<persName ref="prs:hamilton_ga">Hamilton</persName> forwards questions from the <orgName ref="org:treasury">Treasury</orgName> concerning
costs related to <q>the occupation of <placeName ref="plc:san_juan_island">San Juan</placeName></q> to <persName ref="prs:newcastle">Newcastle</persName>
through <persName ref="prs:rogers_f">Rogers</persName>. The <orgName ref="org:treasury">Treasury</orgName> is particularly concerned about
<q>the salary of a Magistrate at £250 a year.</q> <persName ref="prs:ebden">Ebden</persName> minutes that the magistrate <q>was required
I imagine for Imperial purposes and the Imperial
<choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> I suppose
should pay for him, but I cannot find any arrangement about salary.</q>

With reference to your letter of the <date when="1862-04-25">25<hi style="vertical-align: super; font-size: 80%;">th</hi> April 1861</date>, in regard to the funds from which the extra pay issued by <persName ref="prs:douglas_j">Governor Douglas</persName> to the
Royal Marines employed at <placeName ref="plc:san_juan_island">San Juan</placeName> <placeName ref="plc:vancouver_island">Vancouvers Island</placeName> is to be
defrayed I am directed by the Lords Commissioners of Her Majestys
Treasury to transmit herewith, for the information of the <persName ref="prs:newcastle">Duke of
Newcastle</persName>, copy of a letter addressed to the <orgName ref="org:admiralty">Admiralty</orgName> on the <date when="1861-12-26">26
December 1861</date>, with an extract<fw type="catchword" style="text-align: right;">from</fw><pb facs="co_305_19/co_305_19_00564v.jpg"/> from a letter from the War Department
dated <date when="1862-02-07">7 February last</date>, with copies of three Accounts of the
Expenditure of the sums drawn for service connected with the
occupation of <placeName ref="plc:san_juan_island">San Juan</placeName> by a Party of Royal Marines—viz

<p>
Including a balance of £2936-6-4 which it stated to be required
for arrears of Extra Pay.
</p>
<p>
I am also to transmit copy of a letter of this days date which My
Lord has addressed to the <orgName ref="org:admiralty">Admiralty</orgName>.
</p>
<p>
His Grace will observe that a portion of the Expenditure included in
these Accounts, has been incurred for Civil Service, to the extent of
£491.1.11<fw type="catchword" style="text-align: right;">the</fw><pb facs="co_305_19/co_305_19_00565r.jpg"/> the principal charge being for the salary of a Magistrate
at £250 a year.
</p>
<p>
Their Lordships wish to be informed whether this Salary and the other
Civil charges have received His Graces approval, and they would
remind His Grace that no provision has been made by Parliament for
any Civil Expenditure connected with the occupation of <placeName ref="plc:san_juan_island">San Juan</placeName>.
</p>
<p>
My Lords were under the impression until the receipt of these
Accounts that the Expenditure at <placeName ref="plc:san_juan_island">San Juan</placeName>, for which Bills have been
drawn by the Treasurer of <placeName ref="plc:vancouver_island">Vancouvers Island</placeName><fw type="catchword" style="text-align: right;">had</fw><pb facs="co_305_19/co_305_19_00565v.jpg"/> had reference only to the
expenses of the Royal Marines.
</p>
<p>
As it now appears that certain expenses have been incurred
unconnected with Military or Naval Service, My Lords apprehend that
it will be necessary to make special provision, as well to meet the
Civil Expenditure up to the present time, as to cover the expenditure
to be incurred hereafter, if it is considered necessary to continue
the service of the Magistrate, and other Civil Expenses.

This letter encloses accounts of the expenditure at <placeName ref="plc:san_juan_island">S. Juan</placeName> to the
<date when="1861-03-31">31<hi style="vertical-align: super; font-size: 80%;">st</hi> of March 1861</date> including a civil expenditure of £497.1.11.
</ab>
<p>
The Governors despatch N<hi style="vertical-align: super; font-size: 80%;">o</hi> 18 of the <date when="1861-03-30">30<hi style="vertical-align: super; font-size: 80%;">th</hi> of March last</date> encloses
further accounts to the end of <date when="1861">1861</date> viz £4222.2 Military and Naval
and £104.3.4 Civil. This despatch was ready to be sent to the
Treasury but <persName ref="prs:buckland_ec">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Buckland</persName> mentioned that a letter was on its way from
<orgName ref="org:treasury">the Treasury</orgName> and thought the despatch had better be delayed till our<pb facs="co_305_19/co_305_19_00568v.jpg"/>
answer.
</p>
<p>
The correspondence enclosed in <orgName ref="org:treasury">the Treasury</orgName> letter shows that, with
the exception of the civil outlay, the expenditure should be divided
between the <orgName ref="org:war_office">War Office</orgName> and the <orgName ref="org:admiralty">Admiralty</orgName>, the former taking barracks
and the latter the Royal Marines.
</p>
<p>
<orgName ref="org:treasury">The Treasury</orgName> propose special provision for civil expenses and ask how
far they have been approved. With the exception of two items
amounting to £21.18.4 for towing and piloting certain United States
vessels, the whole civil expenditure appears to have<pb facs="co_305_19/co_305_19_00569r.jpg"/> been for the
salary and office expenses of the Stipendiary Magistrate from his
appointment in <date when="1859-07">July 1859</date> to the abolition of his office in <date when="1861-07-07">July last</date>.
He was appointed in pursuance of the policy dictated by this office
on the <placeName ref="plc:san_juan_island">S. Juan</placeName> question, and was continued and removed by the same
authority. He was required I imagine for Imperial purposes and the
Imperial <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">t</hi></abbr><expan>Government</expan></choice> I suppose should pay for him, but I cannot find any
arrangement about salary. However its amount viz £20.16.8 a month or
£250 a year does not seem excessive and the contingencies do not
appear to have been beyond what must have been necessary.

the Magistrate in <placeName ref="plc:san_juan_island">San Juan</placeName> is a proper subject of Imperial charge,
his Salary must be provided for in any Estimate next year connected
with <placeName ref="plc:british_columbia">B Columbia</placeName>. The expense appears to have ceased.

office of Magistrate is abolished, so that there will be no further
Civil expenditure, so far as the <persName ref="prs:newcastle">Duke of Newcastle</persName> is aware, in
respect of the <placeName ref="plc:san_juan_island">Isle of San Juan</placeName>. State that His Grace would
recommend that the amount now due should be provided for by an item
upon any Estimates which it may be necessary to submit to Parliament
next year in connection with <placeName ref="plc:british_columbia">British Columbia</placeName>.
</ab>
<p>
In this memo: I assume that there is no other civil expenditure than
about the Magistrate. If I am wrong please let me know.
