I am directed by the <orgName ref="org:treasury">Lords Commissoners of Her Majesty's Treasury</orgName> to
transmit to you a Report from Mess<hi style="vertical-align: super; font-size: 80%;">rs</hi> <persName ref="prs:foster_mh">Foster</persName> and <persName ref="prs:lewes">Lewes</persName>—who have been
appointed to examine the Accounts of the <orgName ref="org:hbc">Hudson's Bay Company</orgName>—and I
am to request that you will lay the same before the <persName ref="prs:newcastle">Duke of Newcastle</persName> and move His Grace to inform My Lords whether in his opinion the sum of £25,000 may now be safely advanced to the <orgName ref="org:hbc">Hudson's Bay Company</orgName> "on
account" of their claims in respect of <placeName ref="plc:vancouver_island">Vancouver Island</placeName>. Their
Lordships wish to be informed whether the representation made <fw type="catchword" style="text-align: right;">to</fw><pb facs="co_305_15/co_305_15_00551v.jpg"/>to the
Writers of this Report to the effect that the proceeds of the Land
Sales during the 7 Months ending <date when="1859-05">May 1859</date> have been paid by order of <persName ref="prs:douglas_j">Governor Douglas</persName> to the Government chest in lieu of being remitted home by the Agent of the Company is correct.

The Officers, appointed at the instance of <orgName ref="org:treasury">the Treasury</orgName> to make the
preliminary examination of the H.B.C<hi style="vertical-align: super; font-size: 80%;">o</hi> accounts, now report that if
there be proof in this Office or elsewhere that the proceeds of the
land sales in <placeName ref="plc:vancouver_island">V.C.I.</placeName> during the 7 months ending <date when="1859-05-31">31 May/59</date> have been
paid into the Colonial Chest instead of being remitted to the
H.B.C<hi style="vertical-align: super; font-size: 80%;">o</hi>, and if it be determined to prefer no claim to deduction
from the charge made by the C<hi style="vertical-align: super; font-size: 80%;">o</hi> for the conveyance of Emigrants to
the Colony then <pb facs="co_305_15/co_305_15_00552r.jpg"/>£25,000 may be paid on acc<hi style="vertical-align: super; font-size: 80%;">t</hi>. But if otherwise
that then £20,000 only should be paid.

Now with respect to the first hypothesis the only despatch bearing on
the point in our possession down to yesterday is that of
<date when="1859-11-24">24 Nov<hi style="vertical-align: super; font-size: 80%;">r</hi> 59</date>/871 which mentions that the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice>
had been "forced to apply the monies arising from the sale of public
Lands" to the current expenses of the Colony. The extent of such
appropriation is not therein stated. But yesterday we <choice><abbr>rec<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>received</expan></choice> a
despatch from <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> D. dated <date when="1860-04-07">7 Ap<hi style="vertical-align: super; font-size: 80%;">l</hi> 60</date>/5375—which I pass on
herewith—containing an abstract of the H.B.C<hi style="vertical-align: super; font-size: 80%;">o</hi> Account with H.M. G<hi style="vertical-align: super; font-size: 80%;">t</hi>
for disbursements in &amp; for <placeName ref="plc:vancouver_island">V.C. Isl<hi style="vertical-align: super; font-size: 80%;">d</hi></placeName> since it's first establishment
in /<date when="1849">49</date> to the <date when="1859-11-10">10 Nov<hi style="vertical-align: super; font-size: 80%;">r</hi>/59</date>. These accounts will have to undergo a
careful sifting before we can venture on accepting them as "true &amp;
correct". They may, however, serve us on the present occasion. For
in referring to the acc<hi style="vertical-align: super; font-size: 80%;">t</hi> N<hi style="vertical-align: super; font-size: 80%;">o</hi> 1 you will notice that whilst in /<date when="1858">58</date>
the proceeds from the sales <pb facs="co_305_15/co_305_15_00552v.jpg"/>of land amounted to £7890, the proceeds
reported in N<hi style="vertical-align: super; font-size: 80%;">o</hi> 2. for <date when="1859">1859</date> were only £425. Now as we know that a
good deal of Land has been sold of late I think it is to be assumed
that <persName ref="prs:douglas_j"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> Douglas</persName> has taken the proceeds for Governmental purposes.
This is, however, no more than an assumption; and we <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> prefer
something more definite &amp; to the purpose when paying away money to
the Hudson's B. C<hi style="vertical-align: super; font-size: 80%;">o</hi>. At any rate, I think, that, though it may
cause additional delay, we ought not to move in the matter without
communicating to the T-y the accounts just <choice><abbr>rec<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>received</expan></choice> &amp; asking them
whether they consider the inf<hi style="vertical-align: super; font-size: 80%;">n</hi> they contain sufficient to justify
the payment of this £25,000.
</p>
<p>
The second hypothesis of the reporters is as to making any deduction
from the sum to be paid to the C<hi style="vertical-align: super; font-size: 80%;">o</hi> for emigration expenses. I
presume that this point must be decided by the terms of the Grant of
<placeName ref="plc:vancouver_island">V.C.I.</placeName> to the C<hi style="vertical-align: super; font-size: 80%;">o</hi>. Those terms are
<milestone unit="section" rend=".ind on"/>
payment of sum or sums of money
theretofore laid out &amp; expended by them (the C<hi style="vertical-align: super; font-size: 80%;">o</hi>) in &amp; upon the said
Isl<hi style="vertical-align: super; font-size: 80%;">d</hi> &amp; premises &amp; of the value of their establishments, property &amp;
effects then being thereon,

and they do not seem, to me at least, to be expansive enough to
justify an attempt at any deduction being made on acc<hi style="vertical-align: super; font-size: 80%;">t</hi> of the
increased value of the C<hi style="vertical-align: super; font-size: 80%;">o's</hi> farms arising from Immigration effected
at the cost of the Empire.
</p>

I see no reason for delay on this subject nor for a reference back to
<orgName ref="org:treasury">the Treasury</orgName>. They have asked for our opinion and I think that we
have sufficient materials to give it.
</ab>
<p>
In the first place the idea started by one of our examiners that
instead of repaying to the Company the fair sum total of their
expenses on Emigration, we should make a deduction on the plea that
the introduction of Emigrants must have done good to their property,
appears to me utterly inadmissable. I should dismiss at once a
notion which appears to me sophistical and inconsistent with fair
dealing.
</p>
<p>
In the next place the newly <fw type="catchword" style="text-align: right;">arrived</fw><pb facs="co_305_15/co_305_15_00553v.jpg"/>arrived despatch to which <persName ref="prs:blackwood_aj">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Blackwood</persName>
refers, although it does not exhibit any clear view of the land
account for <date when="1859">1859</date> separately, does nevertheless show that on the whole
account of that single year, the Company has a claim of upwards of
£17000 to prefer against the Government.
</p>
<p>
For these reasons I strongly advise that we should at once reply to
<orgName ref="org:treasury">the Treasury</orgName> that in the opinion of this Department, the sum of
£25,000 may be safely advanced to the <orgName ref="org:hbc">Hudson's Bay Company</orgName>.
</p>
