I have to acknowledge your letter of <date when="1862-12-11">11<hi style="vertical-align: super; font-size: 80%;">th</hi> instant</date> with one from the
<orgName ref="org:hbc">Hudson's Bay C<hi style="vertical-align: super; font-size: 80%;">o</hi></orgName> on the subject of the Land transferred to the Crown
in the <placeName ref="plc:victoria">Town of Victoria</placeName> <placeName ref="plc:vancouver_island">Vancouvers Isl<hi style="vertical-align: super; font-size: 80%;">d</hi></placeName> by the Agreement with the
<orgName ref="org:hbc">Hudsons Bay C<hi style="vertical-align: super; font-size: 80%;">o</hi></orgName> of the <date when="1861-02-03">3<hi style="vertical-align: super; font-size: 80%;">rd</hi> of February last</date>.
</p>
<p>
2. When that agreement was communicated to <persName ref="prs:douglas_j">Governor Douglas</persName> he
observed that the effect of it, so far from restoring any land to the
Crown would be to confirm the<pb facs="co_305_19/co_305_19_00445v.jpg"/> Company in claims which they had not
before been able to establish and he intimated that <persName ref="prs:dallas">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Dallas</persName> had
availed himself of his local knowledge in the matter to obtain this
advantage over the Government. <persName ref="prs:douglas_j">Governor Douglas</persName>' despatch was
referred to the Company—but in their answer they took no notice of
this charge. Their attention was called to the omission and <persName ref="prs:berens_hh">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Berens</persName> letter is his explanation of it.
</p>
<p>
3. He states that in his previous answer he had purposely avoided
noticing the imputation, because he was aware that the Governor
himself was in possession of<pb facs="co_305_19/co_305_19_00446r.jpg"/> Land which <persName ref="prs:dallas">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Dallas</persName> considered ought
to belong to the Government and because he was unwilling to give rise
to a discussion which must produce disagreeable feeling but could have
no useful result. He adds that as far as he is aware there were no
means in this country at the time the arrangement was entered into of
ascertaining precisely the unsold lands—but he sends plans of the
lots which the Company's Agent proposed should be surrendered to the
Crown.

<p>
4. It is, I believe, known at the <orgName ref="org:colonial_office">Colonial Office</orgName> from other sources
that <persName ref="prs:douglas_j">Governor Douglas</persName> owns a considerable extent of land in <placeName ref="plc:victoria">Victoria</placeName>,
<ref target="#marg1">*</ref>
and I do not see therefore<pb facs="co_305_19/co_305_19_00446v.jpg"/> that there would be any use in sending <persName ref="prs:berens_hh">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Berens</persName>' letter to the Governor. It would no doubt produce a
rejoinder from him and could not, as far as I can see, lead to any
practical result. But it might be desirable to furnish the Governor
with copies of the plans enclosed in <persName ref="prs:berens_hh">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Berens</persName>' letter, that it may
be ascertained whether they represent accurately the land which will
be surrendered to the Crown under the Agreement.
</p>
