Hammond informs the CO that Her Majesty’s Advocate General reports that Douglas acted properly in declining to deliver up to the United States Government the soldiers who had deserted from the Army of the United States.

The minutes write accordingly to Douglas.

Enclosed is a report from Harding, Kelly, and Cairns to Malmesbury advising that according to the treaty of 9 August 1842, Douglas acted correctly in the matter.

With reference to your letter of the 26th Ultimo, I am directed by the Earl of Malmesbury to transmit to you for the information of Secretary Sir Edward Bulwer Lytton a copy of a Report from HerMajesty's Majesty's Advocate General stating that the Governor of Vancouver's Island acted properly in declining to deliver up to the United States Government the soldiers who had deserted from the Army of the United States.
