16 September 1860, LAC RG7:G8C/2, 351</ref>], transmitting copy of a despatch from her Majesty's Chargeé d'affaires at Washington enclosing copies of his communications
with M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trescot on the subject of the substitution of Military for Civil jurisdiction in
<placeName ref="plc:san_juan_island">San Juan</placeName></q> and recommends that the civil magistrate on the island be withdrawn once the transfer has occurred.

I have the honor to acknowledge the receipt of Your Grace's despatch
No 35 of the <date when="1861-09-16">16<hi style="vertical-align: super; font-size: 80%;">th</hi> September</date> last, transmitting copy of a despatch
from her Majesty's Chargeé d'affaires at<fw type="catchword" style="text-align: right;">Washington</fw><pb facs="co_305_17/co_305_17_00015v.jpg"/> Washington
enclosing copies of his communications with M<hi style="vertical-align: super; font-size: 80%;">r</hi> Trescot on the subject of the
substitution of Military for Civil jurisdiction in <placeName ref="plc:san_juan_island">San Juan</placeName>.

2. I await your Grace's instructions for the withdrawal of the Civil
Magistrate from <placeName ref="plc:san_juan_island">that Island</placeName> whose legal jurisdiction virtually ceased when the sovereignty of the Island<fw type="catchword" style="text-align: right;">was</fw><pb facs="co_305_17/co_305_17_00016r.jpg"/> was admitted on both sides to be
in suspense. I would therefore, since no advantage can be gained
from his continuing to reside there, recommend the removal of that
Officer from the Island.

The foreign Office should be informed and kept in agreement with us,
but I apprehend that our Department ought to express an opinion

right.
