<p><persName ref="prs:shepherd_j">Shepherd</persName> writes to <persName ref="prs:labouchere_h">Labouchere</persName> acknowledging receipt of a letter regarding the inconsistency of <persName ref="prs:douglas_j">Douglas</persName>’s information on the Settlement on the <placeName ref="plc:san_juan_island">San Juan Islands</placeName>. <persName ref="prs:shepherd_j">Shepherd</persName> then discusses the proceedings on the <placeName ref="plc:san_juan_island">San Juan Islands</placeName>.</p> 
 
<p>The minutes discuss and agree that the <orgName ref="org:hbc">HBC</orgName> company made an intentional decision to encourage a settlement on <placeName ref="plc:san_juan_island">San Juan Island</placeName>, despite collisions with the United States. The minutes insist that the <orgName ref="org:hbc">HBC</orgName> desist correspondence with the <orgName ref="org:foreign_office">Foreign Office</orgName> of<placeName ref="plc:vancouver_island">Vancouver Island</placeName> affairs.</p>

I have the honour to acknowledge the receipt of <persName ref="prs:ball">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Ball</persName>'s letter
of the <date when="1856-02-22">22<hi style="vertical-align: super; font-size: 80%;">nd</hi> Instant</date>, enclosing, by your directions, copies of
Correspondence between the <orgName ref="org:colonial_office">Colonial Office</orgName> and the Governor of
<placeName ref="plc:vancouver_island">Vancouver's Island</placeName> on the subject of certain proceedings in the <placeName ref="plc:san_juan_island">Island of San Juan</placeName> in the <placeName ref="plc:haro_strait">Canal de Arro</placeName>: Stating that <persName ref="prs:douglas_j">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Douglas</persName> appears to
have given somewhat inconsistent information with reference to the
Settlement of that Island, and requesting the <orgName ref="org:hbc">Hudson's Bay Company</orgName> to
furnish Copies of such Correspondence as may have passed between
themselves and <persName ref="prs:douglas_j">Governor Douglas</persName> upon the subject.
</p>
<p>
In accordance with this request I have the honor to forward
Extracts of various letters addressed to <persName ref="prs:douglas_j">Governor <fw type="catchword" style="text-align: right;">Douglas</fw><pb facs="co_305_07/co_305_07_00275v.jpg"/>Douglas</persName>, with his
replies thereto and at the same time beg to lay before you the
circumstances connected with the occupation of the <placeName ref="plc:san_juan_island">Island of San Juan</placeName> by
the servants of the <orgName ref="org:hbc">Hudson's Bay Company</orgName>.
</p>
<p>
In <date when="1853-08">August 1853</date> the Queen's Advocate communicated, by authority of
the <orgName ref="org:foreign_office">Foreign Office</orgName>, with <persName ref="prs:barclay_a">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Barclay</persName>, the then Secretary of the
Company, on the subject of the American encroachments at the <placeName ref="plc:san_juan_islands">Islands in
the Canal de Arro</placeName>, and in consequence of what passed at that time it was
determined that instructions should be sent to <persName ref="prs:douglas_j">Governor Douglas</persName> to
secure possession of the <placeName ref="plc:san_juan_islands">Islands of San "Juan</placeName>" and "<placeName ref="plc:lopez_island">Lopez</placeName>."
</p>
<p>
The proceedings of <persName ref="prs:douglas_j">Governor Douglas</persName> in this matter were from time
to time reported to the Secretary of State for Foreign Affairs, as will
appear by the accompanying copies of letters; and on this point, I beg
leave to request your particular attention to the letter received by
the Governor and Committee from <persName ref="prs:clarendon">Lord Clarendon</persName> under date the <date when="1856-05-21">21<hi style="vertical-align: super; font-size: 80%;">st</hi>
May 1855</date> <fw type="catchword" style="text-align: right;">and</fw><pb facs="co_305_07/co_305_07_00276r.jpg"/>and to the communication made to <persName ref="prs:douglas_j">Governor Douglas</persName> by <persName ref="prs:grey_g">Sir George Grey</persName>, alluded to in the letter from the former addressed to the Governor
and Committee, dated <date when="1855-04-20">20<hi style="vertical-align: super; font-size: 80%;">th</hi> April 1855</date>.

<p>
The Directors of the <orgName ref="org:hbc">Hudson's Bay Company</orgName> are convinced that after
a reference to the Chart of the <placeName ref="plc:juan_de_fuca_strait">Straits of De Fuca</placeName>, and a perusal of the
whole of the correspondence that has taken place, you will be of opinion
that the <orgName ref="org:hbc">Hudson's Bay Company</orgName> have been actuated solely by a desire to
cooperate with Her Majesty's Government in retaining for the British
Crown a portion of territory secured to it by Treaty; and I may mention
to you that these Islands are of little advantage to the
<hi style="text-decoration: underline;">Fur Trade</hi> business of the Company,
<ref target="#marg2">**</ref>
though it is obvious that a Settlement of lawless American citizens so
near to <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> would be a great detriment to the peace and
prosperity of the Colony.

<p>
With reference to <persName ref="prs:griffin">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Griffin</persName>'s report to <persName ref="prs:douglas_j">Governor Douglas</persName> on the
subject of the outrage committed by the authorities <fw type="catchword" style="text-align: right;">of</fw><pb facs="co_305_07/co_305_07_00276v.jpg"/>of the United
States, I beg to request your attention to my letter of the <date when="1855-07-24">24<hi style="vertical-align: super; font-size: 80%;">th</hi> July
1855</date> to <persName ref="prs:clarendon">Lord Clarendon</persName>, and to an extract o f the Committee's letter to
<persName ref="prs:douglas_j">Governor Douglas</persName>, dated <date when="1855-07-30">30<hi style="vertical-align: super; font-size: 80%;">th</hi> July 1855</date>; by the former you will
perceive that the Directors of the <orgName ref="org:hbc">Hudson's Bay Company</orgName> lost no time in
informing Her Majesty's Government that the property seized by the
American authorities belonged to the Company, and by the latter that
they disapproved of, and censured <persName ref="prs:griffin">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Griffin</persName> for the ambiguous terms
of his Report.
</p>
<p>
The Directors have no doubt that both <persName ref="prs:douglas_j">Governor Douglas</persName> and <persName ref="prs:griffin">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Griffin</persName> were of opinion that the claims of an independent British
subject would be more likely to be respected by the authorities of the
United States, than those of the servants of the <orgName ref="org:hbc">Hudson's Bay Company</orgName>;
and this may be considered some extenuation of <fw type="catchword" style="text-align: right;">their</fw><pb facs="co_305_07/co_305_07_00277r.jpg"/>their proceedings under
very trying circumstances.
</p>
<p>
In reference to the last paragraph of <persName ref="prs:ball">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Ball</persName>'s letter, I beg to
assure you that the Directors of the <orgName ref="org:hbc">Hudson's Bay Company</orgName> have at all
times been most anxious to communicate with Her Majesty's Government
without reserve upon all matters forming the subject of correspondence
between them.

<p>
They are well aware that in the peculiar position in which the
<orgName ref="org:hbc">Hudson's Bay Company</orgName> stand with regard to the Colony of <placeName ref="plc:vancouver_island">Vancouver's
Island</placeName>, it is essential to the proper conduct of the affairs of that
Colony that entire confidence should exist between Her Majesty's
Government and the Company, and they venture to think that in this
respect you will find the accompanying correspondence with the Secretary
of State for Foreign Affairs <fw type="catchword" style="text-align: right;">completely</fw><pb facs="co_305_07/co_305_07_00277v.jpg"/>completely satisfactory.

But the matter by no means ends here. It is plain, 1. That the <orgName ref="org:hbc">HBC</orgName>.
occupied this island with the very deliberate consciousness that they
were likely to provoke a collision with the U.S. without our being in
the slightest degree informed thereof until the collision took place,
and then in an incorrect manner calculated to deceive. 2. That matters
of great importance to the island government have been habitually
transacted in corresp<hi style="vertical-align: super; font-size: 80%;">e</hi> between the Governor and the Company without
any information to us. 3. That the Company have been in the habit of
corresponding directly with the <orgName ref="org:foreign_office">Foreign Office</orgName> respecting the important
political questions arising on the frontier of <placeName ref="plc:vancouver_island">Vanc. I</placeName> without our
being informed. (Insomuch that, as will be seen from the last pages of
the <pb facs="co_305_07/co_305_07_00278v.jpg"/>second [set of] enclosures, the Company were pressing the For.
Office to get reparation from the Am<hi style="vertical-align: super; font-size: 80%;">n</hi> Government for damage done to
<hi style="text-decoration: underline;">their</hi> property on the <placeName ref="plc:san_juan_island">I. of S.Juan</placeName>, at a time when <hi style="text-decoration: underline;">we</hi> had only
intelligence of certain injuries inflicted by U.S. citizens on a <persName ref="prs:griffin">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Charles Griffin</persName>.)
</ab>
<p>
I certainly think this ought to cease at once. So long as the
Governor is a servant of the H.B.C so long we cannot compel him to
confine himself to the colonial office as his correspondent: we can
only urge on both the necessity of frankness. But with regard to the
For. office, I think the Company should be told plainly that they must
<hi style="text-decoration: underline;">desist altogether from the practice of corresponding with that</hi>
<hi style="text-decoration: underline;">department on <placeName ref="plc:vancouver_island">Vancouvers' Island</placeName> affairs</hi>. The H.B.C. have a long
American frontier in the interior of the continent, and have I daresay
been accustomed to consult the<pb facs="co_305_07/co_305_07_00279r.jpg"/> <orgName ref="org:foreign_office">Foreign Office</orgName> only as to its affairs.
But <placeName ref="plc:vancouver_island">Vancouver's Island</placeName> is a colony; the <choice><abbr>Se<choice><abbr>c<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>company</expan></choice></abbr><expan>Secretary</expan></choice> of State here is the
person responsible for its government: and I do not see how he can
execute that trust unless its affairs, international as well as
internal, are placed before him in the first place, &amp; before the Foreign
Office through him &amp; him only where he finds it necessary. <persName ref="prs:labouchere_h">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Labouchere</persName> will consider whether this matter is best settled by official
or private correspondence: but I should think the former: in which
case the best way might be to write a letter to the Directors, &amp; submit
it, in draft, to <persName ref="prs:clarendon">Lord Clarendon</persName> for his Concurrence.
