I am commanded by my <orgName ref="org:admiralty">Lords Commissioners of the Admiralty</orgName> to send you
herewith, for the information of the <persName ref="prs:newcastle">Duke of Newcastle</persName>, a Copy of a
Letter from <persName ref="prs:baynes_rl">Rear Admiral Baynes</persName>, dated the <date when="1860-01-25">25<hi style="vertical-align: super; font-size: 80%;">th</hi> Jan<hi style="vertical-align: super; font-size: 80%;">y</hi> last</date>, N<hi style="vertical-align: super; font-size: 80%;">o</hi> 16,
with Copies of the Rear Admiral's Correspondence with the Governor
of <placeName ref="plc:vancouver_island">Vancouver Island</placeName>, relative to the joint Military occupation of the
<placeName ref="plc:san_juan_island">Island of San Juan</placeName> by this Country and by the United States.
</p>
<p>
My Lords are of opinion that it is to be regretted that <persName ref="prs:douglas_j">Governor
Douglas</persName> did not comply with <fw type="catchword" style="text-align: right;">the</fw><pb facs="co_305_15/co_305_15_00017v.jpg"/>the request of <persName ref="prs:baynes_rl">Rear Admiral Baynes</persName> to be
furnished with Copies, or at least with extracts, from the Instructions

<ref target="#marg1">*</ref>

upon which the requisition of the Governor was
made to the Rear Admiral for cooperation and assistance in concerting
measures for placing a British Force on the Island, equivalent to
that retained by the United States.
</p>
<p>
It must be apparent to the <persName ref="prs:newcastle">Duke of Newcastle</persName> that in complying with a
requisition of this description from the Governor of a Colony, a
Naval Commander in Chief must of necessity become responsible to his
own Department, and the simple perusal of documents in such a <fw type="catchword" style="text-align: right;">case</fw><pb facs="co_305_15/co_305_15_00018r.jpg"/>case
can rarely be sufficient to enable an Officer to place on record the
reasons which may induce him either to comply with or to decline
acting upon such requisitions, and my Lords trust that the attention
of <persName ref="prs:douglas_j">Governor Douglas</persName> may be called to the serious inconvenience which
might arise from the course which he adopted.
</p>
<p>
Their Lordships consider that every requisition addressed to a Naval
Commander in Chief should be accompanied by the fullest information
which can be furnished, and it appears to my Lords to have been an
error on the part of the Governor to suppose that in furnishing a
Copy of his Instructions

he would have been delegating <fw type="catchword" style="text-align: right;">his</fw><pb facs="co_305_15/co_305_15_00018v.jpg"/>his authority to an Officer, who was
not under his command, but was responsible to another Department for
the proper disposition of the Force under his own orders.

You will observe that the <persName ref="prs:newcastle">Duke of Newcastle</persName>'s despatch was marked
Confidential—that it was laid before <persName ref="prs:baynes_rl">Admiral Baynes</persName>, &amp; perused by
that Officer—&amp; that (see 2830/<date when="1860">60</date>) the Governor and the Admiral
having consulted together came to a mutual agreement on the subject.
<hi style="text-decoration: underline;">Subsequently</hi> to their interview and agreement, at least so I
understand it, the Admiral asked for a copy of the orders the
Governor had received, which was declined; <persName ref="prs:douglas_j">Douglas</persName> alleging that they
had been sent to him as <persName ref="prs:queen_victoria">the Queen</persName>'s Representative, &amp; that it was not
proper for him to give a copy of the S. of S. despatch without Express
directions. The Colonial regulations—see Sec. 178 P. 50—bear him
out in this respect; but I cannot but think it a mistake that he
should have treated the Naval Commander in Chief—the officer who had
to perform the duty of ordering the Marines to <placeName ref="plc:san_juan_island">San Juan</placeName>—with the
same reserve which he <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>would</expan></choice> have used with a subordinate official, or
with a private individual. And it was not unreasonable on the part
of the Admiral—who had already <choice><abbr>rec<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>received</expan></choice> instructions from the Adm<hi style="vertical-align: super; font-size: 80%;">y</hi> (<date when="1859-10-21">21
Oct</date>) and For: Office—to wish to have before him a copy of the
instructions sent to the Governor from this Office so that he might
compare one set of instructions with the other.
