<p><persName ref="prs:douglas_j">Douglas</persName> forwards correspondence with <persName ref="prs:mcmullen_f">McMullen</persName> regarding deserted American soldier who have sought asylum on <placeName ref="plc:vancouver_island">Vancouver Island</placeName>. </p>

<p>The minutes transmit this report to the <orgName ref="org:foreign_office">Foreign Office</orgName> for them to assess the appropriateness of <persName ref="prs:douglas_j">Douglas</persName>’s actions. <persName ref="prs:merivale_h">Merivale</persName> hopes that <persName ref="prs:douglas_j">Douglas</persName> is wrong as it may be preferable that <q>deserters are to be given back on both sides.</q></p>

<p>Enclosed are four documents concerning the arrest of six men charged with desertion and robbery in the American territory; a draft from the <orgName ref="org:colonial_office">Colonial Office</orgName> to the <orgName ref="org:foreign_office">Foreign Office</orgName> forwarding a copy of the despatch, asking whether the course taken by <persName ref="prs:douglas_j">Douglas</persName> should be approved; and a draft reply from <persName ref="prs:lytton_egeb">Lytton</persName> to <persName ref="prs:douglas_j">Douglas</persName> confirming that he <q>acted properly</q> in declining to give up the deserters to American officials.</p>

1. I beg to enclose herewith for your information, copies of a
correspondence with <persName ref="prs:mcmullen_f">Fayette McMullen Esq<hi style="vertical-align: super; font-size: 80%;">re</hi></persName>, Governor of
<placeName ref="plc:washington_territory">Washington Territory</placeName>, relative to the rendition of certain
deserters from the United States Army, who are said to have
sought an asylum on <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>.

2. You will observe that the offences with which those parties
are charged in the affidavits accompanying <persName ref="prs:mcmullen_f">Governor McMullen</persName>'s
letter, are not such as appear to be within the terms of the
Treaty between Great Britain and the United States, of the <date when="1842-08-09">9<hi style="vertical-align: super; font-size: 80%;">th</hi>
August 1842</date>, for the mutual surrender of refugees from justice,
and that they would not have justified a rendition of the
parties so charged.
</p>
<p>
3. I therefore did not comply with <persName ref="prs:mcmullen_f">Governor McMullen</persName>'s
requisition.
</p>
<p>
4. I hope that the view taken of the sense of that Treaty in my
letter may be correct; otherwise I<fw type="catchword" style="text-align: right;">shall</fw><pb facs="co_305_09/co_305_09_00073r.jpg"/> 
shall no doubt receive your
instructions on the subject.
