgia</placeName>, which will further
illustrate the hints I have herein taken the liberty of submitting for
your Grace's consideration.

much disposed to acquiesce in the view here defended by the Governor,
