<p><persName ref="prs:addington_hu">Addington</persName>, on behalf of <persName ref="prs:clarendon">Clarendon</persName>, writes to <persName ref="prs:merivale_h">Merivale</persName> on matters to do with the British/United States boundary, and, among other points, on the sovereignty of <placeName ref="plc:san_juan_islands">the Islands in the Canal de Arro</placeName> and an <q>alleged violation of British Territory on the West Coast of <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>.</q> To close, <persName ref="prs:addington_hu">Addington</persName> conveys <persName ref="prs:clarendon">Clarendon</persName>’s opinion that British territory was, indeed, violated, and that <persName ref="prs:douglas_j">Douglas</persName> should follow <persName ref="prs:newcastle">Newcastle</persName>’s advice on how best to maintain <q>British Rights in such Territory from Foreign Aggression.</q></p>
<p>The minutes discuss issues of boundary and sovereignty, with emphasis on the <q><placeName ref="plc:san_juan_islands">Arro Islands</placeName>,</q> the ownership of which, <persName ref="prs:merivale_h">Merivale</persName> asserts, <q>can only be settled by a fresh convention or by arbitration;</q> moreover, he wonders if American trade with Aboriginal groups on the west coast of <placeName ref="plc:vancouver_island">Vancouver Island</placeName> constitutes a violation of British territory. Finally, <persName ref="prs:newcastle">Newcastle</persName> asks that <persName ref="prs:clarendon">Clarendon</persName> be kept apprised of the matter, and that he consider carefully the issue of territorial violations.</p>

I have laid before the <persName ref="prs:clarendon">Earl of Clarendon</persName> your Letter of the <date when="1853-04-11">11<hi style="vertical-align: super; font-size: 80%;">th</hi>
of April last</date>, forwarding Extracts of a Despatch from the Governor of
<placeName ref="plc:vancouver_island">Vancouver's Island</placeName> respecting a Claim made by American Citizens on
behalf of the United States to the Sovereignty of the <placeName ref="plc:san_juan_islands">Islands in the
Canal de Arro</placeName>; and relating to an alleged violation of British Territory
on the West Coast of <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>.
</p>
<p>
With regard to the <placeName ref="plc:san_juan_islands">Islands in the Canal de Arro</placeName>, I am directed by
<persName ref="prs:clarendon">Lord Clarendon</persName> to refer you to my Letter of the <date when="1848-02-10">10<hi style="vertical-align: super; font-size: 80%;">th</hi> of February
1848</date>, transmitting a Copy of a Despatch from Her Majesty's Minister at<fw type="catchword" style="text-align: right;">Washington</fw><pb facs="co_305_04/co_305_04_00177v.jpg"/>
Washington, reporting a conversation with <persName ref="prs:buchanan">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Buchanan</persName>, then Secretary
of State of the United States, upon the expediency of defining the
Boundary between the British and American Territories in the <placeName ref="plc:strait_of_georgia">Gulf of
Georgia</placeName> and <placeName ref="plc:juan_de_fuca_strait">Fuca's Straits</placeName>, and also to my Letter of the <date when="1849-11-21">21<hi style="vertical-align: super; font-size: 80%;">t</hi> of
November 1849</date>, stating that the Government of the United States proposed
to lay before Congress at its next Session the proposal of Her Majesty's
Government to appoint a Commission to mark the Boundary in Question; and
I am to add that no further Report has been received from <persName ref="prs:crampton_jft">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Crampton</persName>
on this subject.
</p>
<p>
It appears to <persName ref="prs:clarendon">Lord Clarendon</persName> that if the matter be of importance
and that the affair requires accordingly to be settled, <persName ref="prs:crampton_jft">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Crampton</persName>
should be instructed again to call the attention of the American
Government to it; but if not, I am to suggest, for the consideration of
the <persName ref="prs:newcastle">Duke of Newcastle</persName>, that it might be well not to add another Question
to the many now pending and not likely soon to be arranged.

<p>
With respect to the violation of Territory which is undoubtedly
British, and to which there is no disputed claim to Sovereignty, <persName ref="prs:clarendon">Lord
Clarendon</persName> is of opinion that the Governor of <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> should
take such steps <fw type="catchword" style="text-align: right;">as</fw><pb facs="co_305_04/co_305_04_00178v.jpg"/>
as the <persName ref="prs:newcastle">Duke of Newcastle</persName> may think proper for asserting
and maintaining British Rights in such Territory from Foreign
Aggression.

As the Governor's promised second <choice><abbr>desp<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>despatch</expan></choice> (see 3851) respecting the
Sovereignty of the <placeName ref="plc:san_juan_islands">Arro Islands</placeName> has not arrived we can hardly say
whether the question is at present of such importance as to demand being
pressed on the attention of the American <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice>. But judging from
what we now have before us I should conceive that the matter might be
postponed, according to the wish of <persName ref="prs:clarendon">Lord Clarendon</persName>, without any serious
inconvenience arising.

<p>
On the 2<hi style="vertical-align: super; font-size: 80%;">nd</hi> point, the violation of B. Territory, I presume the
Governor should be instructed to show a decided front against foreign
aggression.

1. I remember that on looking with M<hi style="vertical-align: super; font-size: 80%;">r</hi> Laurence at the maps I felt
satisfied that this question of boundary, whenever it becomes important,
can only be settled by a fresh convention or by arbitration. The point
is by no means clear. But wait for the Governor's next despatch?
</ab>
<p>
2. The For. Office has not answered our second question—perhaps
we did not put it clearly. What we wanted to know is, whether for
Americans to trade with <name type="ip" subtype="group">Indians</name> on the W. coast of <placeName ref="plc:vancouver_island">Vanc. I.</placeName> is to be
regarded as a "violation" of our territory—on which point I think
instructions to the Governor should be explicit. The fishing within 3
miles is, I conclude, admittedly contrary to the existing relations
between the countries.
