<p><persName ref="prs:molesworth">Molesworth</persName> writes to <persName ref="prs:douglas_j">Douglas</persName> on the subject of <persName ref="prs:swanston">Swanston</persName>'s <q>Collector of Customs</q> conflict at <q><placeName ref="plc:victoria">Port Victoria</placeName>.</q> <persName ref="prs:molesworth">Molesworth</persName> forwards a report, from the <q>Commissioners of Customs,</q> that justifies the Collector's actions to bar the <name ref="vsl:william_allen" type="vessel">William Allen</name> from <placeName ref="plc:vancouver_island">the Island</placeName>'s other ports, and requests that all future <q>Memorials</q> addressed to the Secretary of State be forwarded to the <orgName ref="org:colonial_office">Colonial Office</orgName>.</p>
<p>The six documents included in the file comprise <persName ref="prs:swanston">Swanston</persName>'s complaints against the Collector of Customs at <placeName ref="plc:victoria">Victoria</placeName>.</p>

I have received your Despatch of the <date when="1855-03-06">6<hi style="vertical-align: super; font-size: 80%;">th</hi> last March</date>, N<hi style="vertical-align: super; font-size: 80%;">o</hi> 2,
reporting upon the complaint of <persName ref="prs:swanston">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Robert Swanston</persName> as to the conduct
of the Collector of Customs at <placeName ref="plc:victoria">Port Victoria</placeName> in refusing to grant a
permit for his Vessel the<fw type="catchword" style="text-align: right;">William</fw><pb facs="rg7_g8c_01/rg7_g8c_01_00154v.jpg"/> "<name ref="vsl:william_allen" type="vessel">William Allen</name>" to proceed to other Harbors of
<placeName ref="plc:vancouver_island">Vancouver's Island</placeName>. It having been deemed expedient to refer the
correspondence on this subject to the Commissioners of Customs for their
observations, I have now to transmit to you a copy of the report they
have addressed to the Board of Treasury with respect to it, and I am
glad to learn thereupon that they are of opinion that the proceedings of
the Collector appear to have been justified, and that <persName ref="prs:swanston">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Swanston</persName>'s<fw type="catchword" style="text-align: right;">complaint</fw><pb facs="rg7_g8c_01/rg7_g8c_01_00155r.jpg"/>
complaint is fully and satisfactorily answered. In forwarding to you
this report of the Commissioners of Customs I have to instruct you to
direct the special attention of the Collector at <placeName ref="plc:victoria">Port Victoria</placeName> to the
advice they have offered as to the course he should pursue in future in
all disputes or applications for relief of a nature similar to the
present; and I would observe to yourself, that, although in this case
you have assigned reasonable<fw type="catchword" style="text-align: right;">ground</fw><pb facs="rg7_g8c_01/rg7_g8c_01_00155v.jpg"/> ground for omitting to forward <persName ref="prs:swanston">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Swanston</persName>'s complaint to this Department, the proper course for you to
pursue is always to send home Memorials or representations addressed to
the Secretary of State by any inhabitant of <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>. It will
of course be desirable that it be made known by public notice or
otherwise in the Colony, that the Secretary of State for the Colonies
will not entertain complaints in cases where<fw type="catchword" style="text-align: right;">the</fw><pb facs="rg7_g8c_01/rg7_g8c_01_00156r.jpg"/> the parties have not, in
the first instance, sought redress from the local Authorities.
