<p><persName ref="prs:hammond">Hammond</persName> writes to <persName ref="prs:merivale_h">Merivale</persName> transmitting a copy of a despatch from <persName ref="prs:clarendon">Clarendon</persName> and suggests that the Americans should add the counter propositions regarding possession of coastal countries to the provisions of the Reciprocity Treaty.</p>
 
<p>The minutes discuss whether the <placeName ref="plc:falkland">Falklands</placeName> should also be incorporated into the reciprocity treaty.</p> 
 
<p>Enclosed is a draft reply from <persName ref="prs:ball">Ball</persName> to <persName ref="prs:shepherd_j">Shepherd</persName> that forwards the enclosed document and asks about any objections to the American counter proposals; a letter from <persName ref="prs:crampton_jft">Crampton</persName> to <persName ref="prs:clarendon">Clarendon</persName> discussing the likely objections that the Americans will have about the Reciprocity Treaty; and a letter from <persName ref="prs:crampton_jft">Crampton</persName> to <persName ref="prs:marcy_wl">Marcy</persName> asking the American Government to include <placeName ref="plc:vancouver_island">Vancouver Island</placeName> in the Reciprocity Treaty.

With reference to your Letter of the <date when="1856-08-30">30<hi style="vertical-align: super; font-size: 80%;">th</hi> of August last</date>
relative to the proposed extension to <placeName ref="plc:vancouver_island">Vancouvers' Island</placeName> of the terms of
the Reciprocity Treaty of <date when="1854-06">June 1854</date>, I am directed by the <persName ref="prs:clarendon">Earl of
Clarendon</persName> to transmit to you a Copy of a Dispatch and of its Enclosure
from Her Majesty's <fw type="catchword" style="text-align: right;">Minister</fw><pb facs="co_305_07/co_305_07_00172v.jpg"/>Minister at Washington on the same subject, and I am
to request that, in laying these Papers before <persName ref="prs:labouchere_h">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Secretary Labouchere</persName>, you will state that <persName ref="prs:clarendon">Lord Clarendon</persName> would wish to be informed
what answer should be returned to <persName ref="prs:crampton_jft">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Crampton</persName>, respecting the Counter
propisitions which <persName ref="prs:crampton_jft">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Crampton</persName> states will probably be made by the
United States' Government, namely, that in return for their acceding to
the request of Her Majesty's Government in regard to <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>,
the other possessions of the Two Countries on the Pacific Coast <fw type="catchword" style="text-align: right;">should</fw><pb facs="co_305_07/co_305_07_00173r.jpg"/>should
also be included in the Provisions of the Reciprocity Treaty.

5433/55, 7866/55) will, I think, be sufficient for y<hi style="vertical-align: super; font-size: 80%;">r</hi> purpose on this
subject.

<p>
Might not this opp<hi style="vertical-align: super; font-size: 80%;">y</hi> be taken to include the Falklands in any new
Reciprocity Treaty. The place is constantly poached upon by American
Fishermen—whom to punish is always a source of annoyance to the two
Gov<hi style="vertical-align: super; font-size: 80%;">ts</hi>—and, though it has nothing to reciprocate, it might possibly
derive advantage from the Accession of Shipping though only of the
fishing sort. I admit that it is rather travelling out of the
geographical limits contemplated in the New Treaty to include <placeName ref="plc:falkland">the
Falklands</placeName>; but it might be convenient to concede the fishing there as a
make-weight against some American claim, and not without advantage to
the Settlement itself, whilst we should be getting rid of a right which
it is difficult for us to prevent being trespassed upon.

I did not fail, in obedience to the instructions contained in Y.
Ldp's Despatch 189 of <date when="1856-09">Sep</date>: last, to bring under the attention of the
U. State's <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> the desire of H.M. <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> that the terms of the
Reciprocity Treaty of <date when="1854-06">June 1854</date> <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> now be applied to <placeName ref="plc:vancouver_island">Vancouver's
Island</placeName>, in addition to the other British North American Colonies therein.
</p>
<p>
<persName ref="prs:marcy_wl">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Marcy</persName>, when I first alluded to this subject, remarked that
before he could form any opinion in regard to the Expediency of such a
measure it <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> be necessary for him to consult some of the
Representatives in Congress of the States and Territories who might
be supposed to be more particularly interested in the matter.
</p>
<p>
Congress having since been assembled and at length organised, I took
an opportunity to bring the subject again under <persName ref="prs:marcy_wl">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Marcy</persName>'s attention,
and to explain to him the mutual advantages which might be expected
from a reciprocal trade between <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> and the neighbouring
parts of the U. States: and I also stated to him that the objection,
which had been raised on the part of H.M. <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> in <date when="1854">1854</date> to the
cession of the right of fishing on the shores of the British Territories
on the Pacific had, as far as the shores of <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> were
concerned, been removed.
</p>
<p>
Y. Ldp will probably recollect that at an early stage in the
negotiation of the Reciprocity Treaty <persName ref="prs:marcy_wl">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Marcy</persName> himself proposed to me
that the engagements of the Treaty, more especially as regarded the
fisheries, <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be extended to the British Possessions and the
U.S. Territories on the Pacific Coast of this Continent: but that this
was objected to by H.M. <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> on the ground that the British
Possessions on that Coast having been granted by Charter to the Hudsons'
Bay Company together with all Royalties and Rights thereunto
appertaining, it was out of the power of H.M. <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> to cede any such
Rights by Treaty.

<choice><abbr>Sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>Should</expan></choice> the U. States' <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> now think it expedient to enter upon
negotiations for embracing <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> in the provisions of the
Treaty, I think it probable that they <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> propose to include likewise
therein the other possessions of the two Countries on the Pacific Coast;
and they will not, I apprehend, fail to ask for a concession of the right
of fishing on the Coasts of the mainland of the British Possessions,
and on those of <placeName ref="plc:haida_gwaii">Queen Charlotte's Island</placeName>, as well as on those of
<placeName ref="plc:vancouver_island">Vancouver's Islands</placeName>; it might therefore perhaps be well that I <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be
in possession of the views of H.M. <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> in regard to this matter
before such negotiation <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be commenced.

I have in the meantime addressed a note to <persName ref="prs:marcy_wl">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Marcy</persName> of which
I have the honor to enclose a Copy, embodying the proposal of H.M.
<choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> in regard to <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>, with a view to its being
brought under the consideration of the U. States' <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice>.
