<p><persName ref="prs:newcastle">Newcastle</persName> admonishes <persName ref="prs:douglas_j">Douglas</persName> for informing the Vancouver Island House of Assembly that <q>the Agent of the Hudsons Bay Company had agreed to defray the whole of the expense</q> for <q>the erection of certain buildings required for the public offices of the Colony,</q> noting among other points, that <persName ref="prs:douglas_j">Douglas</persName> could not <q>have expected when incurring this expense on the very eve of the termination of the [HBC] license, that any portion of the expense would be ultimately defrayed by Her Majesty's Government.</q> <persName ref="prs:newcastle">Newcastle</persName> directs <persName ref="prs:douglas_j">Douglas</persName> <q>to cease at once all farther expenditure on these buildings or other public works except such as may be incurred with the consent of the Legislature of <placeName ref="plc:vancouver_island">Vancouvers Island</placeName>.</q></p></abstract><correspDesc>

I have to acknowledge your despatch No. 17 of the
<date when="1859-05-14">14<hi style="vertical-align: super; font-size: 80%;">th</hi> of May last</date>,
transmitting for the information of Her Majesty's Government, copies of
your Correspondence with the House of Assembly of <fw type="catchword" style="text-align: right;">Vancouvers</fw><pb facs="rg7_g8c_02/rg7_g8c_02_00002v.jpg"/><placeName ref="plc:vancouver_island">Vancouvers Island</placeName> up
to the <date when="1859-05-07">7<hi style="vertical-align: super; font-size: 80%;">th</hi> of May last</date>.
</p>
<p>
From your message of the <date when="1859-07-07">7<hi style="vertical-align: super; font-size: 80%;">th</hi></date> respecting the erection of certain
buildings required for the public offices of the Colony, it would seem
that you informed the House of Assembly that the people of <placeName ref="plc:vancouver_island">the Island</placeName>
were not to defray the cost of these buildings, <!--<pb facs="co_410_01/co_410_01_00107r.jpg"/>-->and that the <fw type="catchword" style="text-align: right;">Agent</fw><pb facs="rg7_g8c_02/rg7_g8c_02_00003r.jpg"/>Agent of
the <orgName ref="org:hbc">Hudsons Bay Company</orgName> had agreed to defray the whole of the expense.
</p>
<p>
I am at a loss to understand the ground of these proceedings. Both
you and the Agent of the <orgName ref="org:hbc">Hudsons Bay Company</orgName> have been fully aware that
the license to the Company was about to terminate on the <date when="1859-05-19">19th of May</date>:
that on that event Her Majesty's Government had the power to repurchase
<fw type="catchword" style="text-align: right;">the</fw><pb facs="rg7_g8c_02/rg7_g8c_02_00003v.jpg"/><placeName ref="plc:vancouver_island">the Island</placeName> "in consideration of sums expended by the Company and the
value of their establishment:" and you were directed by <persName ref="prs:labouchere_h">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Labouchere</persName>,
as long ago as <date when="1859-02">February 1856</date>, to send home in anticipation of that
<!--<pb facs="co_410_01/co_410_01_00107v.jpg"/>-->event, the necessary accounts of what was due.</p>
<p>The Company were warned in <date when="1858-01">January 1858</date>, that this power of repurchase would be exercised: and there has <fw type="catchword" style="text-align: right;">been</fw><pb facs="rg7_g8c_02/rg7_g8c_02_00004r.jpg"/>been since a long correspondence, not yet terminated, between Her Majesty's Government and the Company as to the adjustment of accounts.

<p>
You cannot therefore have expected when incurring this expense on
the very eve of the termination of the license, that any portion of the
expense would be ultimately defrayed by Her Majesty's Government; and <fw type="catchword" style="text-align: right;">if</fw><pb facs="rg7_g8c_02/rg7_g8c_02_00004v.jpg"/>if
there has been any mistake on this point, I must direct you to cease at
once all farther expenditure <!--<pb facs="co_410_01/co_410_01_00108r.jpg"/>-->on these buildings or other public works
except such as may be incurred with the consent of the Legislature of
<placeName ref="plc:vancouver_island">Vancouvers Island</placeName>.

I send you copy of the letter which I have caused to be addressed
