I have laid before <persName ref="prs:russell_j">Lord John Russell</persName> your letter of the <date when="1860-01-18">18<hi style="vertical-align: super; font-size: 80%;">th</hi>
Instant</date>, inclosing Copies of <persName ref="prs:douglas_j">Governor Douglas</persName>' correspondence with
<persName ref="prs:scott">General Scott</persName> respecting the temporary adjustment of the question
respecting the <placeName ref="plc:san_juan_island">Island of San Juan</placeName>.
</p>
<p>
I am to state to you, in reply, for the information of His Grace The
<persName ref="prs:newcastle">Duke of Newcastle</persName>, that <persName ref="prs:russell_j">Lord John Russell</persName> considers that <persName ref="prs:douglas_j"><fw type="catchword" style="text-align: right;">Governor</fw><pb facs="co_305_15/co_305_15_00121v.jpg"/>Governor
Douglas</persName> has acted in conformity with his Instructions which did not
authorize his consenting to a joint occupation of the <placeName ref="plc:san_juan_island">Island of San
Juan</placeName>. Her Majesty's Government, however, being anxious to maintain
the most amicable Relations with the President of the United States,
and feeling the difficulty in which the President was placed by the
acts of <persName ref="prs:harney">General Harney</persName>, <fw type="catchword" style="text-align: right;">consented</fw><pb facs="co_305_15/co_305_15_00122r.jpg"/>consented as the <persName ref="prs:newcastle">Duke of Newcastle</persName> is aware,
sometime ago to the principle of joint occupation.
</p>
<p>
<persName ref="prs:russell_j">Lord John Russell</persName> has in consequence given to <persName ref="prs:lyons">Lord Lyons</persName> and the
<orgName ref="org:admiralty">Board of Admiralty</orgName> Instructions of which Copies have already been
sent to the <orgName ref="org:colonial_office">Colonial Office</orgName>: The question of civil and criminal
Jurisdiction does not appear to have been satisfactorily treated by
<persName ref="prs:scott">General Scott</persName>, and the <fw type="catchword" style="text-align: right;">settlement</fw><pb facs="co_305_15/co_305_15_00122v.jpg"/>settlement of this question in conformity with
the principle laid down by <persName ref="prs:marcy_wl">Secretary Marcy</persName> will no doubt engage the
attention of The <persName ref="prs:newcastle">Duke of Newcastle</persName>.

to have been drafted in conformity. I do not know whether anything
ought to be done on it? beyond conveying to <persName ref="prs:douglas_j"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Douglas</persName> (if this
has not been done) the formal approval of his conduct.

<persName ref="prs:marcy_wl">Secretary Marcy</persName>'s despatch, to which so much reference is made by the
Foreign office, is really quite general &amp; does not lay down any rule
of practical stringency. It is all very well to say we must exercise
mutual forbearance &amp; so forth, but how can the Federal authority
enforce forbearance on a State officer? And it seems from a despatch
received today from <persName ref="prs:douglas_j">Governor Douglas</persName> that there is an American
magistrate on the island: who as I conclude must belong to the State
of Oregon. See minute on that despatch.

It might, I think, be well to suggest to <persName ref="prs:russell_j">Lord J. Russell</persName> that a joint
military occupation of <placeName ref="plc:san_juan_island">San Juan</placeName> having been instituted, it wd. be far
more <pb facs="co_305_15/co_305_15_00123v.jpg"/>satisfactory if all civil authorities were withdrawn. We hear
that the Americans (i.e. <placeName ref="plc:washington_territory">Washington Territory</placeName>) have a Magistrate &amp;
Customs House
officer on the island, and we, it seems have also a magistrate
there. These gentlemen are much more likely to come into collision,
and to raise awkward questions of jurisdiction, than military or
naval officers wd. be—and such is evidently the opinion of <persName ref="prs:scott">Gen.
Scott</persName>. The <orgName ref="org:foreign_office">F.O.</orgName> might be referred to <persName ref="prs:scott">Gen. Scott</persName>'s views, and
recommended to propose to the U.S. <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> that the joint occupation
sh. be strictly a[nd] exclusively military—and the only law that
mild kind of martial law wh. <persName ref="prs:scott">Gen. S.</persName> proposes, consisting in the
expulsion of offenders, or in handing them over to the respective
local Gov<hi style="vertical-align: super; font-size: 80%;">ts</hi>. However, the more the authorities of the Territory
can be Kept out of the question, &amp; the more it can be kept in the
hands of the U. States (Federal) officers, the better.

I believe the withdrawal of all Civil Officers on both sides would be
the best plan, but I am afraid the U.S. will not consent. I will
write however to the <orgName ref="org:foreign_office">F.O.</orgName> and suggest it.

The best way will be to send copy of a despatch which I passed from
<persName ref="prs:douglas_j"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Douglas</persName> two days ago in which he mentions the American
Magistrate and Customs House Officer and state the danger of
collision arising from this [mixed?]

authority—reminding the <orgName ref="org:foreign_office">F.O.</orgName> that these must be State of Washington
Officers and therefore not under the control of Federal Authority.

island. And these could only be dealt with by officers having
