<persName ref="prs:berens_hh">Berens</persName> informs <persName ref="prs:newcastle">Newcastle</persName> that the <orgName ref="org:hbc">HBC</orgName> agrees that it is not entitled to collect a
ten percent commission on land sales on <placeName ref="plc:vancouver_island">Vancouver Island</placeName> <q>from the time when by the payment of the agreed sum for this
<orgName ref="org:hbc">Company</orgName>'s expenditure on the <placeName ref="plc:vancouver_island">Island</placeName> the Government became entitled to a reconveyance of it.</q>
The <orgName ref="org:colonial_office">Colonial Office</orgName>, sensing a potential disagreement, recommends the letter be forwarded to <persName ref="prs:murdoch_twc">Murdoch</persName>
<q>at once.</q>

I have the honour to acknowledge the receipt of <persName ref="prs:elliot_tf">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Under-Secretary Elliot</persName>'s letter of the <date when="1861-10-22">22<hi style="vertical-align: super; font-size: 80%;">nd</hi> ultimo</date>, on the subject
of the Per Centage of 10 Per Cent reserved to this Company by the
Grant of <placeName ref="plc:vancouver_island">Vancouvers Island</placeName>, upon all sales that might be effected by
the Company and I beg to signify my entire concurrence that the
Company's right to that Per Centage should be considered<fw type="catchword" style="text-align: right;">at</fw><pb facs="co_305_19/co_305_19_00521v.jpg"/> at an end
from the time when by the payment of the agreed sum for this
Company's expenditure on the Island the Government became entitled to
a reconveyance of it.
</p>
<p>
I believe that sales have been made under the authority given by this
Company to <persName ref="prs:douglas_j">Governor Douglas</persName> with the particulars of which we are not
acquainted but upon which if made before the payment to this Company
of their advances I presume the Per Centage will be payable.
