<p style="font-style: italic;">This document contains mentions of Indigenous Peoples. <p><persName ref="prs:shepherd_j">Shepherd</persName> writes to <persName ref="prs:labouchere_h">Labouchere</persName> saying he received <persName ref="prs:ball">Ball</persName>’s letter about the Reciprocity Treaty. He discusses some conditions of the Reciprocity Treaty and that <q>Her Majesty’s Government</q> desires a report from <persName ref="prs:simpson_g">Simpson</persName> before the conversation progresses.</p>
 
<p>The minutes question whether the <orgName ref="org:hbc">HBC</orgName> can request sole rights to coast and river fishing.</p> 
 
<p>Enclosed is a draft from <persName ref="prs:elliot_tf">Elliot</persName> to <persName ref="prs:shepherd_j">Shepherd</persName> questioning whether the <orgName ref="org:hbc">HBC</orgName> has the power to reserve fishing rights in certain areas of the Island.

I have the honour to acknowledge the receipt of <persName ref="prs:ball">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Ball</persName>'s letter
dated Downing Street <date when="1856-03-15">15<hi style="vertical-align: super; font-size: 80%;">th</hi> Instant</date> enclosing Copy of [a] letter
addressed to the <orgName ref="org:colonial_office">Colonial Office</orgName> by direction of the <persName ref="prs:clarendon">Earl of Clarendon</persName>,
transmitting Copy of a Dispatch from Her Majesty's Minister at
<placeName ref="plc:washington_territory">Washington</placeName> relative to the extension of the Reciprocity Treaty with the
United States to <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>, which in accordance with his
request I have laid before the Directors of the <orgName ref="org:hbc">Hudson's Bay Company</orgName>.
</p>
<p>
In reply, I have the honour to state that at present <fw type="catchword" style="text-align: right;">the</fw><pb facs="co_305_07/co_305_07_00327v.jpg"/>the Directors
of the <orgName ref="org:hbc">Hudson's Bay Company</orgName> are not aware of any objection to the
acceptance by Her Majesty's Government of the counter Proposition that
<persName ref="prs:crampton_jft">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Crampton</persName> expects will be put forward by the American Government;
provided due care be taken that the right of fishing reciprocally
conceded be restricted to sea fishing, and that the right of salmon
fishing whether in bays, creeks, <hi style="text-decoration: underline;">or along the coast generally</hi>, as
well as in rivers, and the mouths of rivers, be reserved to the Hudson's
Bay Company in the territory held under the exclusive Licence of Trade,
<ref target="#marg1">*</ref>
and also that it be understood that the said Treaty will not be
considered as giving any pretext to American Citizens to trade with <name type="ip" subtype="group">the
Indians</name> for Furs, or other articles.
</p>
<p>
At the same time I have to remark that, before giving a definite
answer, it would be <fw type="catchword" style="text-align: right;">satisfactory</fw><pb facs="co_305_07/co_305_07_00328r.jpg"/>satisfactory to the Directors to have a Report on
the subject from <persName ref="prs:simpson_g">Sir George Simpson</persName> who has visited the North West Coast
of America, and whose opinion on the subject would be extremely
valuable.
</p>
<p>
I propose to communicate with <persName ref="prs:simpson_g">Sir George Simpson</persName>, who is at present
in Canada, by the first opportunity, and would respectfully request that
no steps be taken in the matter until his reply be received, which may
be expected in course of post.

I am quite at a loss to know on what grounds the H.B.C. require to have
the right of coast &amp; river fishing on the NW coast of N<hi style="vertical-align: super; font-size: 80%;">th</hi> Am<hi style="vertical-align: super; font-size: 80%;">ca</hi>
secured to <hi style="text-decoration: underline;">them</hi> in the event of a treaty. Their license gives
them the right of exclusive trading with <name type="ip" subtype="group">the Indians</name> in that region, but
gives them nothing else. I would by no means urge on a controversy with
them, but when these pretensions are put forward it seems almost
necessary to ask the grounds on which they rest, lest silence should
hereafter be taken for consent?

In answer to your letter of the <date when="1856-03-20">20<hi style="vertical-align: super; font-size: 80%;">th</hi> Ulto</date> I am directed by <persName ref="prs:labouchere_h">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Secretary Labouchere</persName> to state that he shall be happy to receive the
proposed report from <persName ref="prs:simpson_g">Sir George Simpson</persName> on the extension of the
Reciprocity Treaty with the United States to <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>, but that
in the meanwhile he will thank you to inform him on what <fw type="catchword" style="text-align: right;">grounds</fw><pb facs="co_305_07/co_305_07_00329v.jpg"/>grounds you
require to have the right of Coast and River fishing on the North West
Coast of America secured to the <orgName ref="org:hbc">Hudson's Bay Company</orgName> in the event of the
extension of the Treaty.
