The <orgName ref="org:colonial_office">Colonial Office</orgName> minutes their debate over <persName ref="prs:wakeford">Wakeford</persName>’s salary as well as his leave of absence and how it will be affected by <persName ref="prs:young_wag">Young</persName>’s leave of absence. <persName ref="prs:blackwood_aj">Blackwood</persName> minutes a suggestion that <persName ref="prs:kennedy_a">Kennedy</persName>’s efforts to find <q>permanent employ</q> for <persName ref="prs:wakeford">Wakeford</persName> as his secretary <q>looks suspicious.</q></p>

I have the honor to transmit a letter from <persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Henry Wakeford</persName> which
explains itself.

<p>
I have informed you in my Despatch N<hi style="vertical-align: super; font-size: 80%;">o</hi> 28 by this Mail that I have
appointed this Gentleman Acting Colonial Secretary during <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName>'s
absence and I should have found great difficulty in carrying on the<fw type="catchword" style="text-align: right;">Public</fw><pb facs="co_305_22/co_305_22_00238v.jpg"/>
Public Service here without his assistance.
</p>
<p>
I would hope that <persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Wakeford</persName> may be permitted to draw half salary
from his office in Western Australia till I am enabled to make
<hi style="text-decoration: underline;">permanent</hi> provision for him here.

<hi style="text-decoration: underline;">temporary</hi>: &amp; the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> asks that <persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> W.</persName> Salary from Western
Australia may be continued until
<hi style="text-decoration: underline;">permanent</hi> provision can be made for him. As the principal in
the Office of Col. <choice><abbr>Se<choice><abbr>c<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>company</expan></choice></abbr><expan>Secretary</expan></choice> of <placeName ref="plc:vancouver_island">V.C.I.</placeName> will, I presume, return to the
Colony it is difficult to say when
<hi style="text-decoration: underline;">"permanent</hi>" employment can be found for <persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Wakeman</persName>. Will you<pb facs="co_305_22/co_305_22_00239r.jpg"/>
favor me with y<hi style="vertical-align: super; font-size: 80%;">r</hi> observations on this proposal before I pass the
despatch on?

commencing <date when="1863-12-14">14<hi style="vertical-align: super; font-size: 80%;">th</hi> of December 1863</date> &amp; his leave will consequently
expire on the <date when="1864-12-14">14<hi style="vertical-align: super; font-size: 80%;">th</hi> of December next</date>.
It will rest of course with the Sec. of State to decide whether this
leave should be extended but I do not think that it ought to be
indefinitely prolonged as <persName ref="prs:kennedy_a">Governor Kennedy</persName> appears to suggest,
especially as there appears to be no reasonable prospect of his
obtaining permanent employment in <placeName ref="plc:vancouver_island">Vancouvers Island</placeName>.<fw type="catchword" style="text-align: right;">It</fw><pb facs="co_305_22/co_305_22_00239v.jpg"/> It will be
necessary to instruct the <orgName ref="org:ocac">Crown Agents</orgName> (with reference to our letter
of <date when="1864-03-15">15<hi style="vertical-align: super; font-size: 80%;">th</hi> of March</date>) to pay the half Salary due to him to <persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Wakeford</persName>
whom he has appointed to receive it.

<persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName>, Col: <choice><abbr>Se<choice><abbr>c<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>company</expan></choice></abbr><expan>Secretary</expan></choice> of <placeName ref="plc:vancouver_island">V.C.Isl<hi style="vertical-align: super; font-size: 80%;">d</hi></placeName>, was granted
by <persName ref="prs:douglas_j">Sir J. Douglas</persName> 12
months leave of absence commencing about the middle of <date when="1864-04">last April</date>.
That leave has not been confirmed, the Governor having been written
to to say whether <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName>'s absence for the whole 12 months would
inconvenience him. As the Governor has secured the services of <persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi>
Wakeford</persName>, his former official subordinate, the ans<hi style="vertical-align: super; font-size: 80%;">r</hi> will probably be
in the negative.
On the other hand <persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Wakeford</persName>s absence is for 12 months, ending the
<date when="1864-12-14">14 Dec<hi style="vertical-align: super; font-size: 80%;">r</hi>/64</date>. There is, therefore, a difference of 4 months between
the termination of the leaves of the respective officers. I do not
see that it devolves on us to square these absences so as to enable
<persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Wakeford</persName> to withdraw at the moment when <persName ref="prs:young_wag">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Young</persName> returns, tho'
considering how distant a place is W. Australia an extension of 4
months to the former is an indulgence which <persName ref="prs:cardwell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cardwell</persName> might
possibly grant. But what we have to see to is that <persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Wakeford</persName> only
receives 1/2 salary from W. Australia, during his absence from the
Colony and not
<hi style="text-decoration: underline;">until the Govr is enabled to make permanent provision for him
in <placeName ref="plc:vancouver_island">V.C.I</placeName></hi>.
That proposal of <persName ref="prs:kennedy_a"><choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> K.</persName> seems to me unusual, at all events in my
Division.

This is a proceeding <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> (after a little hesitation) I think a fair
one.

<persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Wakeford</persName> having served 8 years in W. Australia and receiving a
salary of 360£ a year and being therefore entitled under our rules to
considerable leave of absence, on half pay (180£ a year) takes that
leave &amp; goes to <placeName ref="plc:vancouver_island">V.C.I.</placeName> on the notion of getting employment from his
old W. Australian chief <persName ref="prs:kennedy_a">Gov. Kennedy</persName>.
</p>
<p>
He states this fairly to the Governor of W.A. agreeing that his
Australian 1/2 salary is to cease when he gets the Expected
employment in <placeName ref="plc:vancouver_island">V.C.I.</placeName> He gets at once an
<hi style="text-decoration: underline;">acting</hi>
apptmt as Colonial Secretary—on a half salary, as I collect, of
250£ a year.

<persName ref="prs:kennedy_a">Gov. K.</persName> applies that the acceptance of this acting and temporary
employment<pb facs="co_305_22/co_305_22_00246v.jpg"/> may not be held to terminate his right to his W.
Australian 1/2 salary.

<p>
I think this not unfair—since the Colonial Regulations Act 92
prescribe that an officer temporarily advanced to an acting
appointment "may be allowed half the salary of the office in <choice><abbr>w<hi style="vertical-align: super; font-size: 80%;">h</hi></abbr><expan>which</expan></choice> he
is so appointed to act together with the half salary of his own
office."
</p>
<p>
Answer therefore that <persName ref="prs:cardwell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cardwell</persName> considers that <persName ref="prs:wakeford">M<hi style="vertical-align: super; font-size: 80%;">r</hi> W</persName> may continue
to draw his half salary from W. Australia notwithstanding his
acceptance, on half salary, of the act[in]g appointment of Col. <choice><abbr>Se<choice><abbr>c<hi style="vertical-align: super; font-size: 80%;">y</hi></abbr><expan>company</expan></choice></abbr><expan>Secretary</expan></choice>
of <placeName ref="plc:vancouver_island">V.C.I.</placeName>
